SOME DIRECTIVE AND ADMINISTRATIVE DOCUMENTS OF THE GOVERNMENT AND PRIME MINISTER IN MAY 2025

The Prime Minister requested to abolish at least 30% of business investment conditions and reduce at least 30% of administrative procedure processing time.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 56/CD-TTg dated May 4, 2025 requesting ministries, branches and localities to focus on reducing and simplifying administrative procedures according to Resolution No. 66/NQ-CP dated March 26, 2025 of the Government.

The Prime Minister requires 100% of administrative procedures related to enterprises to be performed online.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 69/CD-TTg dated May 22, 2025 sent to Ministers, Heads of ministerial-level agencies; Chairmen of People's Committees of provinces and centrally run cities on focusing on completing the review, reduction and simplification of administrative procedures.

The dispatch requires ministries, branches and localities to focus on reviewing, cutting down and simplifying administrative procedures, ensuring that 100% of administrative procedures related to enterprises are carried out online, smoothly, seamlessly, effectively and transparently, minimizing paperwork; organizing the implementation of administrative procedures regardless of administrative boundaries within the province, to be completed in 2025.

Immediately put an end to the situation where businesses have to pay unofficial fees in carrying out administrative procedures.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 63/CD-TTg dated May 12, 2025 on rectifying discipline, enhancing responsibility, overcoming limitations, and creating a favorable investment and business environment for enterprises.

The Prime Minister directed to focus on cutting and simplifying administrative procedures in the construction sector.

Prime Minister Pham Minh Chinh signed Official Dispatch No. 78/CD-TTg dated May 29, 2025 on focusing on reducing and simplifying administrative procedures in the construction sector.

The dispatch requested the Minister of Construction to focus on implementing: Urgently reviewing, cutting, and simplifying 361 administrative procedures related to production and business activities, 447 business conditions under the management of the Ministry of Construction, ensuring a reduction of at least 30% of the time to handle administrative procedures, 30% of the cost of complying with administrative procedures, and 30% of business conditions in 2025, in which attention should be paid to researching, reviewing, cutting, and strongly simplifying administrative procedures in the construction sector.

The Government approved the Project dossier on rearranging provincial and communal administrative units in 2025.

The Government issued Resolutions on the Project dossier for rearranging provincial and commune-level administrative units in 2025.

Specifically, in Resolution No. 125/NQ-CP dated May 9, 2025, the Government approved the dossier of the Project on rearranging provincial-level administrative units in 2025 submitted by the Ministry of Home Affairs.

At the same time, in Resolution No. 126/NQ-CP dated May 9, 2025, the Government also approved 34 dossiers of the Project on rearranging commune-level administrative units in 2025 submitted by the Ministry of Home Affairs.

Building decrees on decentralization and delegation of power associated with the 2-level local government model in the financial and banking sector

In particular, the Prime Minister requested ministries, branches, People's Committees of provinces and centrally-run cities to proactively and actively grasp the existing problems, difficulties and obstacles in the production and business activities of state-owned enterprises to promptly have solutions to remove them, promote production and business according to their authority and legal regulations; promptly implement them effectively and take responsibility for assigning growth targets to state-owned enterprises under their management, monitor and urge the implementation, contributing to ensuring the national growth target of 8% or more in 2025...

Government Action Plan on Private Economic Development

The Government issued Resolution No. 138/NQ-CP promulgating the Government's Action Plan to implement Resolution No. 68-NQ/TW dated May 4, 2025 of the Politburo on private economic development.

The Resolution requires ministries, branches and localities to renew their thinking, reach high consensus on awareness and action, arouse national confidence and aspirations, create new impetus and momentum for private economic development; promote reform, improve and enhance the quality of institutions and policies, ensure and effectively protect ownership rights, property rights, freedom of business, equal competition rights and ensure contract enforcement of the private economy; facilitate the private economy's access to resources on land, capital and high-quality human resources; promote science and technology, innovation, digital transformation, green transformation, effective and sustainable business in the private economy.

