Ministry of Labor, Invalids and Social Affairs guides the implementation of new pension and allowance payments

According to the Ministry of Labor, Invalids and Social Affairs , the decree and circular guiding the adjustment of pensions, social insurance benefits, and monthly allowances take effect from August 14 but can be implemented from July 1.

Today, July 13, the Ministry of Labor, Invalids and Social Affairs sent an official dispatch to the Vietnam Social Security regarding adjustments to pensions, social insurance benefits and monthly allowances.

The Ministry of Labor, Invalids and Social Affairs said that on June 29, the Government issued Decree No. 42/2023/ND-CP adjusting pensions, social insurance benefits and monthly allowances and the Ministry of Labor, Invalids and Social Affairs also issued Circular No. 06/2023/TT-BLDTBXH dated June 29 guiding the adjustment of pensions, social insurance benefits and monthly allowances.

According to the provisions of the decree and circular, the adjustment of pension and allowance payment levels will be implemented from July 1.

Therefore, the payment period of September 2023 will be made according to the new benefit level and the additional difference of July and August 2023 will be returned to the beneficiary.

The Ministry of Labor, Invalids and Social Affairs requests the Vietnam Social Security to organize the adjustment and payment of pensions, social insurance benefits and monthly allowances in accordance with the provisions of Decree No. 42/2023/ND-CP and the instructions in Circular No. 06/2023/TT-BLDTBXH mentioned above, ensuring timely and full benefits for beneficiaries.

Explaining why the decree and guiding circular take effect from August 14 but can be implemented from July 1, the Ministry of Labor, Invalids and Social Affairs cited the provisions of Clause 1, Article 156 of the Law on Promulgation of Legal Documents: "In case the provisions of a legal document take effect retroactively, those provisions shall apply."

Previously, on July 12, Deputy Prime Minister Tran Hong Ha requested the Vietnam Social Security to pay pensions and allowances at the new increased rate from the August 2023 salary period, and at the same time pay the additional difference of the July 2023 salary period in August 2023.

Deputy Prime Minister Tran Hong Ha emphasized that this is to ensure the regime and policies for pensioners, social insurance benefits and monthly allowances./.
