Music copyright in the digital age

In the digital age, Vietnamese music in general, and Thai Nguyen music in particular, is witnessing significant transformations thanks to the explosion of social media platforms such as TikTok, YouTube, and Facebook. However, the downside of this convenience is the increasingly sophisticated nature of music copyright infringement...

Musician Quan Anh Tuan expressed his views on the current situation where musical "intellectual property" is being stolen.

With just a few simple steps, a song that a musician has invested months of creative effort and money into arranging and mixing can be edited, slowed down, sped up, or inserted into short videos without permission or payment of royalties.

The practice of using music without permission is widespread and takes many forms: from cafes and tea rooms playing commercial music, to TikTokers and YouTubers using songs to create promotional videos and monetize them, but completely forgetting their obligation to ask for permission from the author.

Composer Quan Anh Tuan, Vice Chairman of the Music Branch of the Thai Nguyen Provincial Union of Literature and Arts Associations, shared: "A musical work is the culmination of the artist's soul, sweat, and tears. However, nowadays, it's commonplace for a song released one day to be 'recycled' and edited by online platforms to be used as background music in parody videos and comedy clips. The saddest thing is that they use the author's work to gain interaction and make money, while the original author receives no permission, let alone royalties."

Many musicians in Thai Nguyen also expressed that, due to the specific nature of their work in the locality, accessing information and protecting their digital copyrights faces more obstacles than their colleagues in large cities like Hanoi or Ho Chi Minh City. The reluctance to carry out registration procedures or authorize specialized organizations such as the Vietnam Copyright Protection Center for Music (VCPMC) makes musicians in mountainous and local areas the most vulnerable in the complex online environment.

To protect the flow of music and keep the passion alive for musicians in Thai Nguyen, finding a solution to the copyright problem is extremely urgent. Experts and artists from the tea-growing region believe that a thorough solution should not only come from tightening legal regulations but also from addressing the root cause of the awareness within the music-listening community itself.

Composer Nguyen Ngoc Tuyet, a member of the Vietnam Music Association, shared a realistic perspective from the viewpoint of Generation Z: Young people today are very tech-savvy, but their awareness of copyright is inversely proportional. Many naively think, "I just take some good music and put it in a video for fun, it doesn't cost anyone anything." They don't understand that this seemingly harmless act is directly depriving musicians of the opportunity to make a living. To change this, we must first educate listeners about respecting intellectual property and the value of creativity.

Based on this reality, many opinions suggest that a comprehensive set of solutions is needed to protect copyright in the digital environment. Among these, encouraging musicians to proactively register their copyrights and applying digital content recognition technologies such as Content ID to control the use of their works online are essential.

In addition, professional associations need to strengthen training and legal support for their members; and relevant authorities should intensify inspections and strictly handle violations to enhance deterrence and build a healthy creative environment.

Music is a stream that nourishes the soul, and musicians are the silent catalysts for that stream. Respecting music copyright is not just about complying with the law, but also about demonstrating the civility of a society that cherishes human values.
