ON INFRASTRUCTURE INVESTMENT, PRODUCTION DEVELOPMENT SUPPORT, POPULATION STABILITY ARRANGEMENT
Voters of Cang Ky village, Tung Qua Lin commune, Phong Tho district: More than 20 households in the villages of Cang Ky, Cang Ha, and Co Ky have pooled money to buy a piece of land on the negative slope at Km 31 + 570 of Provincial Road 132 from Dao San to Si Lo Lau to make a centralized garbage dump. On August 22, 2024, Construction Joint Stock Company 389 under the Department of Transport installed a guardrail fence, so there is no more entrance to dump garbage. Voters recommend that the Provincial People's Committee consult with the Department of Transport to consider removing a guardrail about 2 meters long or opening a hinged door to facilitate households to enter and dump garbage.

The Provincial People's Committee has directed the Department of Transport to coordinate with local authorities to conduct a field inspection at Km31+570/DT.132 (Km35+570/DT.132 according to the new route). The current status of this location has been installed with soft guardrails to ensure traffic safety. Through inspection, removing a guardrail bar of about 2 meters or opening a hinged door to facilitate households to enter and dump garbage as suggested by voters is not appropriate.
Reason: The terrain at Km31+570/DT.132 is a high mountain on one side and a deep abyss on the other, the road surface is narrow (grade VImn road), this location is located between two sharp turns, hugging the hill, limited visibility. Removing the guardrail or opening a hinged door has the potential to cause traffic insecurity, danger to vehicles participating in traffic. Propose that Phong Tho District People's Committee direct Tung Qua Lin commune to choose a garbage dump for households in Cang Ky, Cang Ha, Co Ky villages to ensure compliance with regulations, environmental sanitation and traffic safety.
Voters of Huoi Luong commune, Phong Tho district: Currently, on the Pa Tan - Huoi Luong - Pa Nam Cum traffic route, the section passing through Na Sa Phin village, Huoi Luong commune, there is a position where the roadbed and the roadside on the negative slope have sunk for about 20 meters, with the risk of causing landslides down to 5 households below; request the Provincial People's Committee to pay attention and direct the Department of Transport to arrange funds for repairs to ensure safety for the people.

The location of the voter's reflection is on the route Km22+495 - Km22+515 of Pa Tan - Huoi Luong - Pa Nam Cum road. After verification, the results are as follows:
The negative slope within the road corridor does not have cracks as mentioned by voters. According to voters, the subsidence of the roadbed and sidewalk is about 20m long, located within the area of Km22+495 - Km22+515 of the Pa Tan - Huoi Luong - Pa Nam Cum road, which is within the roadbed and surface. The Department of Transport will direct the repair during regular maintenance work in 2024.
For land outside the road area, no cracks have been found through field inspection. However, to ensure safety in the area, 5 households request the People's Committee of Huoi Luong commune to continue monitoring and inspecting and reporting to the People's Committee of Phong Tho district for timely resolution according to their authority.
Voters of Nam Ban commune, Nam Nhun district: The Provincial People's Committee should consider and build embankments for the Nam Ban commune Primary and Secondary School; because this location is currently at high risk of landslides.

Voters of Muong Te commune, Muong Te district: Currently, during the rainy season, the Nam Han stream bank through the village is often eroded, affecting the production area and posing a danger to households (about 100 households and 3-4 hectares of rice fields). Voters request the Provincial People's Committee to consider investing in Nam Han stream embankment, including 2 sections of about 600m (of which section 1 is about 400m, section 2 is about 200m).

The Provincial People's Committee has directed the Muong Te District People's Committee and specialized agencies to inspect and assess the necessity of investment as a basis for reporting to competent authorities for consideration; if it is really urgent, it will be proposed to be included in the medium-term public investment plan for the period 2026-2030.
Voters of Nam Ty Village, Nam Hang Commune, Nam Nhun District: Request the Provincial People's Committee to consider early arrangement of land for resettlement of residents in Nam Ty Village, Nam Hang Commune, because the village is currently at high risk of landslides affecting people's lives.

