Commune People's Committee Chairman has more rights in education: Linked with individualizing responsibility

Commune level "shoulders the work" to help the department level

The Ministry of Education and Training has just announced the draft Circular guiding the functions, tasks and powers of the Department of Education and Training under the Provincial People's Committee; the field of education and training of the specialized department under the Commune People's Committee on the Electronic Information Portal to collect public comments.

Ms. Ta Thi Thanh Binh - Principal of Thanh Xuan Secondary School (Noi Bai, Hanoi ) said that although there are not many schools in a commune, the management of the head and deputy head, rewards and discipline decided by the Chairman of the Commune People's Committee ensures objectivity, is close to reality, and is suitable to the circumstances and needs of the schools. Most teachers and their families live near their workplace, so they understand the local characteristics.

“The professional advisory department of the commune -level cultural and social department advises the Chairman of the Commune People's Committee to decide on re-appointment, extension of working time to retirement age, dismissal, resignation, secondment... for the heads and deputy heads of educational institutions under its management, along with a number of other tasks. Thus, it is reasonable that the Chairman of the Commune People's Committee will perform the duties of the former Chairman of the District People's Committee,” Ms. Binh emphasized.

Expressing her agreement with this draft of the Ministry of Education and Training, Ms. Tran Thi Lien - Principal of Bac Lenh Primary School (Cam Duong, Lao Cai) said that the Ministry of Education and Training's addition of two new tasks that were previously not assigned to the Chairman of the People's Committee at the commune level according to the provisions of Decree 142 of the Government is consistent with the current situation when applying the two-level local government model, eliminating the district level.

The Chairmen of the People's Committees at the commune level are the ones who closely monitor and direct the contents related to local educational activities every day. The establishment of school councils, recognition of appointment, dismissal of the Chairmen of the school councils or replacement of members is also reasonable; previously, this content was issued by the People's Committees at the district level, but now that the district level is no longer there, it can be brought to the commune level to ensure smooth direction.

Basically agreeing with the policy in the draft because the commune level will "take on the work" to help the Department of Education and Training, however, Ms. Pham Thi Dung - Principal of Pung Luong Primary School (Pung Luong, Lao Cai) said that if the advisory department of the communes does not have expertise in education, it will somewhat affect the quality of advisory on the field of education that the State has decentralized to the commune level.

Many opinions from teachers and education managers also affirmed that the Draft has been developed to specify the provisions in Decree No. 142/2025/ND-CP regulating the division of authority of two-level local authorities in the field of State management of the Ministry of Education and Training and Decree No. 143/2025/ND-CP regulating the decentralization and delegation of authority in the field of State management of the Ministry of Education and Training. On the other hand, compared to the current document, this draft has many notable adjustments.

Enhance management effectiveness

From a grassroots perspective, Ms. Nguyen Thi Mai Van - Vice Principal of Ha Tri Kindergarten (Ha Dong, Hanoi) affirmed that in the local government system, the commune/ward level is closest to the people and directly grasps the actual conditions and specific characteristics of each educational institution in the area, especially for preschool and primary schools.

Decentralization and clear delegation of authority to the Chairman of the People's Committee at the commune level not only enhances the initiative and flexibility in management but also contributes to enhancing the effectiveness and efficiency of implementing educational policies at the local level. In fact, over the past many years, the role of the People's Committee at the commune level in educational management has sometimes been vague, mainly formal due to not being assigned enough necessary authority.

Important issues such as personnel work, organizational structure or rewards and discipline still depend heavily on the district level, leading to lengthy processing procedures, affecting the timeliness and effectiveness of direction and administration. Therefore, adding new tasks to the Chairman of the Commune People's Committee is a concrete step to realize the spirit of "decentralization and delegation of power associated with individualization of responsibility", a major direction in administrative reform that the Party and the State are striving to implement.

According to Ms. Van, to effectively implement the decentralization contents as in the draft, it is necessary to establish a close and clear coordination mechanism between the People's Committee at the commune level and the school. First of all, the People's Committee of the commune should assign a specialized officer, possibly the Vice Chairman in charge of culture - society or a cultural - educational official, to directly receive documents, check, evaluate and advise the Chairman to issue decisions within the authority and regulations of the law.

Schools need to proactively coordinate, prepare complete records, documents, evidence, minutes of school board meetings, etc. when proposing contents related to organization and personnel, while ensuring objectivity in all stages of implementation. In addition, both sides need to develop coordination regulations with clear regulations on responsibilities, processing time, procedures and unified administrative forms.

Ms. Mai Van proposed that it is necessary to enhance the training of legal knowledge, administrative skills and understanding of educational expertise for assigned staff, to ensure that the implementation of new tasks is not confusing or inaccurate, especially those requiring deep expertise such as recognizing principals, extending working time or disciplining staff.

From local reality, Mr. Nguyen Hai Son - Principal of Hai Xuan Secondary School (Hai Xuan, Ninh Binh) shared that assigning more authority and responsibility to the Department of Education and Training as well as the Chairman of the People's Committee at the commune level in the context of implementing the two-level local government model, eliminating the district level is appropriate and ensures the smoothness in the direction and operation of the new administrative apparatus to create the most favorable conditions for the people.

Mr. Son proposed that the provincial Department of Education and Training should closely coordinate with the commune level and base on local realities to mobilize and appoint education officials in schools from kindergarten to secondary school. The Department of Education and Training should focus on professional management and improving the quality of education, while the organization and finance aspects will be consulted with the commune People's Committee and the provincial People's Committee so that the province can make the final decision.

“The most important thing is that all decisions related to the organization and personnel in the school need to be made transparently, publicly, and in accordance with regulations to not only protect the rights and professional reputation of staff and teachers but also contribute to enhancing the trust of the team and society in the quality of education management in the locality,” said Nguyen Thi Mai Van, Vice Principal of Ha Tri Kindergarten (Ha Dong, Hanoi) .
