(Dan Tri Newspaper) - To construct buildings on agricultural land, Ho Chi Minh City stipulates that the land plot must have been issued a land use certificate, still be valid, and have an area of 500 square meters or more.
The Ho Chi Minh City People's Committee has just issued Decision No. 90 regulating the use of a certain area of agricultural land for the construction of facilities directly serving agricultural production in the city.
Structures directly serving agricultural production on agricultural land include sheds, camps, and warehouses for processing and preserving agricultural products, storing agricultural supplies, machinery, and tools.

The applicable subjects are state agencies assigned to perform state management tasks regarding land and other relevant agencies, organizations, and individuals; and users of agricultural land in Ho Chi Minh City.
The conditions for application are that the agricultural land plot must have been granted a land use right certificate and still be within its validity period. The agricultural land area of the plot currently in use must be 500m2 or more, including one or more adjacent plots owned by a single user.
The proportion of land area allocated for construction of facilities directly serving agricultural production shall not exceed 1% of the total agricultural land area, but shall not exceed 50m2. The structures may only be single-story, with a maximum roof height of 5m, no basement, and a semi-permanent structure (brick walls or lightweight material walls; brick, steel, or iron columns; lightweight material roof).
The construction of facilities directly serving agricultural production must not affect irrigation works, dikes, adjacent agricultural land, or violate the existing road right-of-way as approved by the competent authority.
In addition, the investor must comply with the demolition unconditionally and without compensation upon the expiration of the prescribed period, or in cases where a competent State agency requests it, or until the agricultural land plot is approved by a competent State agency for conversion to other land use purposes…
