Sports lawyer Fraser MacKinven of the law firm Burness Paull believes Prestianni could sue Vinicius and Mbappe, although it depends on several factors. According to him, if the public statements damage reputations and are proven false, Prestianni could sue them for defamation.
MacKinven emphasized: "The accuser may have to prove the veracity of the statement. If they fail to do so, they risk legal liability, including financial compensation and a public apology."
The incident occurred during the first leg of the Champions League play-off between Benfica and Real Madrid on February 18th. After a clash with Prestianni, Vinicius accused referee Francois Letexier of using racist language. The referee immediately activated anti-racism procedure, temporarily halting the game for about 10 minutes before resuming play.
Following the match, several Real Madrid players, including Mbappe, condemned Prestianni's behavior. Vinicius also posted a message, asserting that he had once again become the target of racist behavior.
However, Prestoni completely denied the allegations. The Argentinian player claimed Vinicius misheard and insisted he had never engaged in racist behavior. On February 18, UEFA confirmed the appointment of an ethics and disciplinary inspector to investigate.
If found guilty under Article 14 of UEFA's disciplinary regulations, Prestoni could face a 10-match suspension. UEFA's investigation is ongoing and no final conclusion has been reached.
