On the afternoon of May 22, the appellate session of the defendants in the case occurred at Dong Nai General Hospital continued with the questioning part.
In court, Hoang Thi Thuy Nga (former deputy general director of AIC) said that in the case the defendant was just a "salaried person". When the case happened, the legal authorities intervened, and the Russian defendant knew that his actions were collusion. The Russian defendant wants the court to review the crime charged in the indictment.
The first-instance judgment determined that Russia committed the crime of "violating regulations on bidding, causing serious consequences", so it should be sentenced to 12 years in prison.
When asked about the process of Ms. Nguyen Thi Thanh Nhan (former chair of AIC) bribing officials in Dong Nai province, defendant Hoang Thi Thuy Nga affirmed that she did not participate in this process.
“The defendant and Ms. Nhan attended meetings with provincial leaders. However, the defendant only presented the content of the job and the capacity of the company. The defendant was then invited out.” Russian accused.
Rebuting the Russian defendant's testimony in court, the representative of the Procuracy said that, on the basis of the facts collected from the computer and from the Russian desk, it showed that this defendant was involved in direct contact with the Russian Federation. Contact with the investor is Dong Nai General Hospital to "communicate the bid".
“Why does the defendant no longer work for AIC Company?”, The procuratorate asked more. The Russian defendant replied that he "remembered the testimony" but refused to repeat the reason why he quit.
The representative of the Procuracy then quoted Russia's testimony verbatim at the investigating agency with the following content: "I don't like to work at this company anymore because I feel unsafe, there are hidden things in the company."
From the above testimony, the Procuratorate said that Russia clearly understood the nature of her work and understood the obscurity in the company. Therefore, the fact that Russia wants the Appellate Panel to reconsider the crime of "violating regulations on bidding, causing serious consequences", is groundless, because the defendant herself has closely colluded with Nguyen Thi Thanh. Idle, commit crimes and cause damage.
Similarly, defendant Phan Huy Anh Vu (former director of Dong Nai General Hospital) denied the accusation of directing subordinates to facilitate AIC Company of Ms. Nguyen Thi Thanh Nhan to win the bid. The former director of Dong Nai Hospital only asked his subordinates to "don't cause any difficulties", after being introduced to this business by Secretary of the Provincial Party Committee Tran Dinh Thanh.
Mr. Vu recalled the context at that time "under great pressure" from the Provincial People's Committee and the Provincial Party Committee about the project progress. Mr. Vu received the requirement to be equipped with modern equipment, which not many companies can meet with modern equipment, so he chose AIC.
Regarding the amount of VND 14,8 billion, the former Director of Dong Nai Hospital did not admit that this was a bribe. The defendant stated that when he received it, he did not think it was a bribe and did not promise or agree to receive the money. Currently, his family has paid back the entire amount and overcome the consequences for an additional 500 million dong.
Mr. Vu said that after the project was completed, former Deputy General Director of AIC Tran Manh Ha (wanted) came to thank him. Mr. Vu said that 14,8 billion VND is a thank you gift from the business side.
Mr. Vu's appeal wishes to reduce the punishment and reconsider the crime. In the first-instance judgment, the Hanoi People's Court sentenced defendant Phan Huy Anh Vu to 9 years in prison for accepting bribes and 10 years in prison for violating regulations on bidding, causing serious consequences. Both crimes are 2 years in prison.
Also at the interrogation, the remaining 5 defendants who had valid appeals in the appellate session all sincerely declared; They expressed their remorse and regret, hoping the jury would consider giving them leniency of the law.
The trial will be adjourned at 17 p.m. and resume work tomorrow, May 23.
