Ethnic minority people receive a 50% reduction in non-agricultural land rent.

Hanoi: A resolution from Hanoi stipulates a 50% reduction in land rent for non-agricultural land (excluding residential land) used for production and business purposes without auction.

On the afternoon of June 2nd, at its third session, the Hanoi City People's Council passed a Resolution stipulating land policies for ethnic minorities living in the city with 100% of the attending delegates voting in favor.

According to the resolution, residential areas, villages, and hamlets in ethnic minority regions will be allocated and planned with community living land in accordance with the customs, traditions, beliefs, and actual conditions of each locality, with a minimum area of ​​300m² or more.

The policy on initial land support for individuals from ethnic minorities classified as poor or near-poor households in ethnic minority areas within Hanoi (as stipulated in Clause 2, Article 16 of the Land Law No. 31/2024/QH15) is implemented as follows: Land allocation for residential purposes within the limits prescribed by the Hanoi People's Committee, with exemption from land use fees; permission to convert land use purposes from other land types to residential land within the limits prescribed by the Hanoi People's Committee, with exemption from land use fees for land originating from land allocation, lease, recognition, inheritance, donation, or transfer of land use rights by the State in accordance with the law.

The resolution also stipulates that the leasing of non- agricultural land (excluding residential land) for production and business purposes will not be subject to auction and will be subject to a 50% reduction in land rent; the leased land area will be decided by the commune-level People's Committee based on the land fund and actual needs of the locality.

For ethnic minority households classified as poor or near-poor who have been allocated or leased land by the State but currently have no land or insufficient land compared to the prescribed limit, the city will consider providing additional support.

Specifically, in cases where there is no longer any residential land available, land may be allocated for residential purposes or the land use purpose may be changed to residential land, and the land use fee will be waived. If the residential land area is less than the permitted limit, the land use purpose may be changed to ensure compliance with the regulations.

In cases where agricultural land is no longer available or the area of ​​agricultural land currently in use is less than 50% of the land allocation limit for agricultural land as stipulated by the City People's Committee, the land may be further allocated within the limit stipulated by the City People's Committee without collecting land use fees, or non-agricultural land (excluding residential land) may be leased without auction for production and business purposes, with a 50% reduction in land rent, unless otherwise stipulated by law; the area of ​​non-agricultural land leased shall be decided by the commune-level People's Committee based on the actual situation and the local land fund.