At the same time, strengthen the connection between private enterprises, private enterprises with state-owned enterprises and FDI enterprises; form and rapidly develop medium and large enterprises, private economic groups of regional and global stature; substantially and effectively support small and micro enterprises and business households; promote business ethics, promote social responsibility, strongly promote the entrepreneurial spirit, and create all favorable conditions for entrepreneurs to participate in national governance.

The Government issued Resolution No. 127/NQ-CP dated May 13, 2025 implementing Resolution No. 187/2025/QH15 dated February 19, 2025 of the National Assembly on the investment policy for the Lao Cai - Hanoi - Hai Phong railway construction investment project (the Project).

The Resolution stated: The project is large-scale, has a long scope, applies new engineering technology, integrates many specialties, is the first electrified railway project implemented in Vietnam in the context of thin, weak and lacking railway human resources with a short research and implementation time; The project is allowed by the National Assembly to apply many specific and special mechanisms and policies for implementation.

In order to organize the implementation of the Project to meet the required quality and progress, in addition to regular tasks, the Government assigned ministries, ministerial-level agencies, and People's Committees of provinces and centrally-run cities to organize the implementation of the following tasks: Developing and promulgating legal documents; Implementing the Project; Implementing the task of urban development according to the transport development orientation (TOD) at railway stations.

The Government issued Decree No. 98/2025/ND-CP regulating the preparation of estimates, management, use and settlement of regular state budget expenditures for purchasing, repairing, renovating and upgrading assets and equipment; spending on renting goods and services; repairing, renovating, upgrading, expanding and constructing new construction items in invested and constructed projects and other necessary tasks.

The Decree stipulates that for tasks of purchasing, repairing, renovating, and upgrading assets and equipment with a total estimated cost of less than 45 billion VND/task: The Minister, Head of a ministerial-level agency, a government agency, or other central agency (Minister, Head of a central agency) decides or stipulates the authority to decide and approve the task and estimated cost.

For tasks of purchasing, repairing, renovating, and upgrading assets and equipment with a total estimated cost of implementation from 45 billion VND to less than 240 billion VND/task: The Minister or Head of a central agency decides to approve the task and estimated cost.

For tasks of purchasing, repairing, renovating, and upgrading assets and equipment with a total estimated cost of VND 240 billion/task or more:

In case it is not possible to arrange, allocate or adjust in the assigned medium-term public investment plan, ministries and central agencies shall be fully responsible for determining the necessity, objectives and budget estimates for the tasks of purchasing, repairing, renovating and upgrading assets and equipment using regular expenditure funds, ensuring compliance with legal regulations and in accordance with the principles specified above to send to the Ministry of Finance for synthesis.

Prioritize the development of high-quality human resources for the defense industrial complex.

The Government issued Decree No. 99/2025/ND-CP detailing a number of articles of the Law on Defense Industry, Security and Industrial Mobilization; which clearly stipulates the State's policies towards the defense industry complex.

The Decree stipulates that the Ministry of National Defense shall promulgate a strategy for the development of the defense industrial complex; assign tasks and long-term plans for defense production and manage the implementation of functions and tasks of the defense industrial complex through the core of the defense industrial complex.

Promote joint ventures and associations between components of the defense industrial complex: Issue technical and tactical standards and regulations in the military field for products of the defense industrial complex; Ministries and branches, according to their management functions, are responsible for supporting the provision of databases of enterprises to build the defense industrial complex; create conditions for components of the defense industrial complex to participate in military trade promotion programs, training programs, domestic and foreign survey programs related to groups and specialties of weapons and technical equipment products of the defense industrial complex.

The Ministry of National Defense prioritizes allocating funds to implement domestic and foreign training and development programs to develop high-quality human resources for the defense industry complex, especially human resources serving the research and development of weapons and technical equipment of strategic significance.

New regulations on the development mechanism of gas-fired thermal power projects

The Government issued Decree No. 100/2025/ND-CP dated May 8, 2025 amending and supplementing Decree No. 56/2025/ND-CP dated March 3, 2025 detailing a number of articles of the Electricity Law on electricity development planning, power supply network development plans, investment in electricity project construction and bidding to select investors in electricity business projects.

