The conference was attended by Mr. Trieu The Hung, Vice Chairman of the National Assembly 's Committee on Culture and Society; members participating in drafting the Law on Advertising, the Law on Heritage and the National Target Program on Cultural Development for the period 2025-2035 of the National Assembly 's Committee on Culture and Society, members of relevant departments and units of the Ministry of Culture, Sports and Tourism.
Towards the Law on Cultural Heritage being effectively implemented and highly practical
At the Conference, the report of the Ministry of Culture, Sports and Tourism on the development of the Law on Cultural Heritage stated that, in the Program of the 8th Session of the 15th National Assembly, with 413/422 delegates present voting in favor (reaching a rate of 86.22%), the National Assembly of the Socialist Republic of Vietnam officially passed the Law on Cultural Heritage on the afternoon of November 23, 2024 - Vietnam Cultural Heritage Day.
The Law on Cultural Heritage consists of 9 chapters and 95 articles, an increase of 2 chapters and 22 articles compared to the current Law (7 chapters and 73 articles), closely following the goals, viewpoints and major policies approved by the National Assembly, institutionalizing the Party's guidelines and policies on building and developing Vietnamese culture and people to meet the requirements of sustainable national development;
At the same time, it is necessary to resolve institutional bottlenecks, be consistent with the current legal system and be compatible with international treaties to which the Socialist Republic of Vietnam is a member in the process of organizing the implementation of management, protection and promotion of cultural heritage values.
The Law on Cultural Heritage recently passed by the National Assembly has basic new points to resolve shortcomings, ensure constitutionality and continuity, only regulate new issues that are clear, verified in practice, and highly stable; amend overlapping, inappropriate, and unsuitable provisions.
The Law on Cultural Heritage was passed by the National Assembly with a very high approval rate, creating a legal basis for the development of detailed regulations for the implementation of the Law and legal documents related to the field of management, protection and promotion of cultural heritage values to be complete and synchronous, meeting the urgent requirements arising from the actual cause of protecting and promoting the values of the country's cultural heritage. The Law on Cultural Heritage takes effect from July 1, 2025.
The Ministry of Culture, Sports and Tourism acknowledges the dedicated contributions and support of domestic and international experts and managers of cultural heritage to the Drafting Committee of the 2024 Law on Cultural Heritage; the sense of responsibility and dedication to the goal of the Law on Cultural Heritage being effectively implemented with high practicality of the National Assembly's Committee on Culture and Education (now the Committee on Social Culture);
The cooperation of ministries, departments and branches from central to local levels together proposed arising problems and difficulties in practice, to contribute ideas to perfect the draft Law, and the press and media have reported promptly, propagandized major policies into life, and raised the responsibility of each citizen, community, agency and organization in the management, protection and promotion of the value of documentary heritage.
An important milestone in the process of perfecting the legal system on advertising
Regarding the Law on Advertising, implementing Resolution No. 129, after a thorough preparation process, on July 4, 2024, the Minister of Culture, Sports and Tourism - authorized by the Prime Minister - signed Submission No. 350/TTr-CP, submitting to the National Assembly the Draft Law amending and supplementing a number of articles of the Law on Advertising.
After the Government submitted the Draft Law to the National Assembly, the Ministry of Culture, Sports and Tourism closely coordinated with the National Assembly's Committee on Culture and Society to review, compare and complete the contents of the Draft Law.
On September 24, 2024, at the 37th Session, the National Assembly Standing Committee reviewed and gave official comments on the Draft Law. Immediately afterwards, the Ministry coordinated with relevant agencies to study and seriously absorb the comments of the National Assembly Standing Committee and the review report of the National Assembly's Committee on Culture and Society, and continued to complete the project dossier.
With careful preparation and practical content, the Project received high consensus from the XV National Assembly delegates.
