Kinhtedothi - The Ministry of Education and Training is advocating against prohibiting teachers from giving extra lessons, but prohibits any extra-curricular activities that violate the ethics of teachers or professional principles.
On the morning of November 20th, continuing the work program of the 8th Session, National Assembly deputies discussed the Draft Law on Teachers in the plenary hall. During the discussion, National Assembly deputies argued that there is a need for mechanisms to protect teachers, and at the same time, specific regulations on tutoring and supplementary classes are necessary.

Many teachers still avoid or are hesitant to address student misconduct.
Representative Hoang Thi Thu Hien (National Assembly delegation of Nghe An province) stated that the draft law should include provisions to protect teachers so they can work with peace of mind and contribute effectively to teaching. Representative Hoang Thi Thu Hien argued that teachers need to be guaranteed a safe environment in their professional activities. Besides the provisions of the Draft Law on teachers' rights in their professional activities, the policy impact assessment report of the Draft Law analyzes current regulations, which only mention prohibitions for teachers but lacks provisions on what individuals, agencies, and organizations outside the school are prohibited from doing to teachers.
At the same time, the report also lacks regulations on protecting teachers in their professional activities; it lacks policies to build a safe working environment so that teachers can work with peace of mind, dedicate themselves to their work, and perform their professional activities effectively. This would prevent negative interference, or even insults, against teachers in their professional activities, as seen in some recent incidents.

This leads to a situation where many teachers avoid or are reluctant to handle student misconduct, limiting communication with families and students; increasing deviance in schools, increasing school violence, and increasing and giving rise to social problems among students.
Therefore, delegate Hoang Thi Thu Hien suggested that regulations on teachers' rights should be added to address the influence of individuals, organizations, and agencies inside and outside the school. Regarding teachers' professional activities, it is necessary to encourage the application of positive discipline in schools and to have specific regulations from the education sector, with the support of families and parents, as well as society.
Sharing this view, delegate Tran Van Tuan (National Assembly delegation of Bac Giang province) stated that there is currently a lack of specific regulations regarding the relationship between teachers, students, and parents. The legal system does not yet have clear regulations on the rights and obligations of the parties involved in this relationship.

"Teachers today sometimes face difficulties in implementing disciplinary measures against students. Many teachers also feel that students and their parents have too much power, while the teacher's power is merely symbolic," a representative from Bac Giang province stated.
According to the delegates, this situation means that when strict measures need to be implemented, teachers are worried about negative reactions from the public, or even accusations and complaints from students' families. Therefore, some teachers tend to work less actively, not fully utilizing their abilities, intelligence, and dedication...
Representative Tran Van Tuan proposed adding policies to create a democratic and disciplined educational environment so that teachers can fully develop their qualities, abilities, intellect, and dedication to the profession. The rights and obligations of the relevant parties need to be established and supplemented with more specific regulations, creating a legal basis for strictly handling violations.
A mechanism is needed to regulate tutoring and supplementary classes.
Speaking in the assembly hall, delegate Do Huy Khanh (National Assembly delegation of Dong Nai province) addressed the issue of extra tutoring. The delegate suggested that the Ministry of Education and Training should coordinate with relevant agencies to develop specific regulations and management mechanisms for this matter.

According to delegate Do Huy Khanh, supplementary tutoring is essentially a necessary societal need; however, there are currently two opposing viewpoints: one advocating for prohibition, and the other for regulation.
The delegates pointed out that many workers who work overtime in the afternoon are unable to pick up their children and therefore prefer to leave their children with teachers to supervise at home, only picking them up in the evening. Therefore, the draft law needs to include a mechanism for managing extra tutoring.
Meanwhile, Representative Chamaléa Thị Thủy (National Assembly Delegation of Ninh Thuận province) expressed the view that the issue of tutoring and supplementary classes needs to be thoroughly examined in order to regulate it in a specific and appropriate way. In reality, tutoring is a genuine need of students – especially in urban areas and economically developed regions, where families want to invest in education and aim to enhance beyond the basic knowledge taught at school.
Therefore, the delegates concluded that suggesting that increasing teachers' salaries and benefits would solve the problem of extra tutoring is still subjective and not truly in line with real-life situations.

In his explanation and clarification of some issues raised by National Assembly deputies during the discussion session regarding teachers' tutoring, Minister of Education and Training Nguyen Kim Son stated: The Ministry of Education and Training is not prohibiting teachers from tutoring, but prohibits tutoring activities that violate the ethics of teachers as well as professional principles.
Minister Nguyen Kim Son stated that he would fully study the opinions of National Assembly deputies discussed in committees and in the plenary session to incorporate as many as possible; he also affirmed that developing a new team of teachers is the primary reason for drafting the Law on Teachers.