In particular, Decree No. 100/2025/ND-CP amends and supplements Clause 3 and Clause 4, Article 15 of Decree No. 56/2025/ND-CP on the mechanism for developing gas-fired thermal power projects.

According to regulations, gas-fired thermal power projects using domestically exploited natural gas are operated and mobilized at the maximum level according to gas supply capacity, meeting the binding requirements on fuel, capacity and available power generation output of gas-fired thermal power projects, and the needs and technical constraints of the national power system;

The above regulation applies to gas-fired thermal power projects for which the competent state agency has issued a written notice approving the results of the investor's acceptance of the project completion and has begun operating to generate electricity using domestically exploited natural gas before January 1, 2036. The application of the above mechanism shall continue to be applied until the time the gas-fired thermal power plant no longer uses domestically exploited natural gas for electricity generation.

In case the ability to supply domestically exploited natural gas cannot meet the electricity generation demand of the gas-fired thermal power plant project, the Electricity Seller and the Electricity Buyer shall negotiate and agree on the fuel usage plan and electricity price in the electricity purchase contract according to current regulations.

Unified and synchronized medical data management

The Government issued Decree No. 102/2025/ND-CP dated May 13, 2025 regulating the management of medical data. This is an important legal basis for medical data management, creating consistency and synchronization of the contents on creating, collecting, connecting, sharing, using and managing medical data.

This Decree regulates digital health data including the construction, development, protection, administration, processing, and use of digital health data; the national health database; and the responsibilities of relevant agencies, organizations, and individuals in the management of digital health data.

Policy for core defense and security industrial establishments

Some policies for core defense industrial establishments and core security industrial establishments are stipulated in Decree No. 103/2025/ND-CP dated May 15, 2025 of the Government.

The Decree stipulates that core defense and security industrial establishments are enterprises that enjoy policies on investment in construction; purchasing materials and preparing security factors, organizing research and production according to assigned tasks; preparing financial security factors and other support; hiring and paying for leading experts, scientists, and chief engineers; supporting the difference in social insurance and health insurance contributions.

Core defense and security industrial establishments that are not enterprises are entitled to policies in investing in the construction of technical infrastructure systems and social infrastructure systems; priority is given to budget allocation for the construction of technical infrastructure systems serving research and manufacturing in the fields of new materials, high-tech products, and the development of basic and core technologies.

Regimes and policies for mobilized people and people participating in fire fighting, rescue and relief

The Government issued Decree No. 105/2025/ND-CP dated May 15, 2025 detailing a number of articles and measures to implement the Law on Fire Prevention, Fire Fighting and Rescue, which specifically stipulates the regime and policies for mobilized people and people participating in fire fighting and rescue.

The Decree stipulates that mobilized persons, fire prevention, firefighting, rescue and relief workers who suffer accidents or injuries that reduce their ability to work will be paid a one-time allowance or monthly allowance, service allowance according to the level of reduced ability to work according to the conclusion of the Medical Assessment Council. The allowance level is equal to the one-time allowance or monthly allowance, service allowance for workers with reduced ability to work equivalent to the compensation level for workers who have occupational accidents that are not entirely caused by the worker himself/herself according to the provisions of the law on occupational safety and hygiene.

Administrative violations in fire prevention, fire fighting, rescue and relief are subject to fines of up to 100 million VND.

Decree 106/2025/ND-CP dated May 15, 2025 of the Government stipulates that the maximum fine in the field of fire prevention, fire fighting and rescue for individuals is 50 million VND. For organizations committing the same violation, the fine is twice the fine for individuals.

In particular, the Decree stipulates a fine of 10 million to 20 million VND for the act of not establishing a fire prevention, firefighting and rescue team at the facility; a fine of 40 million to 50 million VND for the act of not having a fire prevention solution for the charging area for electric motor vehicles concentrated indoors...

Reduce cement clinker export tax to 5%

According to Decree No. 108/2025/ND-CP dated May 19, 2025 of the Government, the export tax rate on cement clinker products will be reduced from 10% to 5% from now until the end of 2026 to support the domestic cement industry which is facing many difficulties.

