What are the conditions for establishing a school?

To ensure the quality of teaching ateducational institutions, relevant agencies set specific educational operating conditions for domestic schools.

According to the provisions of the 2019 Law on Education, schools are allowed to operate educational activities when they have land, facilities, and equipment that meet the requirements of educational activities; the school construction location ensures an educational environment and safety for students, teachers, and workers.

Have educational programs and teaching and learning materials according to regulations appropriate to each level of education and training; have a team of teachers and managers who meet standards, are sufficient in number, and have a uniform structure to ensure the implementation of educational programs and the organization of educational activities;

At the same time, the school must have sufficient financial resources according to regulations to ensure the maintenance and development of educational activities; have regulations on the organization and operation of the school.

Within the prescribed period, if the school meets all the above conditions, it will be permitted by the competent state agency to conduct educational activities. After the prescribed period, if it does not meet the above conditions, its establishment decision or decision permitting its establishment will be revoked.

Conditions for establishing a school

Pursuant to Article 49 of the 2019 Law on Education, a school is established when there is a school establishment project in accordance with the socio -economic development plan and the educational institution network plan as prescribed by the Law on Planning.

The school establishment project clearly defines the goals, tasks, educational programs and content; land, facilities, equipment, planned location for school construction, organizational structure, resources and finance; strategic directions for school construction and development.

There are 3 types of schools, including: private schools, public schools and non-public schools. Of which, public schools are schools invested in by the State, ensuring operating conditions and representing the owner;

Private schools are schools in which the community at the grassroots level, including organizations and individuals in villages, hamlets, communes, wards, and towns, invests in building facilities and ensures operating conditions. The type of private school only applies to preschool education facilities;

Similarly, private schools are schools invested in by domestic or foreign investors and guaranteed operating conditions.

According to regulations, schools are only allowed to convert their school type from private schools to non-profit private schools and must ensure compliance with the following principles:

Implement the provisions of the charter, regulations on organization and operation of the school type at each level of education and training;
Ensure the rights of teachers, lecturers, educational administrators, workers and learners;
No loss of land, capital and assets.