Since the Draft Law was commented on, the Ministry of Culture, Sports and Tourism has proactively coordinated with the Committee for Culture and Education - the agency reviewing the Draft Law, to organize many seminars and discussions to collect in-depth opinions from ministries, branches, associations, businesses, domestic and foreign experts, as well as subjects directly affected by the Law.
The reception and revision are carried out in a spirit of openness, science and practice, to ensure that the revised and supplemented contents will truly overcome existing shortcomings, while building a modern and effective legal corridor, meeting the requirements of managing domestic advertising activities, and in line with international development and integration trends.
After a thorough and serious preparation process, on June 16, 2025, at the 9th Session, the 15th National Assembly officially passed the Law amending and supplementing a number of articles of the Law on Advertising. The Law will take effect from January 1, 2026.
The promulgation of the Law is not only the result of a long journey of effort, but also an important milestone in the process of perfecting the legal system on advertising.
This is the common result of close coordination, high sense of responsibility and dedication of all agencies assigned the task: from the drafting agency, appraisal agency, verification agency, to ministries and branches coordinating to give comments.
National target program - an important driving force
Regarding the National Target Program on Cultural Development for the 2025 - 2035 period, the National Assembly approved the investment policy at the 8th session of the 15th National Assembly in Resolution No. 162 dated November 27, 2024. Up to now, the implementation has completed the draft of the most basic documents of the Feasibility Study Report to be sent to the competent authority for approval.
To obtain the policy and consensus of the political system, of agencies from central to local levels and individuals and organizations related to the cultural field, there is the continuous contribution of participating agencies, coordinating to build the Program policy, especially agencies of the National Assembly such as the Committee on Culture and Education (now the Committee on Culture and Society).
The policy of developing the Program can be an important source of motivation from the highest leaders of the Party and State at the 2021 National Cultural Conference. The orientations for cultural development in the next period are clearly stated and tasks are set for cultural agencies to start researching and developing the Program.
Since the beginning of 2022, the Ministry of Culture, Sports and Tourism has proactively researched and developed a proposal for investment policy for the Program and has consulted agencies, research institutes, scientists, especially the Committee on Culture and Education as an agency of the National Assembly, and also asked for opinions from comrades in the Committee as individuals, people who are dedicated to the cause of cultural development of the country.
On August 14, 2023, the Ministry of Culture, Sports and Tourism issued Document No. 219/TTr-BVHTTDL on the appraisal of the Program's Investment Proposal Report attached to the Program's Investment Proposal Report No. 218/BC-BVHTTDL.
Implementing procedures in accordance with the provisions of the Law on Public Investment, on April 17, 2024, the Government issued Resolution No. 50/NQ-CP approving the Report on proposed investment policy and authorizing the Minister of Culture, Sports and Tourism to represent the Government to submit to the 15th National Assembly for consideration and approval of the program's investment policy.
With the spirit of urgency and support from the Government and the Ministry of Culture, Sports and Tourism, following the advice of the Committee for Culture, Education and Training, on May 12, 2024, the National Assembly Standing Committee held a meeting to give opinions on the Report proposing the program's investment policy.
On May 13, 2024, the National Assembly's Committee on Culture and Education issued Verification Report No. 2429/BC-UBVHGD15. On May 19, 2024, the Secretary General of the National Assembly issued Notice No. 3652/TB-TTKQH concluding that the National Assembly Standing Committee gave its opinion on the Investment Policy Proposal Report.
Implementing Resolution No. 142/2024/QH15 dated July 9, 2024 on the 7th Session of the 15th National Assembly, the Ministry of Culture, Sports and Tourism has seriously received and explained the opinions of the National Assembly and completed the report on the proposed investment policy for the Program.
On September 13, 2024, the Government issued Resolution No. 140/NQ-CP approving the Report proposing the investment policy of the Program and authorizing the Minister of Culture, Sports and Tourism to represent the Government to submit to the 15th National Assembly for consideration and approval of the investment policy of the Program.