New organizational structure of the Government Inspectorate after the reorganization

The Government issued Decree No. 109/2025/ND-CP dated May 20, 2025 stipulating the functions, tasks, powers and organizational structure of the Government Inspectorate.

According to regulations, the Government Inspectorate is a ministerial-level agency of the Government, performing the function of state management of inspection work, receiving citizens, handling complaints and denunciations, and preventing and combating corruption and negativity nationwide; performing inspection activities, receiving citizens, handling complaints and denunciations, and preventing and combating corruption, waste and negativity according to the provisions of law.

The Government Inspectorate consists of 22 units, including 20 administrative units, assisting the Government Inspector General in performing state management functions; 2 public service units, serving the state management functions of the Government Inspectorate.

Amending the financial autonomy mechanism of public service units

The Government issued Decree No. 111/2025/ND-CP dated May 22, 2025 amending and supplementing a number of articles of Decree No. 60/2021/ND-CP dated June 21, 2021 of the Government stipulating the financial autonomy mechanism of public service units.

In particular, Decree No. 111/2025/ND-CP amends regulations on financial autonomy for public service units that partially self-insure regular expenses (group 3 units).

Regarding the establishment of the Income Supplement Fund and the additional income expenditure of group 3 units, according to the new regulations in Decree No. 111/2025/ND-CP: During the period when the Government has not yet issued the salary regime according to Resolution No. 27-NQ/TW, the maximum establishment of the Income Supplement Fund shall not exceed 2 times the salary fund of the salary scale, rank, position and salary allowances prescribed by the State and salary according to the labor contract (if any).

Regarding the establishment of the Reward Fund and the Welfare Fund, Decree No. 111/2025/ND-CP stipulates the total deduction level for the two funds as follows:

Units that self-insure from 70% to less than 100% of regular expenses: Maximum provision is no more than 2.5 months of salary and average additional income realized during the year of the unit;

Units that self-insure from 30% to less than 70% of regular expenses: Maximum provision is no more than 2 months of salary and average additional income realized during the year of the unit;

Units that self-insure from 10% to less than 30% of regular expenses: Maximum provision is no more than 1.5 months of salary and average additional income realized during the year of the unit.

Decentralization of authority to grant licenses to establish commercial mediation centers to localities

The Government issued Decree No. 112/2025/ND-CP dated May 29, 2025 amending and supplementing a number of articles of Decrees in the field of judicial assistance. In particular, Decree No. 112/2025/ND-CP amends and supplements a number of articles of Decree No. 22/2017/ND-CP regulating commercial mediation.

Specifically, Decree No. 112/2025/ND-CP amends and supplements Article 21 of Decree No. 22/2017/ND-CP on procedures for establishing a commercial mediation center.

According to the new regulations, Vietnamese citizens who meet the criteria for commercial mediators as prescribed in Clause 1, Article 7 of this Decree and wish to establish a commercial mediation center shall submit an application for establishment via postal service or directly to the Department of Justice of the province or centrally-run city where the center is located or online on the National Public Service Portal (according to the old regulations, the application for establishment was sent to the Ministry of Justice).

Responsibility of the head in implementing the tasks of science and technology development and digital transformation of agencies and organizations

Decision No. 970/QD-TTg dated May 19, 2025 of the Prime Minister clearly states the responsibilities of heads of state agencies in leading and directing the implementation of tasks on science and technology development, innovation and digital transformation of agencies and organizations under their management, including: Responsibilities in thoroughly raising awareness and responsibilities of civil servants, public employees and employees about the goals, tasks and solutions for science and technology development, innovation and digital transformation; responsibilities in building and perfecting human resources to perform tasks on science and technology development, innovation and digital transformation of agencies and organizations under their management; responsibilities for preventing and combating corruption, negativity and waste in implementing tasks on science and technology development, innovation and digital transformation of agencies and organizations under their management.

