Regarding the cancellation of an auction result involving a commune official due to legal violations, Mr. Tran Binh Trong, Chairman of the People's Committee of Quynh Hung commune, Quynh Luu district, Nghe An province, stated that the auction of 56 land plots in the Dong Quan area (Hamlet 5, Quynh Hung commune) was conducted openly and transparently.

However, the wrong buyers led to legal violations. Specifically, Mr. Nguyen Van Trong, an accounting officer in Quynh Ba commune, Quynh Luu district, is the younger brother of Mr. Nguyen Van Quy, currently the Vice Chairman of Quynh Luu district, who directly approved land prices, conducted appraisals, and set the starting prices for the land plots put up for auction.

"After the auction, before the decision recognizing the auction results was issued, the district discovered that Mr. Nguyen Van Trong had violated the regulations and was not eligible to participate in the auction, so they issued a decision not to recognize his participation," said the Chairman of the People's Committee of Quynh Hung commune.

The auction involved 56 land plots with a starting price of nearly 60 billion VND. At the end of the auction, all 56 plots were successfully sold for 85 billion VND. Ten people won the auction for these 56 plots. The person who won the least number of plots won one, while the two people who won the most won 23 and 20 plots respectively.

According to the Chairman of the People's Committee of Quynh Hung commune, in addition to Mr. Nguyen Van Trong winning 23 lots, his son, Mr. Nguyen Van Tu, won 20 lots. "Mr. Trong's son did not violate any regulations, so the results are considered normal. The auction was conducted through a secret ballot, openly and under the supervision of many local residents," said the Chairman of the People's Committee of Quynh Hung commune.

Regarding this matter, Mr. Nguyen Van Trong, the accountant of Quynh Ba commune, confirmed that he had received notification canceling the results of the auction for 23 land plots that he had recently won. Currently, the land auction organizing unit has also notified him that his deposit will be returned.

Mr. Trong said that when he learned that 56 plots of land in the Dong Quan area would be auctioned off, a relative of his who runs a business in Hanoi investigated and decided to buy 4,000 square meters of land in the area for business purposes.

However, due to health reasons, this person was unable to personally participate in the land auction. Therefore, this person subsequently asked Mr. Trong to assist in purchasing the land.

“I paid a 20% deposit on the land plot I won in the auction. When I submitted the land auction documents, I didn't tell Mr. Quy (Deputy Chairman of the People's Committee of Quynh Luu District), so he didn't know. Actually, I didn't know that participating in the land auction was wrong; if I had known, I wouldn't have done it because it was a waste of time,” Mr. Trong explained.

Request for re-auction of 23 land plots.

Mr. Nguyen Van Quy, Vice Chairman of Quynh Luu district, affirmed that during the auction process, although they were brothers, Mr. Nguyen Van Trong did not speak to or ask for his opinion, so he was unaware and therefore could not provide guidance to ensure compliance with the law.

"The results of the auction were assessed by the supervisory unit as objective and fair, with no collusion or conspiracy. It can be affirmed that the initial purpose of the auction was to achieve a good outcome," Mr. Quy said.

According to the Vice Chairman of Quynh Luu district, the process of setting the starting price for the auction is a collective effort. Specifically, the district hired an independent consulting firm with the function of appraising prices.

After this unit submits the certificate, the district's valuation council meets, and the Finance Department advises the District People's Committee to make a decision. He himself only signs the decisions on behalf of the Chairman and the District People's Committee, and is not the one who directly makes the decisions.

Further discussing the auction date, the Vice Chairman of Quynh Luu district said that, based on the starting price, whoever bids higher wins. To win all 23 land plots, Mr. Trong had to raise the price of each plot by an average of 300 million to 800 million VND compared to the initial starting price. Accordingly, on average, Mr. Trong won each land plot for between 1 and 1.8 billion VND.

Land auctions in Quynh Luu district over the past six months have yielded very low results, reaching only over 280 billion VND. Many communes, such as Quynh Giang, Quynh Lam, and Son Hai, held land auctions but failed to produce any results.

“The auction process was at a stage under the responsibility of the auction company when the district discovered the aforementioned violation. Immediately, the district ordered it to stop and issued a decision not to recognize Mr. Trong's auction results, and simultaneously requested a re-auction,” said the Vice Chairman of Quynh Luu District.

As previously reported, following a report on June 28, 2023, from the auction supervisory team stating that the winning bidder for 23 land plots in Quynh Hung commune was the younger brother of the person who signed the decision approving the starting price for the auctioned land plots, the People's Committee of Quynh Luu district did not recognize the auction results and directed an investigation to clarify the matter.

The People's Committee of Quynh Luu District has instructed the auction company to urgently complete the procedures for handling 23 residential land plots that were announced as winning bids by the company's auctioneers but violated the law; and to submit a report clearly explaining the responsibilities involved in the auction process and procedures that led to the errors.
