Amend regulations on the lifespan of automobiles.

Adding a lifespan limit for school buses.

According to the draft Decree, the service life of vehicles Cargo vehicles (trucks), specialized cargo vehicles (specialized trucks), and four-wheeled motor vehicles for transporting goods that are no older than 25 years.

The draft decree adds a regulation stating that the lifespan of unused school buses should not exceed 20 years (illustrative image).

Meanwhile , passenger cars with 10 or more seats (including the driver's seat), specialized passenger cars, and four-wheeled motor vehicles for transporting passengers have a service life of no more than 20 years.

The draft also adds provisions regarding the service life limit. For vehicles transporting preschool children and schoolchildren, the age limit is 20 years.

Vehicles not subject to service life limits include: Motorcycles, mopeds, passenger cars with a permitted carrying capacity of up to 8 people (excluding the driver), specialized vehicles, trailers, semi-trailers; and motor vehicles of the military and police serving national defense and security purposes.

According to our investigation, for vehicles used in commercial transport, the service life will be governed by the regulations on the service life of commercial transport vehicles, as stipulated in the Decree on the business of transport services by motor vehicles. However, compliance with the general regulations on the service life of motor vehicles in this Decree will still be ensured upon its promulgation.

For modified vehicles, the draft Decree stipulates that when a vehicle with a service life limit is modified into a vehicle without a service life limit, the regulations regarding the vehicle's service life limit before modification shall apply.

If a vehicle without a service life limit is modified to have one, the regulations regarding the service life limit of the vehicle after modification will apply.

Passenger cars with a permitted carrying capacity of 9 or more people (excluding the driver), specialized passenger cars converted into cargo vehicles (including specialized cargo vehicles); and four-wheeled motor vehicles converted into four-wheeled motor vehicles for cargo purposes are subject to the regulations regarding the lifespan of the vehicle after conversion.

For vehicles that have reached the end of their service life, the draft Decree stipulates that the vehicle registration authority is responsible for revoking the license plates (illustrative image).

Recalling expired vehicle license plates.

According to the draft Decree, the Vietnam Registering and Inspection Department is responsible for guiding, directing, and inspecting inspection facilities in determining the year of manufacture and compiling a list of vehicles that have reached the end of their service life on an annual basis for reporting to the Department.

This list will be shared with local traffic police and traffic inspectors for monitoring, inspection, and management, and will also be publicly announced at the unit to provide a basis for vehicle inspection, allowing the public and local authorities to supervise.

The Department of Transportation will be responsible. To disseminate and publicize regulations on the service life of motor vehicles to all agencies, organizations, and individuals currently using automobiles in the locality for compliance.

Notably, the draft Decree adds a provision regarding the revocation of license plates for motor vehicles that have reached the end of their service life. The vehicle registration authority will be responsible for implementing this.

In addition, organizations and individuals using automobiles in traffic should also plan to replace their vehicles when they reach the end of their service life.

Regarding the method for determining the service life of motor vehicles, in the draft, the Ministry of Transport proposes calculating it from the year of vehicle manufacture until December 31st of the year the service life expires.

In some special cases, with the permission of the Prime Minister , the service life is calculated from the year of initial vehicle registration.

The draft also adds criteria for determining the service life of automobiles in order of priority: Vehicle identification number (VIN); Vehicle chassis number; Technical documents; Information on the manufacturer's label affixed or stamped on the automobile; Archived records (such as: Certificate of quality; Factory quality inspection certificate for domestically produced automobiles; Inspection or acceptance report, Certificate of quality for modified road motor vehicles for modified automobiles; Original records managed by the police; Import documents).

"Vehicles lacking at least one of the above documents, records, or facilities will be considered to have reached the end of their service life," the draft states.
