At the Conference, Deputy Head of the Provincial National Assembly Delegation Hoang Duc Thang informed about the 10th Session of the 15th National Assembly , and emphasized that about 50 draft laws and resolutions will be considered and approved at the session, which are of important significance in perfecting the legal system, ensuring consistency, synchronization, and conformity with the 2-level local government organization model that provinces and cities across the country have deployed in the past three months.
Therefore, Deputy Head of the Provincial National Assembly Delegation Hoang Duc Thang suggested that delegates, experts and relevant agencies analyze and evaluate core issues to perfect the content of draft laws, contributing to improving the quality of law-making work, meeting the country's development requirements in the new period.
At the Conference, through practice, representatives of agencies and units gave comments on the draft laws.
Regarding the Law on Detention, Temporary Detention and Prohibition of Leaving the Place of Residence, the representative of Quang Tri Provincial Police said that after operating a two-level government, detention and temporary detention encountered some difficulties and problems when the management work was transferred from the district level to the provincial level, with a large number of prisoners. Regarding the prohibition of leaving the place of residence, there was an overlap when currently the commune level manages people, while the records are managed by the provincial level, causing difficulties in implementation. Therefore, the representative of Quang Tri Provincial Police proposed to unify regulations on the authority to manage people and records to ensure strictness and convenience in performing public duties.
The representative of the People's Court of Quang Tri province also agreed with the proposal of the Provincial Police, and proposed a number of changes in regulations to ensure strict enforcement of the law.
Regarding the Law on Enforcement of Criminal Judgments (amended) and the Law on Enforcement of Civil Judgments (amended), the representative of the People's Court of Quang Tri province proposed a number of contents related to the dissipation of assets, rights and obligations of the person enforcing the judgment; the time limit for handling the case in Clause 1, Article 34, Article 38, Article 57 of the Law on Enforcement of Civil Judgments (amended); determining the competent authority to decide the legal status of mentally ill people in the Law on Enforcement of Criminal Judgments (amended).
Representatives of the Quang Tri Provincial Bar Association proposed a number of contents related to the Law on Civil Judgment Enforcement (amended). Accordingly, there should be a specific time limit for the steps and procedures for enforcement; additional regulations on verification of conditions for enforcement; consideration of the use of centralized databases, regulations on the obligations of third parties, regulations on the obligations of enforcement officers. In addition, the application of information technology in civil judgment enforcement procedures should be considered as an indicator to evaluate local civil judgment enforcement agencies; at the same time, civil judgment enforcement should be socialized.
Commenting on the Law on Drug Prevention and Control (amended), the representative of Quang Tri Provincial Police proposed to clearly show the content of implementation resources; carefully review and assess the impact of the policy contents stated in the draft; supplement regulations on the common database on drug prevention and control, the list of illegal drug users, drug addicts, connect information from ministries, branches, localities and control legal activities related to drugs; at the same time, supplement regulations related to specific groups of subjects, including: pregnant women, women with young children, girls, etc. The representative of Quang Tri Provincial Customs proposed to supplement authority in the field of drugs.
Regarding the Law on Forensic Expertise (amended), the Quang Tri Provincial Police Department suggested quantifying some phrases such as "specialized knowledge, practical experience". The Provincial Forensic Center and the Quang Tri Provincial Department of Health recommended maintaining the forensic expertise model as prescribed in the 2012 Law on Forensic Expertise in order to synchronize the organization from the Central to the local level; overlapping content on functions and tasks with the Police force.
Concluding the Conference, Deputy Head of the Provincial National Assembly Delegation Nguyen Minh Tam acknowledged the comments of representatives of agencies and units. The comments of delegates and voters will be compiled by the Provincial National Assembly Delegation to be sent to the drafting agency for consideration and comments at the upcoming 10th Session of the 15th National Assembly.