Currently, the province has a huge demand for investment capital for residential resettlement projects, while the central budget allocated to localities and the provincial budget are still limited, so priority should be given to implementing the resettlement of urgent residential areas first. The resettlement area for Nam Ty village, Nam Hang commune, Nam Nhun district is included in the list of medium-term public investment plans for the period 2026-2030 using public investment capital managed by the Ministry of Agriculture and Rural Development in Official Dispatch No. 3971/UBND-KTN dated October 2, 2024 of the Provincial People's Committee.
Voters of Bum Nua commune, Muong Te district: Currently, some hydropower plants built on Nam Bum stream and Nam Si Luong stream do not regularly maintain the minimum flow, affecting the water source for agricultural production of people downstream. Voters request the Provincial People's Committee to direct the Department of Natural Resources and Environment and related agencies and units to strengthen inspection and strictly handle according to the law for investors who do not maintain the minimum flow, affecting the production of the people.

The Provincial People's Committee has directed the Department of Natural Resources and Environment to request hydropower projects and works to maintain regular and continuous discharge after the dam of surface water exploitation and use projects (Official Dispatch No. 41/UBND-KTN dated January 5, 2024 of the Provincial People's Committee, Official Dispatch No. 329/STNMT-KSN dated February 5, 2024 of the Department of Natural Resources and Environment). In 2024, the competent authority imposed administrative penalties on 03 hydropower projects on Nam Si Luong stream, Nam Bum stream and Nam Nghe stream with a total amount of 740 million VND. In the coming time, the Departments of Natural Resources and Environment, Industry and Trade, Agriculture and Rural Development, People's Committees of districts and cities will continue to strengthen supervision and inspection of compliance with the maintenance of minimum flow according to regulations of hydropower projects and continue to handle organizations that do not comply with the directives of the Provincial People's Committee.
Voters of Tam Duong district: Propose that the Provincial People's Committee have a plan to build an embankment to prevent landslides along the Nam De stream bank from the beginning of Na Hum suspension bridge to the border of Na Ca village, about 900m long, to protect about 20 hectares of rice fields and crops.

Currently, the province has a huge demand for investment in population arrangement and relocation projects, especially river and stream embankment projects. However, due to limited capital, priority will be given to building river and stream embankments to protect residents. The Provincial People's Committee has directed the Tam Duong District People's Committee and specialized agencies to inspect and evaluate. If conditions are sufficient and resources can be arranged, they will consider and invest in order of priority.
ON REGIMES AND POLICIES
Voters of Hua Pan village, Nam Ban commune, Nam Nhun district: In 2024, the contractor caused landslides and cut across the Pa Tan - Muong Te road, affecting the production land and crops of Lo A Tao's household, Hua Pan village, Nam Ban commune. The contractor has committed to providing compensation and support, but has not yet done so. We request the Provincial People's Committee to request the contractor to promptly compensate and support the household as committed.

The Provincial People's Committee has directed the Department of Transport to coordinate with local authorities and road maintenance management units to verify voters' opinions at Km319+710/QL.4H (Pa Tan - Muong Te road), the results are as follows:
At Km319+710/QL.4H (Pa Tan - Muong Te road), during the floods in 2024, the positive slope collapsed to the roadbed and surface. To ensure traffic safety, the Department of Transport has directed the road maintenance management unit (Lai Chau Road Maintenance Joint Stock Company 1) to carry out landslide cleaning to ensure traffic congestion, not to cut or reduce traffic. The landslide cleaning work ensures traffic within the roadbed and surface does not affect the production land and crops of Lo A Tao's household, Hua Pan village, Nam Ban commune.
Through verification when performing traffic clearance at Km319+710/QL.4H (Pa Tan - Muong Te road) in 2024, the Contractor (Lai Chau Road Maintenance Joint Stock Company 1) did not commit to compensation and support as voters reflected.