Once again, the Committee on Culture and Education promptly organized an examination, reported to the National Assembly Standing Committee, sought opinions from National Assembly deputies and worked closely with the Ministry of Culture, Sports and Tourism to absorb and edit the content according to the requests of National Assembly deputies to ensure that the submitted documents were in accordance with regulations.
On November 27, 2024, at the 8th session, the National Assembly approved Resolution No. 162/2024/QH15 approving the investment policy of the Program.
Up to now, the Ministry of Culture, Sports and Tourism has closely followed the content of Resolution No. 162 to develop a feasibility study report to submit to the Prime Minister (on May 20, 2025) and is finalizing the Prime Minister's Decisions approving the set of criteria for implementing the Program as well as the Decision stipulating the principles, criteria, and norms for allocating central budget capital and the corresponding ratio of local budgets to implement the Program.
Putting legal regulations into practice
At the Conference, authorized by Minister of Culture, Sports and Tourism Nguyen Van Hung, Deputy Minister Trinh Thi Thuy awarded Certificates of Merit of the Minister to individuals who have made active contributions to the work of building and perfecting the Law amending and supplementing a number of articles of the Law on Advertising, the Law on Cultural Heritage and the National Target Program on Culture for the period 2025 - 2035.
Speaking at the congratulatory and respectful speech, expressing gratitude for the contributions and support of the Committee on Culture and Society (formerly the Committee on Culture and Education), and members participating in the process of drafting the Law amending and supplementing a number of articles of the Law on Advertising, the Law on Heritage and the National Target Program on Cultural Development for the period 2025 - 2035, Deputy Minister Trinh Thi Thuy said: At two consecutive sessions of the National Assembly, the Ministry of Culture, Sports and Tourism submitted a Report and the National Assembly approved 3 important tasks according to the work plan of the Ministry of Culture, Sports and Tourism and the direction of the Minister of Culture, Sports and Tourism.
These are all key tasks, important legal tools as well as the basis for implementing tasks on state management of the culture, sports and tourism sector.
At the same time, it contributes to perfecting the foundation for innovating state management methods in extremely important areas of the culture, sports and tourism sector.
According to the Deputy Minister, all three of these tasks have a very elaborate and serious process from the agency in charge of the construction, the Ministry of Culture, Sports and Tourism, and the coordination between the Ministry of Culture, Sports and Tourism and ministries, branches and localities to complete the dossier to submit to the National Assembly.
The Deputy Minister said that during the implementation process, there were many difficulties and many lessons learned.
The 2021 National Cultural Conference proposed the Party's guiding views, including the orientation for building the National Target Program on cultural development.
To carry out this task, the Ministry of Culture, Sports and Tourism closely coordinated with ministries and branches, especially with the National Assembly's Committee on Culture and Education at that time, and advised competent authorities to organize a national workshop on "Institutions, policies and resources for cultural development". At this workshop, Party and State leaders and agencies identified key tasks to build a national target program on cultural development and also considered this a strategic task.
Regarding the Law on Cultural Heritage and the Law on Amendments and Supplements to a Number of Articles of the Law on Advertising, these are the core areas in the state management of the industry and are closely linked to the people and businesses. During the construction process, there were also many changes and adjustments in the law-making policy.
According to the Deputy Minister, in the coming time, the Ministry of Culture, Sports and Tourism still has many tasks that require the coordination of the Committee for Culture and Society to complete the legal framework for the management of the industry, such as the plan to develop and submit to the National Assembly for approval to amend and supplement a number of articles of the Law on Tourism, the Law on Physical Education and Sports, or complete the legal framework for the fields of Performing Arts, Fine Arts, Photography and Exhibitions.
“In the process of implementing according to functions and tasks, to bring legal regulations into life, monitoring the implementation is extremely important. I hope that comrades in the Committee for Culture and Society will continue to direct and coordinate the implementation of monitoring the implementation according to legal regulations to contribute to promoting and bringing legal regulations into real life” - Deputy Minister Trinh Thi Thuy expressed.
