Revoking a driving license is an administrative violation measure applied to individuals who seriously violate road traffic laws. According to Clause 1, Article 25 of the Law on Handling of Administrative Violations 2012 (amended and supplemented in 2020), a person whose driving license is revoked will be banned from driving a vehicle for a certain period of time, from 01 to 24 months, depending on the severity of the violation.

During this period, the violator is prohibited from driving the vehicle corresponding to the revoked license type, and the driving license will be temporarily seized by the competent authority. When the license revocation period ends, the violator can receive and continue to use his/her license.
Traffic violations that result in revocation of motorcycle driving license
According to Decree 100/2019/ND-CP, amended by Decree 123/2021/ND-CP, the following violations may result in revocation of a driver's license:
1. Suspension of driving license from 01 to 03 months:
- Carrying more people than the prescribed number on a motorbike.
- Violation of regulations on stopping vehicles and rescuing people in case of traffic accidents.
- Driving into prohibited areas, prohibited roads or violating traffic signals and commands of traffic controllers.
2. Suspension of driving license from 02 to 04 months:
- Use a kickstand or other object to scrape the road while moving.
- Violating regulations on speed, encroaching on lanes, causing traffic accidents, or performing dangerous behaviors such as letting go of hands while driving, weaving, or swerving.
3. Suspension of driving license from 03 to 05 months:
- Repeated or repeated violations of the above mentioned dangerous behaviors.
- Causing traffic accidents or failing to comply with orders from law enforcement officers.
4. Suspension of driving license from 10 to 12 months:
- Driving a vehicle with a blood or breath alcohol concentration exceeding the prescribed level but not exceeding 0.25 milligrams/liter of breath.
5. Suspension of driving license from 16 to 24 months:
- Violating regulations on alcohol or drug concentration while driving, not complying with inspection by law enforcement officers.
Consequences of having your driver's license revoked
According to the Road Traffic Law 2008, drivers must carry their driving licenses when participating in traffic. When a license is revoked, an individual is not allowed to drive until the license is returned. If this regulation is violated, drivers may face more severe penalties, including having their driving licenses revoked for a longer period of time or being prosecuted for criminal liability in cases of serious consequences.
Revoking a driver's license is not only a deterrent but also aims to protect the safety of both road users and society. Drivers need to strictly comply with traffic laws to avoid unfortunate consequences.
