On the afternoon of October 10, the National Assembly Standing Committee (NASC) gave its opinion on the policy of adjusting land use planning for the 2021-2030 period, with a vision to 2050.

Proposal to adjust 8 land use indicators

Presenting the Government's Proposal on the decision on the policy of adjusting the National Land Use Plan for the period 2021 - 2030, with a vision to 2050, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that currently, a number of land use indicators in the national land use plan and the National Land Use Plan to 2025 approved by the National Assembly are no longer suitable to actual needs. Notably, the Party Central Committee has also approved the investment policy for the North-South High-Speed Railway Project with a land use scale of about 10,827 hectares (the Government is expected to submit to the National Assembly for consideration and decision on the investment policy at the 8th Session of the 15th National Assembly), leading to increased land use demand for important national infrastructure projects and works.

Therefore, if not adjusted and supplemented, it will limit the demand for using certain types of land in localities, causing difficulties in implementing key national projects, projects with the potential to attract investment, contributing to the implementation of socio-economic development goals approved by the National Assembly, the Government, and the Prime Minister.

According to the provisions of the 2024 Land Law and Decree No. 102/2024/ND-CP, the Government will submit to the National Assembly the adjustment of the National Land Use Planning for the period 2021 - 2030, with a vision to 2050, with the main contents including:

Firstly, adjust 8 land use indicators including: Agricultural land group (rice land, special-use forest land, protective forest land, production forest land is natural forest); non-agricultural land group (national defense land, security land).

Second, the National Land Use Plan was not submitted to the National Assembly for approval. The calculation and determination of the eight land use indicators in the revised National Land Use Plan this time requires a thorough review and balancing of land use indicators of sectors, fields and localities.

In particular, priority is given to allocating land for national defense and security purposes, stabilizing rice-growing land to ensure national food security, strictly managing forest land, maintaining forest cover to contribute to protecting the ecological environment, responding to climate change and achieving sustainable development goals.

Examining this content, Chairman of the National Assembly's Economic Committee Vu Hong Thanh said that the Standing Committee of the Economic Committee agreed with the necessity of adjusting the national land use planning because of the grounds and contents as stated in the Government's Submission.

However, the Standing Committee of the Economic Committee proposed to clarify that in case the National Assembly decides to adjust the National Land Use Plan, how many provincial plans, national sectoral plans or other related plans must be adjusted to ensure consistency and impact of the adjustment. At the same time, continue to review and clarify the causes, especially subjective causes, leading to the proposal to adjust land use planning indicators to ensure that they are close to practical needs...

Clarify the basis, assess the impact; avoid wasting land resources

Speaking at the session, National Assembly Chairman Tran Thanh Man emphasized the importance of the Land Use Planning for the 2021-2030 period, with a vision to 2050; stating that when submitting this content to the National Assembly, it is necessary to clearly demonstrate the policy, ensuring compliance with the 7 bases stated in Article 53 of the Law on Planning. At the same time, clarify the bases for the necessity of adjusting the National Land Use Planning.

The National Assembly Chairman stated that the principle of adjusting the National Land Use Plan must comply with legal regulations on reviewing and adjusting plans.

On the other hand, the National Assembly Chairman suggested that it is necessary to ensure land use needs to achieve socio-economic development goals, ensure national defense and security, and allocate land resources reasonably, economically, and effectively to local sectors and fields. Comply with the requirements for developing infrastructure systems, food security, water resources, forest coverage, ecosystems, and properly solving social issues, including the need for residential land and production land for ethnic minorities.

Regarding the content of the policy to adjust land use planning, the National Assembly Chairman requested to clarify the contents expressing the policy to adjust the planning, because according to the current report, there is only a policy on necessity.

Chairman of the National Assembly's Law Committee Hoang Thanh Tung also proposed to clarify the basis for proposing adjustments to the Planning Law according to the provisions of the Planning Law. Along with that, the Government needs to supplement the impact assessment, clarify the impact of the Planning adjustment on lower-level plans of the Planning in the national planning system such as sectoral planning, regional planning, planning of provinces and cities approved by the Prime Minister so that National Assembly deputies have sufficient basis to consider and decide.

Concluding the meeting, Vice Chairman of the National Assembly Nguyen Duc Hai stated that the Standing Committee of the National Assembly agreed to submit to the National Assembly for consideration and decision on the policy of adjusting the Planning according to the Government's proposal; requesting the Government to be responsible for the data on the implementation of the Planning and land use needs stated in the Submission.

The Standing Committee of the National Assembly requested the Government to absorb the opinions of the Chairman of the National Assembly and the Standing Committee of the National Assembly, the opinions of the examining agency, complete the dossier and submission, and increase the persuasiveness when submitting to the National Assembly. In addition, analyze and evaluate comprehensively, clarify the proposed causes, bases, solutions, pay attention to the indicators, improve the effectiveness of the implementation of the Planning and the need to adjust land use planning; assess the impact of adjusting the Land Use Planning on the need to adjust related planning, the impact on the urbanization process and infrastructure development, the development of industries and high-tech zones to use land effectively, avoid wasting land resources.../.
