On the morning of September 29, the National Assembly Standing Committee continued its 49th session, giving opinions on the Law on Civil Servants (amended).
Presenting the draft law, Deputy Minister of Home Affairs Nguyen Hai Long, the Government representative, said that the draft law innovates the recruitment process by clearly stipulating that recruitment is carried out in two forms: examination and selection. At the same time, the draft law adds regulations on accepting people with experience working in both the public and private sectors to become civil servants.

At the same time, the Government proposed expanding the rights of civil servants to allow them to sign contracts to carry out professional activities, participate in capital contributions, and manage enterprises to synchronize with specialized laws on science - technology, education - training.
Regarding the mechanism for evaluating civil servants, Mr. Long said that the draft law stipulates principles and authority for evaluating civil servants to ensure regular, continuous, and multi-dimensional evaluation based on results, work products, quality of public services, and satisfaction of people, organizations, and businesses.
During the review, Deputy Chairman of the Law and Justice Committee Nguyen Truong Giang said that the Law and Justice Committee (the review agency) believes that the employment contract for civil servants is a special type of labor contract.
Therefore, it is recommended that the drafting agency review the specific provisions of the employment contract for civil servants to stipulate in the draft, as a basis for the Government to stipulate in detail. At the same time, supplement the principled provisions on unilateral termination of employment contracts, because this provision directly affects the right to work of citizens, and needs to be specifically stipulated in the law.

"Civil servants are not recruited to stay in the system for life"
Giving his opinion, Chairman of the Economic and Financial Committee Phan Van Mai said that the issue of contracts with civil servants in the future will be very important and it is necessary to study specific regulations in the law.
"We almost think of civil servants as lifelong employees, but here, contracts are for a limited period of time, with entry and exit, so signing a contract is very important. Therefore, we must gradually change our perception from lifelong employees to being job-based and term-based," Mr. Mai said.
National Assembly Chairman Tran Thanh Man suggested that the law amendment should ensure increased transparency and prevent abuse in civil servant recruitment. "As I said before, it is flexible, but it is not acceptable to have too many civil servants who do not meet the standards," the National Assembly Chairman stated.
The National Assembly Chairman also noted the need to develop a system for evaluating civil servants in the coming time. Currently, the Party regulates evaluating Party members every three months, so civil servants must also be evaluated on whether they have completed or not completed their tasks. "Not being recruited means staying in the system for life," the National Assembly Chairman emphasized.
Approving the management of civil servants by job position, the National Assembly Chairman noted that this issue has been discussed for a long time but the job position has not been determined. At the same time, the innovation in recruitment of civil servants, classification of public service units, strengthening the responsibility of heads of public service units; enhancing the application of information technology, digital transformation; ensuring the rights and benefits of civil servants... are issues that the National Assembly Chairman believes need to be clarified.
The National Assembly Chairman said that the draft law is qualified to be submitted to the upcoming 10th session of the National Assembly, serving the streamlining of the apparatus organization.
"Comrades, since the implementation of the restructuring and streamlining of the apparatus, our whole country has had about 130,000 cadres, civil servants and public employees resign according to Decree 178. Therefore, the ultimate goal of amending the Law on Public Employees is to improve the quality of public employees in the coming time," the National Assembly Chairman emphasized.
