Continuing the 31st session, the National Assembly Standing Committee gave opinions on explaining, accepting and revising the draft Law on Road Traffic Order and Safety.
Reporting on some major issues of the draft Law on Road Traffic Order and Safety, Chairman of the National Defense and Security Committee Le Tan Toi said that during the review process, there were still many opinions related to the ban on driving when there is alcohol in the blood or breath.

First type of opinion: Agree with the draft Law to prohibit the act of driving a vehicle on the road while having alcohol concentration in the blood or breath.
Regarding the advantages, Mr. Toi said that this regulation is inherited from the 2008 Road Traffic Law and is consistent with the provisions in Clause 6, Article 5 of the 2019 Law on Prevention and Control of Alcohol and Beer Harms. The above regulation has been tested in practice and has shown good results.
The number of accidents related to alcohol has decreased. The prohibition of the above behavior with the purpose of preventing and reducing the risks and potential damages caused by the use of alcohol while driving is supported by scientists . Up to now, the above prohibition has been put into practice, has been widely agreed upon by the people and is gradually forming a culture of "don't drive after drinking alcohol".
Regarding endogenous alcohol concentration detected through breath, up to now there is no clear basis; it can be re-checked through blood test to avoid erroneous processing results.
Regarding limitations, the regulation of absolute prohibition of alcohol concentration is strict and affects the alcohol and beer consumption habits of a part of Vietnamese people; has a certain impact on some cultural activities and traditional festivals of some localities; reduces the consumption of alcoholic beverages, thereby affecting the production, import, distribution, supply and consumption of alcohol and beer in our country.

Second type of opinion: Suggest to consider the above regulation and need to have an evaluation report, summary, scientific basis to give the lowest limit.
The advantage of this regulation is that it meets the needs of a part of the population, creating more favorable conditions for people who have consumed alcohol to drive vehicles; does not reduce the consumption of alcoholic beverages, does not affect the production, import, distribution, supply, and consumption of alcohol and beer in our country and indirectly affects many workers in the production and business chain.
Regulations on the alcohol concentration limit for drivers participating in road traffic are similar to regulations of many countries around the world .
However, the limitation is that it increases the number of traffic accidents, leading to increased consequences and damages caused by traffic accidents such as damage to life, health, and property of drivers and other traffic participants. It is difficult to ensure feasibility when people who drink alcohol cannot know when to stop.
The Standing Committee of the National Defense and Security Committee believes that this is a major issue that affects all drivers participating in traffic and has received special attention from voters and public opinion in recent times. Based on the opinions of the National Assembly Deputies, the Standing Committee of the National Defense and Security Committee synthesizes and proposes two options:
Option 1: Regulations prohibiting the act of driving a vehicle on the road while having alcohol concentration in the blood or breath (inheriting the provisions of Clause 6, Article 5 of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer 2019, applicable to all types of road vehicles).
Option 2: The provisions of the 2008 Road Traffic Law prohibit: “Driving a car, tractor, or specialized motorbike on the road with alcohol concentration in the blood or breath. Driving a motorbike or moped with alcohol concentration in the blood exceeding 50 milligrams/100 ml of blood or 0.25 milligrams/1 liter of breath”. At the same time, the relevant provisions in Clause 6, Article 5 of the 2019 Law on Prevention and Control of Alcohol Harm must be amended.
"The Standing Committee of the National Defense and Security Committee agrees with the Government's proposal and earnestly recommends that the Standing Committee of the National Assembly choose Option 1 to report to the National Assembly for permission to continue inheriting current regulations to protect many lives, health, and property of the people, protect resources for society, and protect the longevity of the race," emphasized Chairman Le Tan Toi .
