Guidelines on mechanisms for resolving long-standing backlogs in projects.

The government has issued Decree 147 guiding the implementation of specific mechanisms and policies to resolve difficulties and obstacles for stalled and long-standing projects as stipulated in Resolution No. 29 of the National Assembly.

Regarding the review of conditions for handling projects that have been granted certificates (land ownership certificates) improperly, as stipulated in Article 11 of Resolution No. 29, Decree 147 instructs the Department of Construction to preside over and coordinate with relevant agencies to review the project's conformity with planning regulations as prescribed by law on urban and rural planning.

The decree compiles the results of the assessment of conditions and prepares dossiers to be submitted to the provincial People's Committee for consideration and decision on allowing the adjustment of land use purposes or allowing the adjustment of land use purposes and land use duration in the land use certificate that are not in accordance with regulations for each project. The decree also specifies the types of dossiers to be submitted to the provincial People's Committee.

Meanwhile, the Department of Agriculture and Environment is tasked with determining land prices and transferring the information to the tax authorities so that the tax authorities can calculate the additional land use fees and land lease fees payable after the provincial People's Committee issues a decision allowing the adjustment of land use purposes or a decision allowing the adjustment of land use purposes and land use duration in the land use certificate that is not in accordance with regulations...

The land registration office is assigned responsibilities related to issuing land ownership certificates for projects and homebuyers.

Decree 147 also specifies the timing and method for determining land prices, calculating land use fees, and land lease fees for projects whose land use purpose is adjusted to residential land. It is noteworthy that if the amount of land use fees or land lease fees already paid exceeds the amount calculated based on the residential land price at the time the land use certificate was issued incorrectly, the state will not refund the difference.

Furthermore, Decree 147 also provides guidance on handling the continued allocation and leasing of land for projects that violate regulations on investor selection and land management and use. It also addresses investment projects on land that has already been reclaimed by the state, even if the land reclamation is not in accordance with the law.

The decree takes effect from May 7, 2026.
