After years of living together and shouldering numerous household responsibilities, the Chinese woman felt she deserved fair compensation.


In 2011, Ms. Hu from Zhengzhou, Henan, China, met and married Mr. Wang. However, after living together and having children, significant differences in personality, work style, and educational views became increasingly apparent. This led to constant family conflicts, with arguments becoming a daily occurrence for Ms. Hu and her husband.

In October 2022, after a heated argument, Ms. Ho had no choice but to move out of her home, and they began living separately. In December 2024, Ms. Ho filed for divorce with the Zhongyuan District Court in Zhengzhou City.

In addition to demanding the termination of the marriage, custody of their daughter, and division of shared assets, Ms. Ho also requested that her husband pay her 50,000 RMB (approximately 176 million VND) in compensation for all the housework she had done over the years.

Ms. Ho argues that, during her marriage, she has taken on many household responsibilities, including childcare and housework, while her husband has failed to fulfill his duties and obligations. She is seeking compensation because she feels her efforts deserve recognition.

During the trial, the judge found that the relationship between the two parties was beyond repair and therefore organized mediation to negotiate issues such as property division and child support. During the mediation process, both parties expressed their feelings about the marriage and their opinions. The judge showed empathy and acknowledged the efforts that the plaintiff, Ms. Ho, had made for the family over the years.

However, Ms. Ho's husband disagreed, arguing that the compensation she requested was excessive. The judge explained to the defendant, Mr. Vuong, the importance of housework for family stability and children's development.

At the same time, the court also emphasized that the responsibilities and obligations of both spouses in the marriage are equal. According to the law, Ms. Ho's contributions must be compensated accordingly, or even more than 50,000 RMB (approximately 176 million VND).

Regarding the division of assets and child support, the judge offered reasonable suggestions based on the law and taking into account the practical circumstances of both parties, such as their economic income, living conditions, and the wishes of their children.

After much debate, the two parties finally reached a settlement. According to the agreement, Ms. Ho will have custody of their daughter, and Mr. Wang will be responsible for paying monthly child support. In addition, the properties and vehicles belong to Mr. Wang. Based on Ms. Ho's request, the court ruled that Mr. Wang must pay Ms. Ho a lump sum of 250,000 RMB (over 880 million VND) in economic compensation, which also includes reasonable compensation for the housework she performed over the years.

According to Article 1088 of the Chinese Civil Code, a spouse who has undertaken many responsibilities such as raising children, caring for the elderly, and assisting each other in work has the right to claim compensation from the other spouse upon divorce. The specific measures are to be agreed upon by both parties; if no agreement is reached, the People's Court will issue a ruling.

The judge reminded the audience that, in reality, "housework" is no lighter or easier than outside work. However, for a long time, this type of work was often downplayed or considered mandatory. With the improvement of the "compensation for housework in divorce" clause in the Chinese Civil Code, the value of housework has been clarified, and the contribution of housewives to marriage and family has been affirmed.

The law stipulates that the spouse who undertakes more household chores will be entitled to corresponding economic compensation. This is beneficial in encouraging family members to participate in household work, promoting mutual respect between husband and wife, playing a positive role in balancing the economic interests of husband and wife, eliminating discrimination, and maintaining family harmony and stability.
