Supplementing the remuneration scheme for forensic experts.

The Prime Minister issued Decision No. 22/2026/QD-TTg amending and supplementing a number of articles of Decision No. 08/2025/QD-TTg dated April 4, 2025 on the remuneration regime for forensic experts.

Decision No. 22/2026/QD-TTg amended and supplemented point d, clause 2, Article 3 of Decision No. 08/2025/QD-TTg by changing the regulations on the remuneration level for a person performing examinations of injury-causing objects, toxins, DNA, histopathology, based on records, and other types of examinations in the field of forensic medicine.

According to the new regulations, the remuneration for individuals performing forensic examinations of injury sources, toxins, DNA, histopathology, and other types of forensic examinations is as follows: 250,000 VND per case for qualitative drug analysis in biological fluid samples, hair samples, or quantitative alcohol analysis in blood samples, or analysis of single substances in biological fluids; 400,000 VND per case for quantitative drug analysis in biological fluids and hair samples; 400,000 VND per case for toxicology analysis from samples; 300,000 VND per case for nuclear DNA analysis; 500,000 VND per case for mitochondrial DNA analysis; 500,000 VND per case for analysis of the mechanism and type of injury source; 600,000 VND per case for toxicology analysis of organ samples and biological fluids. The fee is 800,000 VND per case for histopathological examination. The fee is 1,000,000 VND per case for examination based on documents.

In cases involving 10 or more samples, the expert assessment fee will be increased by 20% compared to the standard fee.

In cases where the above-mentioned tasks are performed by forensic experts, the daily allowance for forensic examination as stipulated in Article 2 of Decision No. 08/2025/QD-TTg shall apply. Thus, compared to the provisions of Decision No. 08/2025/QD-TTg, Decision No. 22/2026/QD-TTg has added a daily allowance of 400,000 VND per case for the examination of toxic substances from samples. Furthermore, it adds the provision that for the types of tasks mentioned in point d, clause 2, Article 3 of Decision No. 08/2025/QD-TTg performed by forensic experts, the daily allowance for forensic examination as stipulated in Article 2 of Decision No. 08/2025/QD-TTg shall apply.

Decision No. 22/2026/QD-TTg also amends regulations on funding sources and principles for paying remuneration for forensic expert services.

Accordingly, the funding for remuneration for forensic examination in criminal cases or other cases requested by competent procedural authorities shall be guaranteed by the state budget and allocated in the annual budget of the state agency or unit requested to conduct the examination. The funding for remuneration for individuals appointed by the prosecuting authority to perform tasks such as autopsy, dissection, or exhumation shall be guaranteed by the state budget according to the annual budget of that agency.

Annually, state agencies and units whose operating expenses are covered by the state budget and which are commissioned to conduct expert examinations must prepare a budget and request the competent authority to approve and allocate funds to ensure the payment of expert examination fees to the expert examiners and their assistants under their management. The prosecuting authority must prepare a budget and request the competent authority to approve and allocate funds to ensure the payment of expert examination fees to its personnel assigned to perform expert examinations in cases of autopsy, dissection, and exhumation.

The preparation, execution, and settlement of funds for the payment of judicial expert fees shall be carried out in accordance with the provisions of the law on the state budget and the law on accounting. The procedures, documents, and processes for advance payment and settlement of judicial expert fees shall be carried out in accordance with current laws on advance payment, settlement, and disbursement of state budget expenditures through the State Treasury.

The process of supplementing the budget during the year and handling state budget revenue and expenditure at the end of the year shall be carried out in accordance with the provisions of the law on the state budget.

In cases where agencies or organizations are applying specific financial and income mechanisms as prescribed by law, the funds for paying the remuneration for forensic expert services shall be taken from the regular operating budget of those agencies or units in accordance with specialized laws and other relevant legal provisions.

The costs of paying expert fees for forensic examinations in civil and administrative cases requested by the prosecuting authority at the request of the parties involved shall be borne by the parties involved in accordance with the law on procedural matters and the costs of forensic examination. The state agency or unit that assigns the expert to conduct the forensic examination is responsible for advancing and paying the expert fees to the expert and their assistants upon assignment of the examination task and upon completion of the examination.

The competent authority conducting the proceedings is responsible for advancing and paying the expert fees to those assigned to perform tasks during the examination of corpses, autopsies, and exhumations.

Decision No. 22/2026/QD-TTg takes effect from May 1, 2026. In cases where the expert assessment has been received and conducted before the effective date of this Decision, the payment of expert assessment fees shall be made in accordance with Decision No. 08/2025/QD-TTg dated April 4, 2025 on expert assessment fees.
