Officially abolish ministry inspectors, district inspectors and department inspectors

On June 25, with 443/445 delegates participating in the vote, the National Assembly passed the Law on Inspection (amended). The law takes effect from July 1, with many new points regarding the inspection agency system.

Eliminate ministry, district and department inspectors

According to the new law, the inspection agency will be organized according to a two-level model, including the Government Inspectorate and provincial inspectorates. Along with that are the inspection agencies in the People's Army, the People's Public Security and the State Bank of Vietnam ; the key inspection agency; and the inspection agency established according to international treaties.

Compared with current regulations, the new law has abolished the ministerial inspection agencies, district inspection agencies, departmental inspection agencies, general department-level inspection agencies, etc.

Regarding duties and powers, the Government Inspectorate will inspect the implementation of policies, laws, duties and powers of ministries, ministerial-level agencies, government agencies and provincial People's Committees.

At the same time, inspecting the implementation of policies, laws, tasks and powers of agencies, organizations, units and individuals under the management of the ministry without a ministry inspectorate.

The Government Inspectorate will also inspect law enforcement in areas under the state management of ministries that do not have ministerial inspectorates; inspect the management and use of state capital and assets in enterprises...

Meanwhile, the provincial inspectorate will inspect the implementation of policies, laws, tasks and powers of specialized agencies, other administrative organizations and public service units under the provincial People's Committee; commune-level People's Committee; units and individuals under specialized agencies under the provincial People's Committee and commune-level People's Committee.

In addition, it inspects the compliance with the law in areas under the state management of specialized agencies under the provincial People's Committee; inspects the management and use of state capital and assets at enterprises whose owners are represented by the provincial People's Committee, except in cases where the Government Inspectorate conducts inspections...

Inspectors are entitled to a portion of the recovered funds.

The new law stipulates that the inspection agency is allowed to deduct a portion of the money recovered and discovered through inspection after being submitted to the state budget according to regulations of the National Assembly Standing Committee to spend on activities and improve the capacity of the inspection agency.

During the law-making process, there were suggestions to consider the regulation on funding allocation, because inspection activities have been guaranteed by the state budget, this regulation creates a feeling of being unobjective. Instead, it should be regulated in the direction that the State provides sufficient resources, means, and has a separate treatment regime for inspection activities regardless of the recovery results.

There are also opinions suggesting clearly specifying the deduction rate in the law.

In the report on receiving and explaining the above content, the Government said that the inspection agency's right to deduct a portion of the money recovered and discovered through inspection has been regulated and implemented stably since 2006 until now.

The nature of this financial mechanism is to compensate for the shortage of budgetary resources allocated according to the staffing standards for inspection agencies; to support and enhance inspection capacity, strengthen material facilities for inspection agencies and reward and encourage organizations and individuals with achievements in inspection work.

Annually, inspection agencies report the amount of money recovered through inspection and actually paid to the budget, along with the estimated budget use, to the financial agency at the same level to submit to the competent authority for budget allocation; spending according to the norms, standards, and regimes, with documents according to regulations; spending is controlled through the State Treasury and assessed, inspected, audited, etc.

The Government added that the funds extracted from the recovered amount discovered through inspection will be used for: additional spending to strengthen inspection work, receive citizens, handle petitions, resolve complaints and denunciations, prevent and combat corruption and negativity; strengthen facilities; reward; special professional expenses...
