At the press conference of the Da Nang City government on April 14, Mr. Nguyen Hong An - Deputy Director of the Da Nang Department of Natural Resources and Environment - said that the city will revoke 238 red books issued in violation of regulations for houses and land located in the planning area of ​​the railway station project in Lien Chieu district (the planning has now been canceled).

According to Mr. An, the People's Court of Da Nang has declared that the granting of land use right certificates to these 238 cases is not in accordance with the law and must be revoked.

Da Nang City People's Committee directed and assigned Lien Chieu District to coordinate with relevant agencies to handle the matter according to their authority. Lien Chieu District People's Committee has implemented the following procedures to recover and cancel.

However, Mr. An said the current problem is that people have lived on the land belonging to the 238 red books mentioned above, so the revocation and cancellation must take into account social security issues.

"Therefore, the recovery and implementation solutions must be calculated for these cases," said Mr. An.

It is known that in 2020, Lien Chieu District People's Court tried the case of Tran Van Thoi (55 years old, Hoa Khanh Nam ward) and his accomplices for the crime of Forging seals and documents of agencies and organizations.

Tran Van Thoi and his accomplices were accused of falsifying 238 land records in Lien Chieu district in the planning area of ​​the former railway station project to obtain land use right certificates from the Department of Natural Resources and Environment.

After the first instance trial, the defendants and those with related rights and obligations filed an appeal, requesting the appellate court to retry the case without canceling the issued red book.

At the appeal hearing, the People's Court of Da Nang did not accept the appeal of those with related obligations and rights, accepted the conclusion of the court of first instance, and recommended that the Department of Natural Resources and Environment revoke and cancel the above 238 red books.
