Many new regulations on recruitment, use and management of civil servants take effect from July 1, 2025.

The Government has just issued Decree No. 170/2025/ND-CP regulating the recruitment, use and management of civil servants, effective from July 1, 2025.

Decree 170/2025/ND-CP stipulates that the recruitment of civil servants through examination is decided by the competent recruitment authority and is carried out separately for each of the following groups of subjects:

1. People who commit to voluntarily work for 5 years or more in areas with especially difficult socio -economic conditions.

2. Students who study under the recruitment regime as prescribed by the Lawon Education , after graduation, will work in the locality where they were sent to study.

3. Excellent graduates and talented young scientists are subject to policies to attract and employ talented people.

Another new content of Decree 170/2025/ND-CP is the addition of regulations on the arrangement and ranking of civil servants according to job positions, specifically including: arrangement and assignment of work; arrangement into job positions, change of civil servant job positions; conditions and standards for civil servants when changing job positions; implementation of job position changes for civil servants. This content aims to determine the specific roles and tasks in arranging job positions and ranking civil servants for those who are recruited as civil servants; the responsibility of the head of the agency using civil servants to assign work according to the requirements of the recruited job positions, train, monitor and evaluate the performance of duties and tasks of civil servants.

Decree 170/2025/ND-CP also adds cases of being accepted into the civil service who are experts, scientists, jurists, good lawyers, typical and excellent businessmen, managers, business administrators; people working at agencies, organizations, units in the political system but are not civil servants, in accordance with the provisions of the Law on Cadres and Civil Servants 2025 in attracting high-quality human resources and experienced people who immediately meet job requirements to work in the public sector.

Amending and supplementing regulations on termination of employment for civil servants

Decree 170/2025/ND-CP stipulates that the head of the civil servant management agency or the civil servant employing agency with decentralized recruitment authority decides to terminate or authorizes the decision to terminate the employment of civil servants.

The Decree also specifically stipulates the procedures for resolving termination of employment in cases where civil servants voluntarily resign and in cases where civil servants are dismissed.

Civil servants who voluntarily resign are entitled to severance pay as follows: 3 months of current salary; 1.5 months of current salary for each year of work with compulsory social insurance; the period of compulsory social insurance payment is reserved or one-time social insurance is received according to the provisions of the law on social insurance.

The Decree continues to promote decentralization and delegation of power. Accordingly, ministries, branches and localities have the authority and responsibility for recruiting, using and managing civil servants under their management; and decentralize recruitment authority to affiliated and subordinate agencies, units and organizations.

Regarding the simplification of administrative procedures, Decree 170/2025/ND-CP does not regulate the examination and consideration for promotion of civil servants. Accordingly, administrative procedures for examination and consideration for promotion of civil servants will be abolished; the forms of regulations when recruiting civil servants will be reduced; there will be no need to prepare appointment records according to regulations in case of changing the name of an agency, organization or unit without changing the organizational model (the competent authority decides to change the position according to the corresponding new job position); the term of office will be calculated according to the old appointment decision (no need to carry out the appointment process and no need to prepare appointment records according to regulations).
