Presenting the Report, Minister of Labor, War Invalids and Social Affairs Dao Ngoc Dung said that compared to the 2013 Law on Employment, the draft Law on Employment (amended) has a number of major amendments and supplements.
In particular, with the group of policies on flexible, effective, modern, sustainable, integrated and focused labor market management, the draft law has amended and supplemented regulations on the labor market information system; supplemented regulations on labor registration; supplemented regulations on training, fostering, updating knowledge and professional skills on employment services.
Regarding the group of policies to perfect unemployment insurance policies as a tool for labor market management, Minister Dao Ngoc Dung said that the draft law has added subjects participating in unemployment insurance, including: Employees with a labor contract with a term of 01 month or more (currently 03 months or more) ; Part-time workers, with monthly salaries equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions, ensuring consistency with the Law on Social Insurance 2024.
In addition, the bill also amends the unemployment insurance contribution rate in the following direction: Employees pay a maximum of 1% of monthly salary; Employers pay a maximum of 1% of the monthly salary fund of employees participating in unemployment insurance; The State supports a maximum of 1% of the monthly salary fund for unemployment insurance contributions of employees participating in unemployment insurance and is guaranteed by the central budget.
On the other hand, the bill amends unemployment insurance regimes such as: support regime for participation in training, fostering and improving vocational skills for workers, consulting and job referral regimes...
Regarding the group of policies on vocational skills development and improving the quality of human resources, the draft law has added regulations on vocational skills development in the direction of: Regulations on the purpose and content of vocational skills development; National vocational skills framework; Responsibilities of employers and educational institutions on vocational skills development; Support for vocational skills development activities...
The bill also amends and supplements regulations on national vocational skills assessment in the following directions: Adding regulations on national vocational skills assessors; amending regulations on national vocational skills certificates; adding new regulations on recognition of equivalence or exemption from national vocational skills assessment...
The last group of policies informed by Minister Dao Ngoc Dung is to promote sustainable job creation. Accordingly, the draft law amends regulations on capital sources for job creation loans to perfect the legal basis, ensure the consistency and uniformity of the law, contribute to increasing capital sources and improving the efficiency of job creation loans in the following directions: Central budget allocated to the Social Policy Bank from other development investment expenditures; National Employment Fund source converted into Central budget source allocated to the Social Policy Bank (to ensure compliance with the provisions of the State Budget Law 2015) ; Local budget source entrusted through the Social Policy Bank; Mobilized source of the Social Policy Bank; Capital source of other organizations and individuals entrusted through the Social Policy Bank. At the same time, it is necessary to supplement regulations on the People's Councils at provincial and district levels to arrange local budget capital including other development investment capital, regular expenses and other legal capital sources, and assign the People's Committees at the same level to entrust the Social Policy Bank to implement loans to create jobs.
In addition, the revised Law on Employment is expected to stipulate that the subjects borrowing capital to work abroad under contract are workers working abroad under contract (not limited to 05 subjects as in the current Law), at the same time, it stipulates priority subjects for borrowing capital with lower interest rates and regulations to ensure flexibility and initiative in capital sources of localities, organizations and other individuals entrusted to the Bank for Social Policies.../.
