The Ministry of Justice has issued Circular 03/2024/TT-BTP amending and supplementing 08 circulars related to administrative procedures in the field of judicial support. Each circular has additional provisions on the responsibility for exploiting and using information in the National Population Database.
Supplementing regulations on responsibility for exploiting and using information in the National Population Database
Specifically, the responsibility for exploiting and using information in the National Population Database is stipulated as follows:
1. Competent authorities, cadres, civil servants, public employees and individuals assigned to receive and resolve administrative procedures and provide public services are responsible for exploiting and using information in the National Population Database to resolve administrative procedures and provide public services.
2. The exploitation and use of information in the National Population Database is carried out as follows:
- In case of online application submission: information is extracted from the National Population Database to automatically fill in the form, the person performing the administrative procedure does not need to declare. If the information is not automatically filled in the form, the person performing the administrative procedure must declare it completely.
- In case of submitting paper documents (submitting directly or by post): the person performing the administrative procedure must fully declare in the form.
3. Information subject to exploitation and use under Clause 1 of this Article includes:
- Gender;
- Nationality;
- Permanent residence;
- Current residence.
The above contents are added to the following 8 Circulars:
1. Circular No. 05/2021/TT-BTP dated June 24, 2021 of the Minister of Justice guiding a number of articles and measures to implement the Law on Lawyers, Decree detailing a number of articles and measures to implement the Law on Lawyers;
2. Circular No. 01/2010/TT-BTP dated February 9, 2010 of the Minister of Justice detailing and guiding the implementation of a number of articles of Decree No. 77/2008/ND-CP dated July 16, 2008 of the Government on legal consultancy;
3. Circular No. 01/2021/TT-BTP dated February 3, 2021 of the Minister of Justice detailing a number of articles and measures to implement the Law on Notarization;
4. Circular No. 05/2020/TT-BTP dated August 28, 2020 of the Minister of Justice detailing a number of articles and measures to implement Decree No. 08/2020/ND-CP dated January 8, 2020 of the Government on the organization and operation of Bailiffs;
5. Circular No. 11/2020/TT-BTP dated December 31, 2020 of the Minister of Justice regulating card forms, procedures for issuing new and re-issuing judicial expert cards;
6. Circular No. 06/2017/TT-BTP dated May 16, 2017 of the Minister of Justice regulating the framework program of auction training courses, auction training facilities, internship and testing of auction practice internship results and forms in the field of property auction;
7. Circular No. 12/2012/TT-BTP dated November 7, 2012 of the Minister of Justice promulgating a number of forms on the organization and operation of commercial arbitration;
8. Circular No. 02/2018/TT-BTP dated February 26, 2018 of the Minister of Justice promulgating and guiding the use of a number of forms on the organization and operation of commercial mediation.
In addition to supplementing regulations on the responsibility for exploiting and using information in the National Population Database, Circular 03/2024/TT-BTP also replaces the application forms, declarations, and forms specified in the 8 Circulars mentioned above.
