Accordingly, the Ministry of Justice requested the People's Committees of provinces and cities to strengthen state management of the activities of notaries and notary practice organizations, focusing on directing and implementing the following tasks:
Effectively organize the implementation of the 2024 Notarization Law according to the Plan issued with Decision No. 12/QD-BTP dated January 3, 2025 of the Minister of Justice, Official Dispatch No. 85/BTP-BTTP dated January 6, 2025 of the Ministry of Justice sent to the People's Committees of provinces and cities on the implementation of the 2024 Notarization Law, Official Dispatch No. 4225/BTP-BTTP dated July 16, 2025 sent to the Department of Justice of provinces and cities on the implementation of Decree No. 104/2025/ND-CP dated May 15, 2025 of the Government detailing a number of articles and measures to implement the Notarization Law, Circular No. 05/2025/TT-BTP dated May 15, 2025 of the Minister of Justice detailing a number of articles and measures to implement the Notarization Law. Notary, Circular No. 06/2025/TT-BTP dated May 15, 2025 of the Minister of Justice on notary practice internship... so that notaries and notary practice organizations clearly understand their responsibilities and obligations in the process of practicing and providing notary and certification services.
Based on the decentralized and delegated tasks prescribed in Decree No. 121/2025/ND-CP dated June 11, 2025 of the Government on decentralization and delegation in the field of state management of the Ministry of Justice, the Provincial People's Committee directs and strictly implements the appointment, reappointment, dismissal of notaries, establishment and registration of operations of notary practice organizations, ensuring that notary practice organizations are established and operate in accordance with legal provisions; and enhances the application of information technology in notary activities.
Based on the actual conditions in the locality, the Provincial People's Committee shall consider and decide on the transfer of transaction certification authority to notary organizations in commune-level localities that meet the conditions prescribed in Clause 3, Article 19 of the Law on Notarization, Point e, Clause 1, Article 63 of Decree No. 104/2025/ND-CP, the Plan for implementing the Law on Notarization issued together with Decision No. 12/QD-BTP; at the same time, direct the dissemination to the people and thoroughly instruct notary organizations to promote the implementation of certification at notary organizations, in order to reduce the workload for the Commune-level People's Committee.
Direct the Department of Justice: Issue documents to thoroughly instruct notaries and notary practice organizations in the area to fully comply with the principles of practice, rights and obligations as prescribed by law; properly implement notarization and certification procedures; Coordinate with tax authorities and agencies registering ownership and use rights of assets to thoroughly instruct notaries and notary practice organizations in guiding people requesting notarization of transactions on transfer of ownership and use rights of assets to declare and pay taxes and register changes in assets after performing transactions in accordance with regulations; Direct the organization of the congress of the Notary Association in 2025 to soon stabilize the organization and operation; create favorable conditions for the activities of the Notary Association in the locality to promote the role of professional autonomy.
Direct departments, branches and sectors (Provincial Police, Provincial Inspectorate, tax authorities, etc.) to closely coordinate in state management of notary activities; organize inspection teams to examine notary organizations according to regulations, strengthen the fight against and prevent violations of the law in notary and certification activities in the locality, detect and handle negative acts and violations of the law by notaries and notary organizations; in case of detecting violations, handle them strictly and promptly according to authority or transfer them to competent agencies for handling according to regulations of law.