Regarding the area of land for production and crops of the Lo A Tao household, Hua Pan village, Nam Ban commune, located on the slope of the slope that has been eroded to the ground and road surface due to natural disasters. The household is requested to propose their wishes to the local authorities for consideration and support according to current regulations.
Voters of Ban Nam Suong, Vang San Commune, Muong Te District: Many Mang ethnic households previously received support from the state for roofing according to Decision No. 1672/QD-TTg dated September 26, 2011 of the Prime Minister; until now, their houses have been damaged and degraded but they do not enjoy housing support policies under the National Target Program on Socio-Economic Development of Ethnic Minorities and Mountainous Areas for the 2021-2030 period. Voters request the Provincial People's Committee to pay attention and consider supporting policies for the above households.
The Provincial People's Committee responded as follows:
- The Prime Minister issued Decision No. 1672/QD-TTg dated September 26, 2011 approving the Project "Socio-economic development of the ethnic groups: Mang, Cong, La Hu, Co Lao" to be implemented in Lai Chau province from (2013 - 2020). The content of housing support is implemented according to the support principle under Article 3 of Decision No. 167/2008/QD-TTg dated December 12, 2008 of the Prime Minister: "The State supports, the community helps, and households contribute to build a house with a minimum usable area of 24m2; the life of the house is 10 years or more".
- Up to now, the houses have been damaged and degraded but are not entitled to housing support policies under the National Target Program on Socio-Economic Development for Ethnic Minorities and Mountainous Areas for the 2021-2030 period, for the following reasons:
In 2024, Mang ethnic households in Nam Suong village, Vang San commune, Muong Te district are not eligible for support (because the households have received housing support under Decision No. 1672/QD-TTg) but the age of the house is not enough 10 years or more according to the provisions of Decision No. 167/2008/QD-TTg.
The Provincial People's Committee assigned the People's Committee of Muong Te district to direct relevant professional agencies to continue reviewing if households are eligible for support under the National Target Program on Socio-Economic Development in Ethnic Minorities and Mountainous Areas for the period 2021-2030 according to Decision No. 1719/QD-TTg dated October 14, 2021 of the Prime Minister (Phase I: from 2021-2025), make a record, synthesize, appraise and advise the People's Committee of Muong Te district to approve the support beneficiaries in accordance with current regulations.
Voters of Pac Pa Village, Vang San Commune, Muong Te District: Some households in the village have received support policies for temporary housing demolition under Project 245 of the Ministry of Public Security. However, currently, these households are subject to emergency relocation due to natural disasters but are not eligible for relocation support policies. Voters request the Provincial People's Committee to pay attention and consider having relocation support policies for these households.
The Provincial People's Committee responded as follows:
Pac Pa village, Vang San commune, Muong Te district is identified as an area at high risk of landslides. The Provincial People's Committee has issued Decision No. 1472/QD-UBND dated October 18, 2024 on declaring a natural disaster emergency in Pac Pa village, Vang San commune, Muong Te district. Currently, the Provincial People's Committee is considering allocating funds for implementation. Regarding support policies: For households that are subject to emergency relocation, they will enjoy support policies according to the provisions of Decision No. 590/QD-TTg dated May 18, 2022 of the Prime Minister on approving the Population Dispatch Program for areas: Natural disasters, special difficulties, border areas, islands, spontaneous migration, special-use forests for the period 2021 - 2025, with a vision to 2030 and related documents.
Voters of Bum To commune, Muong Te district: Currently, teachers have received a new salary increase with a basic salary of 2,340,000 VND/month. However, contract employees according to Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government at schools (janitors, security guards...) with a low income of only about 5 million VND/month will not receive a salary increase. Some contract employees have quit their jobs due to low salaries, not ensuring enough to cover living expenses; request the Provincial People's Committee to pay attention and consider.