By 2030, rapidly increase the scale of high-level training in STEM fields

Deputy Prime Minister Le Thanh Long signed Decision No. 1002/QD-TTg dated May 24, 2025 approving the Project on training human resources to serve high-tech development in the 2025-2035 period and orientation to 2045 (Project).

The specific goal of the Project by 2030 is to rapidly increase the scale of high-level training in STEM fields, especially basic sciences and fields related to digital technology, artificial intelligence and biotechnology. The proportion of people studying STEM fields will reach 35% at each training level, of which at least 2.5% will be in basic sciences and 18% will be in fields related to digital technology.

Training and fostering human resources for nuclear power development

Deputy Prime Minister Le Thanh Long signed Decision No. 1012/QD-TTg dated May 26, 2025 approving the Project "Training and fostering human resources for nuclear power development by 2035".

The goal of the Project is to meet the human resource needs for Ninh Thuan 1 and Ninh Thuan 2 nuclear power plants by 2030. In the period 2031 - 2035, strive to train and supplement human resources to meet the actual needs of nuclear power plants.

New regulations on retail electricity price structure

Deputy Prime Minister Bui Thanh Son signed Decision No. 14/2025/QD-TTg dated May 29, 2025 regulating the structure of retail electricity prices.

Retail electricity prices are specified in detail for each group of electricity customers, including: production, business, administrative and living.

In particular, the retail electricity price for the group of customers using electricity for domestic purposes includes 5 levels with increasing prices to encourage economical and efficient use of electricity (Level 1: For kWh up to 100 - The ratio compared to the average retail electricity price adjusted by authority (%) is 90%; Level 2: For kWh from 101 - 200 - 108%; Level 3: For kWh from 201 - 400 - 136%; Level 4: For kWh from 401 - 700 - 162%; Level 5: For kWh from 701 and above - 180%).

SOME NEW GOVERNMENT POLICIES TAKE EFFECT FROM JUNE 2025

Amending and supplementing regulations on invoice issuance time from June 1

Decree No. 70/2025/ND-CP of the Government takes effect from June 1, 2025, amending and supplementing Article 9 of Decree No. 123/2020/ND-CP on the time of invoice issuance.

According to the new regulations, the time of invoice issuance for the sale of goods (including the sale and transfer of public assets and the sale of national reserve goods) is the time of transfer of ownership or right to use the goods to the buyer, regardless of whether the money has been collected or not.

For export of goods (including export processing), the time for issuing e-commerce invoices, electronic value-added invoices or electronic sales invoices is determined by the seller, but no later than the next working day from the date the goods are cleared through customs according to customs regulations...

Regime and policies for senior experts who are cadres, civil servants and public employees

The Government issued Decree No. 92/2025/ND-CP dated April 25, 2025 stipulating the regime and policies for senior experts.

Specifically, for senior experts who are cadres, civil servants, and public employees, the Decree stipulates that those holding leadership or management positions with a position allowance coefficient of 0.9 or lower, or not holding leadership or management positions, are entitled to enjoy the following regimes and policies: Salary is ranked at level 1, salary coefficient 8.80 of the Senior Expert Salary Table; enjoy regimes and policies related to public service activities equivalent to the title of Assistant to senior leaders of the Party and State.

In case of holding a leadership or management position with a position allowance coefficient from 1.0 to 1.25, the employee is entitled to the following regimes and policies: Salary is ranked at level 2, salary coefficient 9.40 of the Senior Expert Salary Table; and is entitled to regimes and policies related to public service activities equivalent to the position of Deputy Minister.

In case of holding a leadership or management position with a position allowance coefficient of 1.30 or higher, they are entitled to enjoy the following regimes and policies: Salary is ranked at level 3, salary coefficient 10.0 of the Senior Expert Salary Table; enjoy regimes and policies related to public service activities equivalent to the title of Minister.

Decree No. 92/2025/ND-CP takes effect from June 15, 2025.

Violations in the enforcement of laws on handling administrative violations

On April 26, 2025, the Government issued Decree No. 93/2025/ND-CP amending and supplementing a number of articles of Decree No. 19/2020/ND-CP dated February 12, 2020 of the Government on inspection and disciplinary action in the enforcement of laws on handling administrative violations.

