In the Handbook on State management in the field of land when implementing two-level local government , the Ministry of Agriculture and Environment guides the procedures for registering land, assets attached to land, and granting the first Certificate of land use rights and ownership of assets attached to land (red book) at the commune level, which will include three steps.
Step one , the applicant submits the application to the Public Administration Service Center or the Land Registration Office. People can choose to submit copies of documents and present the originals for the officer receiving the application to check and compare, or submit the original documents or submit notarized copies of documents.
In case of submitting documents online, the documents must be digitized from the original or a copy of the document that has been notarized or certified according to regulations.

In case of submitting copies or digitized versions of documents, when receiving the results of administrative procedure settlement, the applicant must submit the original documents of the dossier.
In step two , the agency receiving the application checks the completeness of the application components, issues a Certificate of Application Receipt and makes an appointment to return the results. In case the application components are not complete, it will be returned with a Request for Supplementation and Completion of the Application Form for the applicant to complete and supplement according to regulations.
Step three , the People's Committee of the commune where the land is located checks the actual land use of the organization and determines the specific boundaries of the land plot. At this step, the Chairman of the People's Committee of the commune will decide on the form of land use or cases of exemption from land use fees and land rent and direct the sending of information transfer forms to determine financial obligations.
The Chairman of the Commune People's Committee will issue the Certificate of land use rights and ownership of assets attached to the land after receiving the tax authority's notice of the completion of financial obligations. At the same time, the Commune Chairman will direct the transfer of the dossier with a copy of the issued Certificate to the Land Registration Office to establish, update, and correct cadastral records and land database.
In case of land use that is not exempted from all land use fees and land rent for the entire lease term, the matter will be transferred to the provincial level. At this time, the provincial land management authority will submit to the Chairman of the Provincial People's Committee a decision on the form of land use, determine the land price and send an information transfer form to determine financial obligations.
The provincial land management agency will then issue a Certificate of land use rights and ownership of assets attached to the land after receiving a notice from the tax authority on the completion of financial obligations. The certificate is then sent to the receiving agency to be handed over to the grantee.
