This Circular provides details on the preparation, approval authority, approval time, dossier, order, procedures for approval and submission of risk management plans in mineral exploitation.

According to the Circular, enterprises exploiting Group I minerals by open-pit method; Enterprises exploiting Group II, Group III, Group IV minerals by open-pit method using industrial explosives; and Enterprises exploiting Group I, Group II, Group III, Group IV minerals by underground method must establish a risk management plan in mineral exploitation according to the contents specified in Appendix I issued with this Circular.
The risk management plan in mineral exploitation can be integrated with risk assessment and other emergency response plans according to specialized laws.
Authority to approve risk management plan
The Circular stipulates that enterprises exploiting Group I minerals by open-pit method; enterprises exploiting Group II, Group III, Group IV minerals by open-pit method using industrial explosives must self-approve the risk management plan in mineral exploitation before constructing open-pit mines for new mining investment projects; self-approve before January 1, 2026 for mining investment projects that are in the process of constructing open-pit mines or have been put into operation.
Enterprises exploiting minerals of groups I, II, III, and IV by underground mining methods shall prepare a plan for risk management in mineral exploitation and submit it to the competent authority for approval, as follows:
For Mineral Exploitation Licenses under the authority to issue according to regulations in Clause 1, Article 108 of the Law on Geology and Minerals, submit to the Department of Industrial Safety Techniques and Environment for approval.
For Mineral Exploitation Licenses under the authority to grant according to regulations in Clause 2, Article 108 of the Law on Geology and Minerals, submit to the Provincial People's Committee for approval.
Timing of approval of underground mining risk management plan
The time for approving the risk management plan for mineral exploitation investment projects using underground mining methods is stipulated as follows:
For new mining investment projects, approval must be obtained at least 07 working days before construction and before putting the mine into use.
For mining investment projects in the mine basic construction phase, approval must be obtained at least 07 working days before putting the project into use.
For investment projects that have been put into operation before July 1, 2025, they must be approved before July 1, 2027.
The Circular takes effect from July 1, 2025.
Risks in mineral exploitation are the possibility of encountering potential hazards that cause incidents, accidents, injuries, occupational diseases, property damage, and environmental pollution during the mineral exploitation process.
Risk management in mineral exploitation is the application of technical and management measures to ensure that all risks are identified, analyzed, evaluated and handled for all works, machines, equipment, production lines, technological processes and in all stages of mineral exploitation activities.
A risk management plan in mineral exploitation is an activity of building a system of regulations and procedures to find out possible hazards to prevent, respond to and overcome, and minimize risks that may arise during the mineral exploitation process, including safety management reports, risk assessment reports and emergency response plans.