Decree No. 93/2025/ND-CP, effective from June 15, 2025, stipulates 20 violations in the enforcement of the law on handling administrative violations (Decree No. 19/2020/ND-CP stipulates 19 violations). Specifically:

1. Retain violations with signs of crime for administrative handling.

2. Forging or falsifying administrative violation records or records of application of administrative measures.

3. Taking advantage of one's position and power to harass, demand or receive money or property from violators; condoning, covering up or restricting the rights of violators when handling administrative violations.

3. Illegal interference in the handling of administrative violations.

5. Failure to make a record of administrative violations when detecting administrative violations according to the provisions of law.

6. Making records of administrative violations without proper authority, without proper administrative violations, and without proper administrative violators.

7. Violating the time limit for drawing up a record of administrative violations or violating the time limit for issuing a decision to sanction administrative violations.

8. Not issuing a decision to sanction administrative violations, not applying administrative measures to violators according to law provisions or not confiscating exhibits and means of administrative violations, not applying remedial measures according to provisions in Clause 2, Article 65 of the Law on Handling of Administrative Violations.

9. Sanctioning administrative violations, applying remedial measures or applying administrative handling measures without proper authority or procedures (except for cases being considered for handling violations specified in Clauses 5, 7, 8 and 10 of this Article), not to the right subjects according to legal regulations or applying incorrect or incomplete forms of sanction, levels of sanction, or remedial measures to administrative violations or failing to apply forms of sanction, remedial measures to administrative violations.

10. Incorrectly identifying the violation when issuing a decision to sanction an administrative violation, except in cases where the violation is considered for handling as prescribed in Clause 9 of this Article.

11. Extend the period of application of administrative measures.

12. Failure to amend, supplement, cancel, or issue new decisions in administrative sanctions or failure to promptly amend, supplement, cancel, or issue new decisions in administrative sanctions when errors or violations are discovered.

13. Failure to monitor, urge, inspect, and organize the implementation of decisions on administrative sanctions, decisions on confiscation of exhibits and means of administrative violations, and decisions on applying remedial measures as prescribed; failure to organize the enforcement of decisions on administrative sanctions and decisions on applying remedial measures as prescribed.

14. Illegal use of money collected from administrative fines.

15. Not providing or providing inaccurate, incomplete, or dishonest information or documents related to the content of the inspection of law enforcement on handling administrative violations.

16. Opposing or obstructing inspectors, threatening or repressing those who provide information or documents to the inspection team, causing difficulties in the inspection of law enforcement on handling administrative violations.

17. Illegal interference in the inspection of law enforcement on handling of administrative violations.

18. Providing or disclosing information, documents, and records of the inspected subject to organizations and individuals without authority or responsibility.

19. Failure to implement or incomplete and inaccurate implementation of the conclusion of the inspection of law enforcement on handling of administrative violations.

20. Lack of responsibility in directing the implementation of conclusions on inspection of law enforcement work on handling administrative violations.

Changes in conditions for opening dedicated airports from June 23, 2025

The Government issued Decree No. 101/2025/ND-CP dated May 9, 2025 amending and supplementing a number of articles of Decree No. 32/2016/ND-CP dated May 6, 2016 regulating the management of aviation obstacle heights and airspace management and protection sites in Vietnam and Decree No. 42/2016/ND-CP dated May 15, 2016 regulating the conditions, order and procedures for opening and closing specialized airports.

In which, Decree No. 101/2025/ND-CP amends and supplements Clause 1, Article 10 of Decree No. 42/2016/ND-CP on conditions for opening specialized airports:

- Serving the strategy of national defense, economic and social development;

- Comply with relevant legal provisions on airspace management, land management, environment, water resources, water surface areas, sea surface areas, airspace management, no-fly zones, restricted flight zones;

- The airport owner has been granted a Certificate and a Registration for specialized airport operations for the airport proposed to be opened to serve the purpose of regularly operating commercial flights.

The above regulations take effect from June 23, 2025.
