When will the Vehicle Registration Department be on par with its counterparts at the Ministry of Transport?

No staff, operates like… a business.

According to Government Decree No. 56/2022/ND-CP dated August 24, 2022, regulating the functions, tasks, powers, and organizational structure of the Ministry of Transport , in addition to departments, institutes, schools, etc., the Ministry also has 8 specialized management bureaus, corresponding to the fields of: road, rail, aviation, maritime, etc.

Specifically, in the regulations concerning the functions, tasks, powers, and organizational structure of these Departments, they all perform the same duties: advising the Minister on managing their respective fields; drafting and submitting legal documents to competent authorities for promulgation; developing plans, projects, and strategies for the development of their sectors… yet in reality, their legal status is completely different. Accordingly, since its establishment, the Vietnam Register Department has had to operate autonomously and be responsible for its own tasks, organizational structure, personnel, and finances.

“This department has never been allocated civil servant positions. Salaries and benefits for employees here are implemented according to the mechanism of a… business enterprise. This is an unreasonable situation, a difference between the Vehicle Registration Department and the other specialized departments in the ministry,” Deputy Minister of Transport Nguyen Xuan Sang confirmed to PLVN.

The fundamental difference between a civil servant working in a state administrative agency and a public employee in a public service unit is that civil servants receive salaries funded by the state budget, while public employees do not.

In fact, at this point, the Vietnam Registering and Inspection Department does not receive any state budget allocation; in other words, it is financially autonomous. If so, how are positions such as Director, Deputy Director, and department heads defined, and what is their legal status within a state management agency under the Ministry of Transport?

“Although the positions at the Vehicle Registration Department are not on the civil servant payroll, the procedures, standards, and conditions for appointment or transfer all comply with the regulations of the Ministry of Transport on personnel organization. In short, the recruitment and appointment of personnel – the procedures – are no different from those of a civil servant or a civil servant holding a leadership position in other departments and bureaus under the Ministry,” Deputy Minister Sang said, adding that the Ministry of Transport has been coordinating with the Ministry of Interior to soon clearly and correctly define the legal status of the personnel there.

The Department is solely responsible for state management.

Reportedly, in addition to the procedures to "restore the name," the Ministry of Transport has also directed the reorganization of this Department in the future, separating the functions of state management of vehicle inspection from the function of providing public services, in order to improve service quality, save social costs, and ensure transparency, openness, and healthy competition among vehicle inspection service providers.

It is expected that the inspection centers under the Department will be responsible for providing public services; the Department of Inspection and some of its subordinate inspection branches will only perform state management functions, similar to the operational model of the Vietnam Maritime Administration, the Vietnam Aviation Administration, etc. However, the organizational structure of the Vietnam Department of Inspection may be more streamlined and equivalent in size to the Vietnam Railway Administration.

Previously, in February 2023, after a series of vehicle inspection centers had to close due to the prosecution and temporary detention of many leaders and inspectors at these centers and inspection branches under the Vietnam Register, leading to a serious shortage of professional and technical personnel, the Ministry of Transport at that time sent a document to the Ministry of Interior requesting permission for the Vietnam Register to sign labor contracts with its affiliated units until sufficient personnel were recruited according to regulations.

Shortly thereafter – in early March 2023, the Minister of Transport also transferred and appointed Mr. Nguyen Chien Thang, Director of the Enterprise Management Department of the Ministry, to the position of Director of the Vietnam Register.

Since then, the Ministry of Transport has only recently taken decisive action to reorganize the operational model of the Vietnam Register Department within the Ministry's authority, or to propose to higher authorities to promptly address the shortcomings following the shocking violations in this sector.

The Vietnam Register currently has 13 advisory and support organizations for the Director and 37 subordinate units. The Department's financial management mechanism is based on a wholly state-owned limited liability company model, with subordinate units accounting as dependents of the Department.
