The draft Resolution of the National Assembly on a number of specific mechanisms and policies to make breakthroughs in education and training development that the Ministry of Education and Training has just announced proposes to assign the Director of the Department of Education and Training the authority to recruit, receive, mobilize, transfer, and second teachers, education managers, and staff in preschool and general education institutions at the provincial level.

The Ministry of Education and Training continues to propose assigning the Director of the Department of Education and Training to preside over the recruitment of teachers at all levels.

According to the Ministry of Education and Training, the regulations on appointment as stated in Clause 10, Article 23 of the Law on Organization of Local Government are both "rigid" and lack consistency, causing difficulties for localities in implementation because in cases where the commune does not have sufficient conditions to implement or the superior state management agency has other regulations on decentralization and authorization, they cannot be implemented.

Based on the reality of recruitment and secondment work at the district level in the previous period, the Ministry of Education and Training said: "Through understanding, checking and supervising the state management work on staff in recent years, it can be seen that one of the reasons for the situation of local surplus and shortage of teachers that has been going on for many years without being resolved is due to the decentralization of recruitment and secondment authority assigned to the People's Committee at the district level to preside over preschool, primary and secondary school levels.

This leads to a "fragmentation" situation between districts. When there is a local surplus or shortage of teachers between two districts, it cannot be mobilized because the management authority belongs to two different districts.

On the other hand, because the education sector is not in charge of recruitment, it leads to the situation of recruitment not meeting the subject needs; the exam is the same as for civil servants in other sectors, so the pedagogical capacity of candidates to become teachers cannot be assessed.

The Ministry of Education and Training also pointed out the current situation that the commune level does not have an independent professional agency like the department level, and does not have enough people to do professional work according to level or field, so it is not feasible to assign the commune level to preside over recruitment.

Commune level does not have enough capacity to organize exams, the assessment of candidates' capacity is not guaranteed due to lack of expertise; causing costs for the State, individual candidates and society (because more than 3,200 communes organize exams); reducing candidates' chances of passing the exam due to few opportunities to choose (because each exam is only held in 1 commune)...

Therefore, the Ministry of Education and Training believes that: "The Department of Education and Training is a specialized agency that directly directs educational activities and will have a firm grasp of the leadership, management, and school administration capacity of its staff; has a common ground for evaluation and comparison, and can carry out the transfer and rotation of staff from one locality to another to meet the requirements of educational tasks."

Previously, in an interview with reporters about the key tasks of the new school year, Minister of Education and Training Nguyen Kim Son said that the Ministry of Education and Training is drafting a decree detailing a number of articles of the Law on Teachers, including regulations on the content and form of teacher recruitment. It is expected that the recruitment will include two rounds of exams, in line with current regulations on civil servant recruitment.

However, the second round of expertise and professional skills will be designed differently, closely following the actual process of teaching and educational activities, ensuring the correct assessment of pedagogical capacity and professional skills of candidates at each level of education and training. This is expected to be an important innovation, aiming to overcome previous limitations when applying the general mechanism of civil servants without taking into account the specific characteristics of the teaching profession.
