TPO - The draft amendment to Decree 155 proposes removing obstacles in handling surplus public office buildings after organizational restructuring. For office buildings with areas larger than the standard, but which cannot be divided or no agency needs to take over, units may be considered for continued use.

The Ministry of Finance has released a draft Decree amending and supplementing several articles of Decree No. 155/2025/ND-CP, proposing a more flexible mechanism for handling office buildings and operational facilities with areas exceeding standards and norms after organizational restructuring, aiming to resolve practical difficulties in the process of merging, consolidating, and transferring public assets.

According to the new proposal, in cases of mergers, consolidations, divisions, dissolutions, cessation of operations, or changes in management, the receiving unit will receive the headquarters in its current state, then review the area according to standards and norms before submitting it to the competent authority for management and use.

Notably, for areas exceeding the prescribed standards and norms, if no other suitable agency, organization, or unit is available to take over, the competent authority may consider returning the area to the unit currently managing and using it, and this area will be determined to be "not exceeding the standards and norms".

The draft also adds regulations for cases of transferring or relocating headquarters that are not subject to merger or consolidation, but where the area exceeds the standard or prescribed limits and the excess area cannot be separated, or where no other unit has a need to receive it. In such cases, based on the request to receive the assets in their current state from the requesting unit, the competent authority may decide to transfer or relocate the assets in their current state.

After receiving the assets, the user unit will continue to review and process them according to regulations. In cases where assets are transferred outside the scope of management of a ministry or central agency, the agreement of the minister, head of the central agency, or chairman of the People's Committee of the relevant province is required.

As of April 27th, the Department of Public Assets Management - Ministry of Finance reported that 11,396 surplus land and property assets have been recovered and transferred to local authorities for management, requiring further processing in phase 2. Of these, 9,228 assets were recovered by local authorities, and 2,168 assets were transferred by central government agencies.

To date, 5,027 facilities have completed processing or been put into operation, and 6,369 The facilities are still in the process of being processed. Of the incomplete facilities, only 2,622 are. While some facilities have already had plans for processing and utilization developed, 3,747 other facilities still lack specific utilization plans.
