Focus on overcoming shortcomings in handling complaints and denunciations

The management and operation of apartment buildings give rise to many disputes and complaints.

According to the Report of the Inspection Team established under Decision No. 618/QD-UBND dated February 1, 2023 of the Chairman of the City People's Committee, the Inspection Team conducted inspections and concluded at 9 units: Department of Natural Resources and Environment, People's Committees of districts: Dong Da, Thanh Tri, Phu Xuyen, Ung Hoa, Thanh Oai, Phuc Tho, Hoai Duc and Thach That.

The Inspection Team advised and recommended the City People's Committee to direct the handling and overcoming of existing problems and limitations after the inspection. The initial inspection results showed that the settlement of complaints, denunciations, recommendations and reflections in some cases was slower than the settlement time limit according to regulations and the requirements of the City; some cases were left pending and prolonged, leading to petitions going beyond the level. Most of the inspected units had complicated complaints and denunciations that had been pending for many years and had not been resolved, including cases under the monitoring of the Steering Committee for the implementation of Resolution 15 and Directive 15 of the Hanoi Party Committee.

In some units, the assignment of agencies (Citizen Reception Committee, Inspectorate, specialized departments) to advise, monitor, synthesize, inspect, and urge is still overlapping, unclear about people and tasks, leading to inefficiency in the common work. The organization, implementation, monitoring, and synthesis of assigned tasks in the Decision on handling complaints, Conclusion on handling denunciations of the Chairman of the City People's Committee, Chairman of the District People's Committee, and Head of the unit have not been focused on, leading to the emergence of complaints.

Some outstanding state management issues still exist, are complicated and prolonged, and need to be specifically handled and resolved, such as: The management and operation of apartment buildings have given rise to many disputes and mass complaints with unclear authority and sanctions for resolution. The resolution of problems in the allocation of service land has not had any positive changes despite the close direction of the City Party Committee and People's Committee. Problems and obstacles in the allocation of land for rural population dispersion (implemented according to the 1993 Land Law and the 2003 Land Law) until the state changed the legal regulations on land management and use, leading to complaints from people whose lists were approved, who had paid money but had not yet received land.

In order to promptly and effectively resolve complaints, denunciations, recommendations and reflections from citizens in sectors and localities, the Chairman of the City People's Committee requests the Chairmen of the People's Committees of districts, towns and cities, Heads of Departments, branches and sectors of the City to direct the inspection and review of the Citizen Reception Committee and the citizen reception unit to ensure the arrangement of enough cadres and civil servants with professional capacity and moral qualities to perform this work according to regulations.

Review the functions, tasks, assignment, and coordination between units in the work of receiving citizens, handling complaints, denunciations, recommendations, reflections, and consulting, especially in the work of monitoring, synthesizing, checking, and urging to ensure that people and work are clear. Pay attention to arranging facilities and equipment for citizen reception with the spirit of serving the people, ensuring that work requirements are met.

Seriously organize and perform well the work of synthesizing, monitoring, reporting on the situation and results of the implementation of the tasks assigned by the Chairman of the City People's Committee on handling complaints, denunciations, petitions and reflections; tasks assigned in the Decisions on handling complaints, Conclusions on denunciations of the Chairman of the City People's Committee, Chairmen of District People's Committees and Heads of Departments, branches and sectors.

Resolutely resolve problems related to rural land allocation projects

For the units that have been concluded by the Inspection Team, the City People's Committee has issued specific instructions, requiring the units to urgently and seriously implement. For the remaining units, proactively inspect, review, develop specific plans, assign responsibilities to individuals and units to thoroughly resolve outstanding, complicated, and prolonged complaints and denunciations under their authority, especially cases under the monitoring of the Steering Committee for the implementation of Resolution 15 and Directive 15 of the City Party Committee.

Units should strengthen coordination, seek opinions to remove obstacles, and provide guidance in resolving cases. The content of the consultation and guidance must be specific and close to reality; strengthen propaganda, mobilization, and persuasion to limit the situation of citizens gathering in large numbers to file complaints to City and Central agencies.

The Office of the City People's Committee is assigned to preside with the City Inspectorate and related units based on the results of building and deploying the software system for managing petitions, handling complaints, denunciations, and reflecting and recommending recommendations currently being deployed at the City Citizen Reception Committee. At the same time, research and propose the City People's Committee to deploy the establishment of a software system for managing petitions, handling complaints, denunciations, and reflecting and recommending recommendations unified throughout the City (City, People's Committees of districts, Departments, branches and related units), on the principle of ensuring system connection, building a large database, ensuring the leadership, direction and operation of the City Party Committee and the City People's Committee, reporting to the City People's Committee in the first quarter of 2024.

The Department of Construction is assigned to preside over, together with the Department of Justice and relevant units, reviewing legal documents of the State, the Ministry of Construction , the City People's Committee and relevant units related to the management and operation of apartment buildings. At the same time, summarize the current problems and difficulties in the management, operation, and handling of violations, especially in resolving related complaints, denunciations, and disputes. From there, advise the City People's Committee to issue directive documents (issue legal documents if necessary, in which it is important to clarify the content of the cases, the roles, authority, and responsibilities of relevant entities: authorities, investors, apartment building management boards, and residents) in handling and resolving existing and arising cases, and report to the City People's Committee before April 30, 2024.

The Department of Natural Resources and Environment shall preside over and work with the People's Committees of districts, towns and cities to review and synthesize rural land allocation projects implemented in the City in accordance with the provisions of the 1993 Land Law and the 2003 Land Law but still have problems. From there, clarify the current situation, difficulties and problems of each project, synthesize, advise on the direction of handling and resolving them, and report to the City People's Committee before June 30, 2024.

The Chairman of the City People's Committee also assigned the People's Committees of districts, towns and cities (where service land allocation still exists) to develop detailed plans to allocate service land to households, report to the Standing Committee of the District Party Committee, District Party Committee and City Party Committee for leadership and direction in organizing implementation, ensuring that this work is basically completed before September 30, 2024.
