The application of a specific mechanism on material mines according to Resolution No. 106/2023 has helped remove obstacles, promote progress, and overcome important bottlenecks affecting the completion of projects on schedule.
The Vietnam Road Administration ( Ministry of Construction ) has just reported on the summary of Resolution No. 106/2023 of the National Assembly piloting a number of specific policies on investment in road construction.
Resolution No. 106/2023 has removed many obstacles regarding materials.
According to Resolution 106/2023, the Vietnam Road Administration was assigned 5 projects including: Component project 2 of the Khanh Hoa - Buon Ma Thuot Expressway Construction Investment Project Phase 1; My An - Cao Lanh Expressway Construction Investment Project Phase 1; Cao Lanh - Lo Te route upgrading investment project in Dong Thap province and Can Tho city to reorganize traffic; Cho Moi - Bac Kan route construction investment project, Bac Kan province; Dau Giay - Tan Phu Expressway Construction Investment Project (Phase 1) under the PPP method.
The assignment of mines to contractors has helped speed up the progress of projects. To date, the Khanh Hoa - Buon Ma Thuot Component 2 Project has completed 45% of the contract value. The Cao Lanh - Lo Te Project has reached 81% of the contract value. The My An - Cao Lanh Project just started construction on July 26, 2025.
The Cho Moi - Bac Kan project started on March 15, mainly leveling the ground and dredging organic matter. The Dau Giay - Tan Phu project signed a contract and started on August 19.
In the context that many key transport projects have encountered difficulties in supplying construction materials, the Vietnam Road Administration stated that the application of a special mechanism on material mines under Resolution No. 106/2023 has helped remove obstacles, promote progress, and overcome important bottlenecks affecting the timely completion of projects. Resolution 106/2023 was effective until June 30 and has now expired.
Proposal to hand over material mines as soon as the project starts construction
In fact, the 2024 Law on Geology and Minerals has facilitated the shortening of the licensing procedures for the exploitation of Group IV minerals, allowing contractors to directly exploit them for important national projects and urgent public investment projects. However, sand from riverbeds, lakebeds and sea areas is not included in the list of Group IV minerals. This makes it difficult to source filling materials for projects in the South, because most of the filling materials are mainly sand. Some key expressway projects, although on a tight schedule, are not considered important national projects or urgent public investment projects.
At the 19th meeting of the State Steering Committee for important national projects and works, key to the transport sector, the Prime Minister assigned the Ministry of Agriculture and Environment to urgently submit to the Government a Resolution on specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals.
Therefore, the Department of Roads recommends that units in the project preparation phase need to carefully survey the material mine, evaluate the exploitation capacity, and consider other projects in the area. The implementation roadmap needs to have a full legal basis to hand over the mine to the contractor as soon as the project starts construction.
This agency also recommended that the Ministry of Construction urge investors, projects and component projects to implement on schedule; recommended that the Ministry of Agriculture and Environment should soon complete and submit to the Government a Resolution on specific mechanisms and policies under the direction of the Prime Minister.
