On October 9th, the Central Council for Coordination of Legal Dissemination and Education organized the 2024 Business and Law Forum with the theme "Joining hands to solve legal issues, contributing to creating a favorable investment and business environment for enterprises." The forum was held in both in-person and online formats with 63 connection points in provinces and cities.

The forum was attended and chaired by Deputy Prime Minister Le Thanh Long - Chairman of the Central Council for Coordination of Law Dissemination and Education.

A bridge to "listen to each other's voices".

This is the second time the Forum has been held, as part of the Inter-sectoral Legal Support Program for Small and Medium-Sized Enterprises for the period 2021-2025. Furthermore, the Forum's theme and content closely adhere to the guiding principles of General Secretary and President To Lam at the 10th Central Committee Meeting of the 13th Party Congress: "High consensus on identifying stronger breakthroughs in institutional development, removing bottlenecks and barriers, and placing people and businesses at the center."

In his opening remarks at the Forum, Minister of Justice Nguyen Hai Ninh stated that the 2024 Business and Law Forum was organized to create a bridge for competent authorities and businesses to "listen to each other's voices"; to continue jointly identifying legal issues related to production and business activities in the current context and to propose recommendations and solutions to improve the legal system.

At the same time, we reaffirm our commitment to always stand by and protect the legitimate rights and interests of businesses under any circumstances; always listen to and share their difficulties, and work together to overcome challenges.

"The Central Council for Legal Dissemination Coordination, ministries, sectors, and localities are ready to accompany, closely monitor, and work with the business community to 'resolve to the end' the difficulties and legal issues that the business community faces, contributing to creating a transparent and favorable investment, production, and business environment in a substantive way," the Minister of Justice pledged.

The Business and Law Forum focused on discussing two major issues: resolving certain legal issues related to investment projects using land, and legal issues concerning taxation and solutions to overcome them.

Investment procedures are like a " maze " .

During the forum, the Chairman of the Vietnam Construction Contractors Association, Nguyen Quoc Hiep, pointed out that there are currently 15 laws "interfering" with real estate. Previously, each ministry and sector drafted its own law, leading to a lack of uniformity and consistency. Recently, laws (Land Law, Real Estate Business Law, Housing Law) have been amended to ensure consistency and reduce inconsistencies. However, the drafting agencies have not been truly responsive to reality.

Mr. Nguyen Quoc Hiep cited the example of administrative procedures regarding land clearance and dialogue with residents, which currently face many obstacles. After fully notifying local organizations and authorities, it takes 60 days before the investor can hold a dialogue with the residents.

“Our project has 177 steps, and it takes 360 days just for dialogue and enforcement. Land clearance procedures are a burden that real estate businesses have to endure. Regarding administrative procedures, some projects require 38-40 stamps," Mr. Hiep stated, highlighting the current situation. He also suggested that although there is a model process for handling administrative procedures, it needs to be reviewed because the lack of sanctions prolongs these procedures. Meanwhile, every project requires planning adjustments, many of which are not crucial but must go through various levels of authority, and then the investment policy must be adjusted. Only when you actually do it do you realize how difficult the reality is, and how complicated the procedures are.
