This morning, the National Assembly voted to pass a law amending 11 laws in the military and defense fields, including: Law amending and supplementing a number of articles of the Law on National Defense; Law on Officers of the Vietnam People's Army; Law on Professional Soldiers, Workers and Defense Officials; Law on Military Service; Law on Vietnam Border Guard; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Management and Protection of Defense Works and Military Zones; Law on Militia and Self-Defense Forces; Law on National Defense and Security Education.

The Law on Officers of the Vietnam People's Army has eliminated a number of positions of commander, political commissar of provincial border guard command, deputy commander, deputy political commissar of provincial border guard command; commander, political commissar of district military command; deputy commander, deputy political commissar of district military command.

The removal of some of the above positions is to ensure compliance with the Central Military Commission's plan to continue to reorganize local military organizations to be "lean, compact, and strong" to meet the requirements of tasks in the new situation.

The Law also adds the responsibility of the Chairman of the Provincial People's Committee to decide to call for training of reserve officers and call reserve officers to active service, train and inspect mobilization readiness and combat readiness of cadres, civil servants and reserve non-commissioned officers residing in the locality.

The reason why the Commander and Political Commissar of the Provincial Military Command do not hold the rank of general

Discussing the previous bill, there was a proposal to study with key areas to raise the highest military rank of Major General for the Commander and Political Commissar of the provincial military command, in relation to the People's Public Security force, especially after streamlining the apparatus, reducing provincial-level focal points and provincial Border Guard.

There is a proposal to study the regulation of general rank for Commander and Political Commissar of provincial military command, because when provinces merge, the responsibility of Commander is very large.

Explaining this proposal, the Government said that the draft only amends and supplements issues related to the arrangement of the apparatus of the political system and the organization of two-level local governments to ensure consistency with the provisions of the Constitution, the Law on Organization of Local Government (amended) and relevant legal provisions.

On the other hand, the Law on Officers of the Vietnam People's Army has just been amended in 2024, which stipulates the highest military rank for the positions and titles of officers and assigns the Government to stipulate positions with military ranks from Lieutenant General and below to ensure the number of positions with military ranks of General according to regulations of competent authorities. Therefore, the Government proposes to keep it as in the draft law.

There are suggestions to specify the highest military rank for the position and title of the Chairman of the National Defense, Security and Foreign Affairs Committee as Senior Lieutenant General; the Vice Chairman of the National Defense, Security and Foreign Affairs Committee as Lieutenant General; and the Standing Member of the National Defense, Security and Foreign Affairs Committee as Major General to be consistent with the Law on the People's Public Security.

Reporting on this content, the Government said that it has supplemented the draft law in the following direction: The seconded People's Army officer elected to hold the position of Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs has the highest military rank of Senior Lieutenant General. The seconded People's Army officer approved to hold the position of Deputy Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs or appointed to the position of Deputy Minister or equivalent position or title has the highest military rank of Lieutenant General.

A seconded officer of the People's Army approved to hold the position of Member is a full-time National Assembly delegate working at the National Assembly's Committee on National Defense, Security and Foreign Affairs or appointed to the position of General Director or equivalent position or title with the highest military rank being Major General.

There are suggestions to add the positions of Commander, Political Commissar, Deputy Commander, Deputy Political Commissar of the Border Guard Command, Commander, Political Commissar, Deputy Commander, Deputy Political Commissar of the Regional Defense Command to suit the organization established in the new units.

The Government said that in Conclusion No. 159 of the Politburo and the Secretariat, it determined to dissolve the District Military Command, establish the Regional Defense Command, a unit equivalent to the brigade level, directly under the Provincial Military Command, and dissolve the Provincial Border Guard Command, establish the Border Guard Command, a unit equivalent to the division level, directly under the Provincial Military Command.

Therefore, the positions of Commander, Political Commissar of the Border Guard Command and Deputy Commander, Deputy Political Commissar of the Provincial Border Guard Command no longer exist.

The position of Commander of the Border Guard Command is not regulated because the command and management positions of units equivalent to division and brigade levels (such as: Border Guard Command, Regional Defense Command) and the remaining equivalent positions and titles are under the authority of the Minister of National Defense.
