Khanh Hoa province proposed that the Ministry of Home Affairs advise the Government to issue regulations on norms and standards in land allocation and construction of religious facilities so that localities have a basis for application in land allocation for religious activities and construction permits for religious works.
Regarding this issue, the Ministry of Home Affairs' Electronic Information Portal has responded. According to the Ministry of Home Affairs , the norms and standards for land allocation are: Based on the legitimate needs of religious organizations and affiliated religious organizations; based on the scale of religious activities and the number of residents (number/density of followers) of religious organizations and affiliated religious organizations; based on the land fund of the People's Committee of the province or centrally-run city assigned according to the planning approved by competent authorities.
Regarding the norms and standards for granting construction permits for religious works: Must comply with the provisions of the Law on Belief and Religion and the Land Law for religious works, regulations for religious and belief land. The design and construction area must comply with the provisions of the Construction Law and be consistent with local planning, and must be approved by the competent authority.
Construction of religious works must comply with the provisions of Article 80 of the Construction Law and must be approved by the competent authority. In case there are any design adjustments to religious works during construction, it is necessary to report and have the competent authority approve the adjustment compared to the original technical design.
Religious works must also comply with the regulations on construction licensing like other works in Article 89 of the Construction Law (except for works in Clause 2, Article 89 which are exempted from construction permits); it is important to clearly define religious works here and be consistent with the terminology in the Law on Belief and Religion.
For the Ministry of Construction: According to the provisions of Article 52 of the 2014 Construction Law, amended and supplemented in 2020, religious works only need to prepare economic and technical reports, and the appraisal of construction design is organized by the investor.
However, in reality, religious buildings are places where many people gather, even very many people, many buildings are very large in scale (height can be up to 30 - 40m). Compared to many other civil works (for example, guard houses with a height > 6m) belonging to level III buildings, specialized construction agencies must appraise the construction design), large-scale religious buildings need to coordinate with specialized agencies on beliefs and religions in the locality to build and appraise to avoid affecting the safety of the building.
