Continuing the program of the 9th Extraordinary Session of the 15th National Assembly, on the morning of February 12th, Group 18, comprising the delegations of National Assembly deputies from Thanh Hoa province, Ha Nam province, and Tra Vinh province, discussed in their group the draft Law amending and supplementing a number of articles of the Law on the Organization of the National Assembly and the draft Law on the Promulgation of Legal Normative Documents (amended).

The draft Law amending and supplementing a number of articles of the Law on the Organization of the National Assembly focuses on the following contents: amending and supplementing regulations on People's Councils and Committees of the National Assembly; amending and supplementing regulations on the Secretary General of the National Assembly, the National Assembly Office, and agencies under the Standing Committee of the National Assembly; adjusting some contents related to the delineation of authority between the National Assembly, the Standing Committee of the National Assembly and the Government and other state agencies; and simultaneously amending and supplementing a number of articles and clauses related to the activities of the National Assembly, the Standing Committee of the National Assembly, the agencies of the National Assembly and National Assembly deputies, which, through a review of practical activities from 2016 to the present, have revealed difficulties and inadequacies.

In their comments, National Assembly deputies generally agreed with the draft Law amending and supplementing several articles of the Law on the Organization of the National Assembly. They also stated that the amendments and supplements ensure flexibility in the organization and operation of the National Assembly, promptly institutionalizing policies agreed upon by the Politburo and the Central Committee, linking them to the requirements of legislative and supervisory work, and especially to the decision-making on important issues in the new situation.

National Assembly Deputy Cao Thị Xuân participated in the discussion at the group meeting.

Contributing his opinion on Article 5 concerning lawmaking and amendment, National Assembly Deputy Mai Van Hai, Provincial Party Committee member and Deputy Head of the Thanh Hoa Provincial National Assembly Delegation, stated that this is a very important aspect of the National Assembly's activities. Specifically, Point 2, Clause 2 stipulates certain issues of long-term stability and specifies details related to human rights. According to the Deputy, it would be more appropriate to include these provisions in the Law on Legal Normative Documents; at the same time, it is necessary to review and remove some of the content that reflects the Party's guidelines and policies.

Regarding the National Assembly's issuance of resolutions and regulations on piloting new contents within its authority, this content should not be included in the Law on Legal Normative Documents. Instead, it should be stipulated that the National Assembly issues pilot resolutions on new issues that have provisions different from current laws or issues not yet regulated by law. Regulations should be established in a principled and specific manner regarding the process of taking and casting votes of confidence for positions elected or approved by the National Assembly. Consideration should also be given to regulations concerning the handling of violations by National Assembly deputies...

Contributing to the discussion on Clause 4, Article 5, which stipulates the authority of the National Assembly, National Assembly Deputy Cam Thi Man stated that Clause 4 stipulates that the drafting of laws during each term is determined and implemented according to the legislative orientation of the National Assembly's term and the annual legislative program. Therefore, she proposed replacing the phrase "the drafting of laws" with "legislative work" to ensure the National Assembly's authority is properly exercised as stipulated in Article 69 of the Constitution, which states that the National Assembly exercises the power to amend the Constitution, the power to legislate, decides on important national issues, and exercises supreme oversight over the activities of the State.

Participating in the discussion on the organizational structure of the National Assembly's Ethnic Council and Committees, National Assembly Deputy Cam Thi Man stated that Clause 1 of Article 67, after amendment, stipulates as follows: The Ethnic Council consists of a chairman, vice-chairmen, and members; the National Assembly Committees consist of a chairman, vice-chairmen, and members. Currently, both part-time and full-time representatives at the local level register to participate as members of the Ethnic Council or committees. According to this regulation, do part-time and full-time representatives at the local level fall under the organizational structure of the Ethnic Council or the National Assembly Committees?

National Assembly Deputy Cam Thi Man agreed with the draft that it should not stipulate permanent and full-time members as in the current law. However, to further clarify the organizational structure of the National Ethnic Council, the National Assembly Committee proposed defining members as follows: permanent members are those permanent and full-time members at the central level as stipulated in the current law, and non-permanent members are full-time representatives at the local level and part-time representatives (representatives holding concurrent positions). Accordingly, it is proposed to amend Clause 1, Article 67 to: The National Ethnic Council consists of a chairman, vice-chairmen, permanent members, and non-permanent members; the National Assembly Committee consists of a chairman, vice-chairmen, permanent members, and non-permanent members. Alternatively, this provision could be considered for amendment in a Resolution of the National Assembly Standing Committee on the functions, tasks, and powers of the National Ethnic Council and the National Assembly Committee.

National Assembly Deputy Le Thanh Hoan participated in the discussion at the group meeting.

Participating in the discussion on the draft Law on the Promulgation of Legal Normative Documents (amended), National Assembly deputies generally agreed with the proposed amendments. They also stated that the amendments aim to promptly institutionalize the Party's policy on reforming and improving the law-making process; contributing to accelerating progress and improving the quality of drafting and promulgating legal normative documents, and perfecting the institutional framework to meet the requirements of national construction and development in the new era.
