Additional age limit for school buses

According to the draft Decree, the vehicle usage period Cargo vehicles (trucks), special-purpose cargo vehicles (special-purpose trucks), four-wheeled motor vehicles not older than 25 years.

Draft Decree supplements regulations that the age limit for unused school buses must not exceed 20 years (illustrative photo).

Meanwhile , passenger cars with 10 seats or more (including the driver's seat), specialized passenger cars, and four-wheeled motor vehicles have a usage period of no more than 20 years.

The draft also adds provisions on the term of office. For cars carrying preschool children and students, no more than 20 years.

Vehicles that are not subject to the age limit include: Motorcycles, motorbikes, passenger cars with a capacity of up to 8 people (not including the driver), special-purpose cars, trailers, semi-trailers; Military and police motor vehicles serving national defense and security purposes.

According to the investigation of Giao thong Newspaper reporters, for vehicles used for transport business, the age limit will be applied according to the regulations on the age limit of vehicles used for transport business, stipulated in the Decree regulating the business of transport services by car. However, it is still necessary to ensure compliance with the general regulations on the age limit of motor vehicles in this Decree when it is issued.

For converted vehicles, the draft Decree stipulates that when a vehicle with a term of use is converted into a vehicle without a term of use, the regulations on the term of use of the vehicle before the conversion shall apply.

Vehicles without a usage period that are converted into vehicles with a usage period shall be subject to the regulations on the vehicle's usage period after conversion.

Passenger cars with a permitted capacity of 9 or more people (excluding the driver), specialized passenger cars converted into cargo cars (including specialized cargo cars); four-wheeled passenger cars with engines converted into four-wheeled cargo cars with engines shall be subject to the regulations on the age of the vehicle after conversion.

For vehicles that have expired, the draft Decree stipulates that the vehicle registration agency is responsible for revoking the license plate (illustrative photo).

Revoke expired license plates

According to the draft Decree, the Vietnam Register is responsible for guiding, directing and inspecting registration facilities to determine the year of manufacture and make a list of expired cars annually to report to the Department.

This list will be shared with the Traffic Police Department and Traffic Inspectorate of localities for monitoring, inspection, management, and at the same time publicly announced at the unit to have a basis for inspection for people and local authorities to monitor.

The Department of Transport will be responsible. Propagate and disseminate regulations on the age of motor vehicles to all agencies, organizations and individuals using cars in the locality for implementation.

Notably, the draft Decree adds provisions on the revocation of license plates for motor vehicles that have expired their usage period. The vehicle registration authority will be responsible for implementing this content.

In addition, organizations and individuals using cars when their vehicle's lifespan expires also need to have a plan to renew their vehicle.

Regarding the method of determining the age of motor vehicles, in the draft, the Ministry of Transport proposed to calculate from the year of vehicle manufacture until December 31 of the year the age of use ends.

In some special cases when permitted by the Prime Minister , the term of use is calculated from the year of first vehicle registration.

The draft also adds the basis for determining the age of use of cars in order of priority: Vehicle identification number (VIN); Vehicle chassis number; Technical documents; Information on the manufacturer's label attached or stamped on the car; Archived records (such as: Quality certificate; Factory quality inspection certificate for domestically produced cars; Inspection or acceptance record, Certificate of quality of modified road motor vehicles for modified cars; Original records managed by the police; Import documents).

"Cars that do not have at least one of the above documents, records, and bases will be considered to have expired," the draft states.
