According to the Provincial Inspectorate, Ms. Khanh's land dispute with Mr. Bui Van Thuan ( 528m2 ) and Mr. Bui Van Tho ( 575m2 ) has been considered and resolved by the Chairman of the Provincial People's Committee, with appropriate support policies applied, and approved by the Government Inspectorate . Therefore, Ms. Khanh's continued complaints, requesting Mr. Thuan and Mr. Tho to return the land or compensate for the value of residential land, are groundless. Decision 263/QD-UBND, Decision 259/QD-CT.UBND, dated October 25, 2005 of the Chairman of the Provincial People's Committee resolved the matter in accordance with the law.
In addition, Ms. Khanh had a land dispute with Mr. Pham Van Net (1,300m 2 ), Mr. Tran Quoc Hung (1,200m 2 ) and Mr. Tran Tuan Kiet (1,200m 2 ). Ms. Khanh's land dispute with Mr. Net and Mr. Hung was also considered and resolved by the Chairman of the Provincial People's Committee, applying appropriate support policies, and was approved by the Government Inspectorate. Therefore, Ms. Khanh's continued complaint and request for compensation for land use rights value according to the land type for which a land use rights certificate (LURC) has been granted is not based on resolution. Decision 301/QD.UB.KN, dated October 20, 2003 of the Chairman of the Provincial People's Committee resolved it in accordance with the law; Ms. Khanh's complaint against Mr. Net was resolved by the Chairman of the Provincial People's Committee by issuing a Notice of termination of complaint resolution according to the plan agreed with the Government Inspectorate.
Regarding the dispute with Mr. Kiet, in 2015, the Department of Natural Resources and Environment reported in writing to the Chairman of the Provincial People's Committee: "The People's Committee of Phu Tan district cannot issue a decision to resolve the land dispute with Ms. Khanh, because the disputed land has been granted a land use right certificate. On the other hand, the land use right certificate has been transferred many times, so it cannot be revoked, according to the provisions of Point d, Clause 2, Article 106, Land Law 2013 and Clause 5, Article 87, Decree 43/2014/ND-CP, dated May 15, 2014 of the Government".
To resolve the State's responsibility and end the settlement of Ms. Khanh's complaint, the province has applied a support policy in a way that is beneficial to her to encourage and persuade her to agree. The support plan was agreed upon by the Government Inspectorate with the Provincial People's Committee in the Minutes of the meeting dated January 8, 2021, August 12, 2022. If Ms. Khanh does not agree with the province's support policy, it will not be considered for further settlement. The Chairman of Phu Tan District People's Committee's proposal of a settlement plan to instruct Ms. Khanh to file a land dispute petition to the People's Committee of Phu Tho commune is in accordance with the provisions of Article 152, Article 236 of the 2024 Land Law.
At the citizen reception meeting on April 15, 2025, the Provincial Inspectorate, local leaders, departments and branches encouraged and explained land law regulations over the periods, ensuring that the process of handling citizen complaints is in accordance with legal regulations, inspected, reviewed and notified in writing by competent State agencies, but Ms. Khanh still complained.
Concluding the dialogue, Alternate member of the Party Central Committee, Deputy Secretary of the Provincial Party Committee, Chairman of the An Giang Provincial People's Committee Ho Van Mung requested the specialized agencies to review the implementation of land policies for Ms. Khanh to see if they are in accordance with the law; and to re-examine the process of granting land use rights certificates to her in the above stages. Regarding Ms. Khanh's civil complaints, the Phu Tan People's Committee was assigned to work so that the parties could reach an agreement. If no agreement can be reached, she has the right to file a lawsuit in court.
The Chairman of the Provincial People's Committee assigned the Provincial Inspectorate to review and resolve Ms. Khanh's complaint; the People's Committee of Phu Tan district to review the case of citizens filing a complaint and whether the issuance of land use right certificates was in accordance with legal regulations; re-check the land location of Mr. Kiet, Mr. Net and Mr. Hung; coordinate with the Provincial Inspectorate to resolve land disputes in accordance with the law.