The Provincial People's Committee responded as follows:
According to Decision No. 30/2021/QD-TTg dated October 10, 2021 of the Prime Minister on promulgating principles, criteria and norms for allocating regular state budget expenditure estimates in 2022, which does not stipulate expenditure norms for subjects of labor contracts according to Decree No. 68/2000/ND-CP dated November 17, 2000 and Decree No. 161/2018/ND-CP dated November 19, 2018 of the Government (now Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government on contracts for certain types of work in administrative agencies and public service units). Based on the actual situation and the ability to balance the local budget, the Provincial People's Council issued Resolution No. 58/2021/NQ-HDND dated December 10, 2021 stipulating the principles, criteria and norms for allocating the regular expenditure estimates of the local budget in 2022 in the province, in which Articles 13 and 29 stipulate the allocation norm for labor contract subjects in accordance with Decree No. 68/2000/ND-CP and Decree No. 161/2018/ND-CP of the Government in public service units at 90 million VND/person/year. If calculated on average/month, this norm is higher than the current regional minimum wage stipulated in Clause 1, Article 3 of Decree No. 74/2024/ND-CP dated June 30, 2024 of the Government on the minimum wage for employees working under labor contracts.
On June 30, 2024, the Government issued Decree No. 73/2024/ND-CP regulating the basic salary and bonus regime for cadres, civil servants, public employees and armed forces, in which the basic salary applied from July 1, 2024 is VND 2,340,000/month. However, the Decree does not apply to labor contract subjects according to Decree No. 111/2022/ND-CP of the Government. Therefore, there is currently no basis for supplementing funds to increase salaries for contract staff at agencies and units. Based on the allocation norms in Resolution No. 58/2021/NQ-HDND dated December 10, 2021 of the Provincial People's Council and the allocated budget in the 2024 budget estimate, districts are requested to make payments in accordance with regulations. At the same time, at Point a, Clause 2, Article 8 of Decree No. 111/2022/ND-CP stipulates: "Employees doing support and service work as prescribed in Clause 1, Article 4 of this Decree shall receive wages and other benefits as agreed in the labor contract". Therefore, the monthly contract salary may increase if units balance existing resources for support.
Voters of Tan Uyen town, Tan Uyen district:
According to the provisions of Resolution No. 15/2020/NQ-HDND dated July 10, 2020 of the Provincial People's Council: "Civil servants, public employees, and employees working at the Provincial Public Administration Service Center are entitled to a support level of VND 1,000,000/person/month. Civil servants and public employees working at the District One-Stop Department are entitled to a support level of VND 700,000/person/month. Civil servants working at the Commune One-Stop Department are entitled to a support level of VND 300,000/person/month". In fact, the number of records at the commune level is very large. Voters proposed that the Provincial People's Committee consider increasing the support level based on the total number of records actually received by each agency and unit to limit disadvantages for agencies with many records.
The Provincial People's Committee responded as follows:
Currently, the support level for civil servants and public employees working at the One-Stop Department at all levels in the province is implemented according to Resolution No. 15/2020/NQ-HDND dated July 10, 2020 of the Lai Chau Provincial People's Council on regulations on support policies for civil servants, public employees and employees working at the Provincial Public Administration Service Center and the One-Stop Department at the district and commune levels in the province. Accordingly, the support level for commune-level civil servants working at the One-Stop Department is:
(1) Partial support for living expenses of VND 300,000/person/month (provincial level is VND 1 million/person/month; district level is VND 700,000/person/month);
(2) Support for sewing uniforms: VND 2,000,000/person/year (this support level is similar to the support level for civil servants at provincial, district and commune levels).
The level of support is issued based on local regulations and practical conditions (ability to balance the budget).
Regarding this issue, the Provincial People's Committee will direct specialized agencies to review and study voters' recommendations to evaluate and advise in accordance with actual conditions.
Propose that the Provincial People's Committee increase the rate of civil servants receiving support at the commune-level one-stop shop. In fact, civil servants at the commune and town levels all have administrative procedures, must receive documents and return results, but only receive support for 04 comrades.
