Recently, the Chairman of the Hanoi People's Committee, Tran Sy Thanh, directed the Department of Construction to take the lead and coordinate with the City People's Committee Office and the Thach That District People's Committee to investigate and clarify the information reported in the press regarding the "My House high-end apartment building" in Tan Xa commune, Thach That district, which was allegedly built illegally and exceeded the permitted number of floors by three times.
This construction project is owned by Mr. VMC (residing in Viet Hung ward, Long Bien district). According to our investigation, on March 14th, the People's Committee of Thach That district (Hanoi) issued a decision imposing an administrative fine of 35 million VND on Mr. C. for "organizing construction work without a building permit, as required by regulations for the construction of individual houses."
Furthermore, within 30 days of the issuance of the penalty decision, Mr. C. must complete the application for a construction permit from the competent authority and obtain one. If, after this period, Mr. C. fails to present the construction permit, he will be notified to demolish the illegally constructed building himself. If a construction permit is granted, Mr. C. must demolish the structure or parts of the structure that do not conform to the issued permit before he can continue construction.
On April 17th, Mr. Nguyen Kim Loan, Vice Chairman of the Thach That District People's Committee, signed construction permit No. 32 for Mr. C. and Ms. NTQH. According to the permit, this is a detached house on plot No. 152, map sheet No. 14 (village 1, Tan Xa commune), with an area of 726.5 m2.
The building was initially licensed for 3 floors plus a penthouse. The first floor had a construction area of over 150 m2, with a total floor area of nearly 492 m2. The building density for the entire plot was 20.7%. Shortly after, the investor "transformed" the building into a 9-story structure, with the building density now covering almost the entire plot.
A mini-apartment building was constructed exceeding the permitted height by 6 floors in Tan Xa commune, Thach That district.
Following violations by the investor at this construction site, on June 14th, the People's Committee of Thach That District issued a decision to enforce demolition, ordering the removal of the parts of the building that violated the permit, but without specifying a timeframe for Mr. C. to rectify the situation. Therefore, even after four months since the demolition order was issued, the nine-story building shows no signs of being demolished.
Following the request from the Chairman of the Hanoi People's Committee, Tran Sy Thanh, for relevant authorities to investigate and clarify the matter, the construction site has now been closed .
