The Identity Law was passed by the 6th National Assembly at its 1th session, effective from July 7, 2024. One of the important contents of the law is the conversion of CCCD cards into identification cards.

By the end of 2023, the Ministry of Public Security has issued more than 83 million chip-embedded CCCD cards to people nationwide. After the Identification Law was passed, many people wondered whether these more than 83 million CCCD cards would have to be changed to identification cards or not?
Regarding this issue, in the transitional provisions, the Identity Law clearly stipulates that CCCD cards issued before July 1, 7 will be valid until the expiration date printed on the card. Thus, if you already have a CCCD card with a chip (and it is still valid), there is no need to change to an identification card.
Cases where it is mandatory to change to an ID card include:
-Citizens 14 years old, 25 years old, 40 years old and 60 years old
Previously, the 2014 Law on Citizen Identification No. 59/2014/QH13 only stipulated that citizens of the following ages: 25 years old, 40 years old, and 60 years old needed to work as CCCD.
However, starting from July 1, 7, citizens who are 2024 years old and have been issued an Identification card before are also required to carry out the procedure for renewing an Identification card. Particularly for people under 14 years old, it is not required, but only issued an ID card when needed.
-Change or correct information about family name, middle name, and birth name; date of birth
Information such as full name and date of birth are important information for a citizen. Therefore, when there are changes, updating the above information in the Identity Card is mandatory to ensure the accuracy of personal data, avoiding confusion and disputes when performing transactions.
-Change identity; Additional information about facial photos and fingerprints; gender reassignment or gender change according to the law
Compared to the Citizen Identification Law 2014, in Article 24 of the new Identification Law 2023, citizens who change gender will also need to change their Identity card from July 1, 7. At the same time, identity, face, and fingerprints are some of the unique characteristics to identify different individuals.
Therefore, when changing identity, face, fingerprints or changing gender, updating the above data is extremely important to facilitate the authorities in confirming information when necessary.
-There are errors in the information printed on the Identification card
Currently, the Identification card includes the following information stated in Article 18 of the Law on Identification: Face photo; Personal identification number; Surname, middle name and birth name; Date of birth; Sex; Place of birth registration; Nationality; Residence.
This is also important information to distinguish one individual from another. Therefore, when discovering the above information is incorrect on the Identification card, people need to go to the Police Department to immediately change a new card.
-Reset personal identification number
According to Clause 3, Article 12 of the Law on Identification, personal identification numbers are used to carry out procedures for issuing Identification cards. In addition, at the 6th session of the XNUMXth National Assembly, the Ministry of Public Security stipulated that citizens can cancel and reset their personal identification numbers when:
Gender reassignment/year of birth correction.
Errors in personal information such as: year of birth, gender, place of birth registration.
Therefore, when re-establishing the personal identification number, citizens need to re-issue an Identification card to correspond to the new personal identification number.
Currently, the personal identification number is a series of 12 numbers including:
First 06 numbers: century of birth code, gender code, year of birth code, province code, centrally run city/country code where birth was registered.
The remaining 06 numbers are random (Pursuant to Article 13 of Decree 137/2015/ND-CP).
It can be seen that incorrect information about year of birth, gender, and place of birth registration will also affect the first 06 digits of the personal identification number.
– If the chip-embedded CCCD card expires after July 1, 7 (expiry date printed on the front, bottom left corner of the card), it must be changed to an identification card.
In addition, people can apply for an ID card (according to need) in the following cases:
– Vietnamese citizens under 14 years old, carry out procedures for issuance of ID cards for the first time, through a representative. This is a new regulation in the Identity Law compared to the CCCD Law, aiming to expand the subjects eligible for ID cards.
– Citizens already have a CCCD card with a chip but want to change it to an identification card.