The Provincial People's Committee responded as follows:
According to Point b, Clause 4, Article 10 of Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on implementing the one-stop, one-stop mechanism in handling administrative procedures, it is stipulated that "Civil servants working at the Reception and Result Delivery Department of the People's Committee at the commune level are civil servants holding the positions of commune-level civil servants prescribed in the Law on Cadres and Civil Servants assigned by the Chairman of the People's Committee at the commune level based on the specific situation in the locality". On the other hand, according to Clause 4, Article 7 of Circular No. 01/2018/TT-VPCP of the Government Office guiding the implementation of a number of Articles of Decree No. 61/2018/ND-CP stipulating the authority to approve personnel assigned to work at the One-stop Department at all levels, it is stipulated that: "The Chairman of the People's Committee at the commune level approves the list of personnel assigned to work at the Reception and Result Delivery Department at the commune level".
Thus, based on the above regulations, the number of civil servants working at the One-Stop-Shop at the commune level is decided by the Chairman of the People's Committee at the commune level and enjoys the regime and policies according to current regulations.
Voters of districts and cities: Implementing Resolution No. 21/2024/NQ-HDND dated July 17, 2024 of the Provincial People's Council on regulations on criteria for establishing teams, criteria for the number of members; support and training levels for forces participating in security and order protection teams at the grassroots level in Lai Chau province, effective from August 1, 2024; many communes and towns in the province have issued Decisions to establish security and order protection teams at the grassroots level since the end of July 2024. However, according to Decision No. 1380/QD-UBND dated October 1, 2024 of the Provincial People's Committee on allocating and supplementing funds for provincial budget units and districts and cities to implement regimes, policies and tasks arising in 2024, districts and cities are only allocated funds to implement Resolution No. 21/2024/NQ-HDND for a period of 4 months (9, 10, 11, 12). Voters asked the Provincial People's Committee to clarify whether the grassroots security and order protection teams established since the end of July will receive support in August 2024?
The Provincial People's Committee responded as follows:
Pursuant to Clause 5, Article 14 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level and the Decision of the Provincial People's Committee stipulating the number of Security and Order Protection Teams that need to be established, the number of Security and Order Protection Team members in villages and residential groups under the management of each commune-level administrative unit, the Chairman of the Commune-level People's Committee, upon the request of the Commune-level Police, decides to establish the Security and Order Protection Team and each member of the Security and Order Protection Team.
Decision No. 33/2024/QD-UBND dated August 19, 2024 of the Provincial People's Committee on the number of security and order protection teams; the number of security and order protection team members in villages, hamlets, residential groups, and neighborhoods in communes, wards, and towns in Lai Chau province takes effect from September 1, 2024. Therefore, after the Provincial People's Committee issued the Decision regulating the number and members of the security and order protection team, the Chairman of the Commune People's Committee issued the Decision to establish the security and order protection team and each member of the security and order protection team. Therefore, the Provincial People's Committee does not allocate funds for members participating in the security and order protection team in August 2024.
Voters of Tung Qua Lin commune, Phong Tho district:
According to Decision No. 50/2024/QD-UBND dated October 11, 2024 of Lai Chau Provincial People's Committee, compensation support for crops (cardamom) has been applied at the rate of (Planting year 1: 32,000 VND/1 clump; Planting year 2: 38,000 VND/clump; Harvest stage: 85,300 VND/dry kg). But currently, applying Decision No. 30/2017/QD-UBND dated August 14, 2017 of Lai Chau Provincial People's Committee with the support level (newly planted under 2 years: 24,000 VND/clump; planted from 2 years to less than 3 years: 72,000 VND/clump; planted from 3 years or more: 192,000 VND/clump), people do not agree, have difficulty in mobilizing land recovery to open a road to the border, requesting the Provincial People's Committee to consider.
The Provincial People's Committee responded as follows:
Cardamom is identified as a perennial crop that can be harvested multiple times; the stable harvest cycle is about 10 years. According to Article 103 of the 2024 Land Law, compensation for perennial crops when the State reclaims land is based on the actual damage value of the garden. The basis for determining the unit price for cardamom compensation is as follows:
In the basic construction phase (year 1 and year 2), the compensation unit price is calculated based on the total cost of seeds, fertilizers, planting and care according to the economic and technical standards approved by the competent authority: In year 1, the total investment cost for 1 hectare is about 53,143,960 VND/1660 clumps = 32,000 VND/1 clump; in year 2, the total investment cost (year 1+2) is 63,828,920 VND/1660 clumps = 38,000 VND/clump, which is appropriate according to the actual damage value.
