National Assembly 'finalizes' many special mechanisms and policies for building nuclear power plants

This morning, the National Assembly passed the Law on Atomic Energy, stipulating special mechanisms and policies for investment and construction of nuclear power projects and research nuclear reactor projects.

The Law stipulates that the State promotes the development and application of atomic energy for peaceful purposes, serving socio-economic development, protecting the environment, improving the quality of people's lives; contributing to ensuring energy security; prioritizing investment and diversifying capital sources for the development and application of atomic energy.

The State ensures the budget for scientific research and technological development in the field of atomic energy; builds and operates a national environmental radiation monitoring and warning network.

At the same time, there are preferential mechanisms for training, fostering, attracting, using and reusing human resources; investing in technical facilities, equipment and laboratories for research and training establishments.

The new law provides transitional provisions on special mechanisms and policies for investment and construction of nuclear power projects and research nuclear reactor projects issued before the effective date of this law.

These mechanisms and policies will continue to be implemented until they are abolished or replaced by other legal documents.

Nuclear power projects that have been decided on investment policies before the effective date of this Law shall be implemented according to the national power development plan in cases where other plans at the same level, regional plans, provincial plans or plans of a technical or specialized nature have not been updated, adjusted or supplemented.

Building nuclear power plants must ensure national defense and security.

This law sets out many specific conditions for the construction site of a nuclear power plant. Accordingly, the investor is responsible for surveying and assessing in detail the construction site of a nuclear power plant based on natural and man-made factors that may have an external impact on the safety of the plant.

In addition, the selection must take into account the radiation from nuclear power plants that can be harmful to humans and the environment; population density, distribution and measures to respond to radiation incidents and nuclear incidents.

Along with that, the location of a nuclear power plant must take into account the characteristics of national defense, security, order and safety of the location, including the risk of illegal intrusion, sabotage, terrorist attacks and factors affecting the assurance of security and safety during the construction, testing, operation and decommissioning of the nuclear power plant.

The Prime Minister considers and approves the location for the construction of a nuclear power plant. The location approval is made before or at the same time as the decision to invest in the construction of a nuclear power plant.

Safety monitoring and security assurance throughout the plant life cycle

Before the National Assembly voted to approve, Chairman of the Committee on Science, Technology and Environment Le Quang Huy said that the policy contents had been received, revised, were principled and assigned to the Government for detailed regulations.

These contents include regulations on training support, human resource treatment, socialization, and strengthening international cooperation in the field of atomic energy.

Regarding nuclear power plants, the draft law has been reviewed and revised in terms of investment, construction, operation, and termination of nuclear power plants.

At the same time, the draft also stipulates safety monitoring and security assurance throughout the life cycle of nuclear power plants, ensuring consistency of the legal system, in accordance with international practices and IAEA guidelines.

Because radiation safety, nuclear safety and nuclear security are particularly important issues, the draft law stipulates a national nuclear and radiation safety agency that ensures compliance with the requirements of the International Atomic Energy Agency (IAEA), international treaties to which Vietnam is a member, international practices and the Vietnamese context.

The draft law also provides a chapter on radiation safety, radiation protection, nuclear safety and nuclear security. It includes regulations on locations for storing, processing and burying radioactive waste, spent radioactive sources and spent nuclear fuel...
