The National Competition Commission ( Ministry of Industry and Trade ) said that recently, the unit has received consumer feedback about the phenomenon of discoloration occurring between the Ipad Pro 11-inch (M4) WiFi and Apple Pencil Pro when the two devices come into contact with each other during use.
According to the feedback, at the magnetic charging contact point between the two devices, there is an unusual discoloration, similar to a slight burn mark. This sign may be related to device safety, causing fire and explosion and the possibility of technical errors. Based on the consumer feedback, the National Competition Commission has sent a document requesting Apple Vietnam Co., Ltd. to provide relevant information and documents.
Based on the report of Apple Vietnam Co., Ltd., the National Competition Commission said that Apple Vietnam Co., Ltd. has received feedback on the above phenomenon. Through the process of reviewing images, information, and documents provided by consumers, the company determined that the discoloration phenomenon is an aesthetic/appearance issue, possibly caused by external contaminants such as dirt, moisture, or dust that has existed between the devices when charging.
Apple Vietnam Co., Ltd. affirms that this phenomenon does not affect the performance or function of the device and is not a sign of product safety. Currently, the company has not recorded any systemic safety issues for Ipad Pro 11-inch (M4) WiFi and Apple Pencil Pro.
According to the company's report, the above products have been tested and certified in accordance with international standards for information technology equipment (ITE) safety, including IEC 60950 and IEC 62368.
In the Vietnamese market, the iPad Pro 11-inch (M4) WiFi has been certified to comply with the National Technical Regulation on Safety of Telecommunications and Information Technology Equipment - QCVN 132:2022/BTTTT. However, according to the company's report, the Apple Pencil Pro is not covered by this regulation.
Based on the published warranty policy, for the above discoloration phenomenon, the company's warranty does not apply to the product's cosmetic/exterior damage. However, the company applies a 1-year limited warranty policy for iPad and Apple Pencil products in the Vietnamese market.
The Company's report shows that the aesthetic/appearance problem does not lead to "not ensuring safety for consumers, potentially causing damage to the life, health, or property of consumers," so there is no obligation to recall defective products and goods according to the provisions of the law on consumer rights protection.
Therefore, the National Competition Commission recommends that consumers proactively check the product condition after purchase and during use, especially when detecting unusual signs appearing on the device surface.
In addition, consumers need to keep information and images of the current status of the product, in case they need to report to the business or authorities. Proactively contact Apple support through the published channels to get advice and instructions on how to handle specific situations regarding the status of the device.
The National Competition Commission also noted that during the use of the product, if consumers discover or encounter risks related to unsafe products that can potentially cause damage to life, health or property, they are requested to promptly notify the competent state management agency for consumer rights protection in the locality (Department of Industry and Trade) to conduct verification and recall in accordance with the provisions of law.
The National Competition Commission will continue to monitor consumer feedback and require businesses to strictly comply with current legal regulations to ensure the legitimate rights and interests of consumers in Vietnam./.