Harvesting stage (calculated from the 3rd year onwards): The compensation level at this stage is the unharvested output corresponding to the remaining years in the cycle, multiplied by the unit price of VND 85,300/kg (the product selling price minus investment costs).
For example: At the time of compensation, Mr. Nguyen Van A's family had 1 hectare of cardamom that had been planted for 5 years, of which 2 years had been harvested, so the remaining harvest cycle was 8 years. According to the 2023 survey data, the cardamom yield was about 500 kg of dried fruit/ha, with the prescribed planting density of 1,660 clumps/ha, the average yield was 0.3 kg of dried fruit/clump. The compensation level for 1 hectare of cardamom was: 500 kg x 8 years x 85,300 VND/kg = 341,200,000 VND/ha; calculated by clump = 0.3 kg/clump x 8 years x 85,300 VND/kg = 204,720 VND/clump.
In case the cardamom garden is out of cycle but still gives harvest, compensation will still be paid = actual yield x price at the time of compensation.
For example: Actual output is estimated at 500 kg/ha, with an average selling price of about 120,000 VND/kg, then the compensation level = 500 kg x 120,000 VND = 60,000,000 VND/ha.
The Provincial People's Committee issued Decision No. 50/2024/QD-UBND dated October 11, 2024 stipulating the unit price for compensation for damage to crops and livestock and support for relocation of livestock when the State acquires land in Lai Chau province, ensuring compliance with the provisions of the 2024 Land Law and in accordance with reality. Districts and cities need to continue to propagate so that people understand and direct to calculate compensation plans to ensure compliance with regulations.
Voters recommend that the province consult with the Central Government to consider and amend a number of criteria according to Decision 1300/QD-BYT dated March 9, 2023 of the Ministry of Health to suit the economic conditions of each locality and region (In criterion 3: Infrastructure of commune health stations, section 14 stipulates that the main works of commune health stations are ranked from level III or higher).

In Decision No. 1300/QD-BYT dated March 9, 2023 of the Ministry of Health promulgating the National Criteria for Commune Health by 2030, it is stipulated that: A commune is recognized as meeting the national criteria for health if it fully meets the following requirements: Achieving 80/100 points or more; the number of points in each criterion must be 50% or more of the points of that criterion; not being "failed". In criterion 3: Infrastructure of commune health stations, section 14 stipulates that the main works of commune health stations are ranked from level III or higher; This criterion only accounts for 2/100 of the scale, in the case of "The main building is dilapidated and seriously degraded, it does not meet the Criteria".
In fact, there are currently 106 commune, ward and town health stations in the province (of which 59 health stations have main works of level IV, 47 health stations are level III). However, by the end of 2024, it is expected that 97/106 commune, ward and town health stations will be recognized as meeting national criteria for health (of which 50 health stations have main works of level IV). Thus, indicator No. 14 in Criterion 3 is both a scoring indicator and an orientation indicator for investment and development of infrastructure for health stations, in order to ensure sustainability, solidification, save land area and best meet the health care needs of the people. Therefore, the indicator in item 14 of Criterion 3 according to Decision 1300/QD-BYT dated March 9, 2023 of the Ministry of Health is appropriate.
Voters of Tan Uyen town, Tan Uyen district: According to Regulation No. 18-QD/TU dated November 15, 2023 of the Provincial Party Committee Standing Committee on annual review, assessment and classification of quality for collectives and individuals in the political system. Accordingly: Clause 1.4, page 23 stipulates that the rate of excellent completion of tasks at the end of the year shall not exceed 20% of the number classified. In fact, the Town People's Committee was assigned a staff of 25 cadres and civil servants in 2024, but the number of cadres and civil servants present at the end of the year was only 20 comrades (for civil servants, there were only 9/13 civil servants).
