A business establishment trading in planted forest timber without full procedures in Huong Xuan commune, Phu Loc district

Previously, the District People's Committee directed the Department of Agriculture and Environment to coordinate with the Department of Finance and Planning, the Department of Economy , Infrastructure and Urban Areas, and the People's Committee of Huong Xuan commune to inspect and verify the land use of the two establishments of Ms. Tran Thi Loc and Mr. Truong Thai Huy (both trading in planted forest wood) in Huong Xuan commune.

Regarding the current land use status of Ms. Tran Thi Loc's establishment, it is land for non- agricultural production and business (Commercial and service land - land code TMD) which is not suitable for the purpose of land use as residential land and land for growing perennial crops. Specifically, Ms. Tran Thi Loc's establishment has leased land from Mr. Vo Xuan Thuong and Ms. Nguyen Thi Minh Tam under a contract dated October 30, 2024 with the leased area including 100m2 of residential land and 400m2 of land for growing perennial crops. Similarly, Mr. Truong Thai Huy's establishment also trades in forest timber on land for growing perennial crops.

Because the current land use status of the above-mentioned plots (TMD Land) is not suitable for the purpose of land use, the Department of Agriculture and Environment, relevant agencies, and the People's Committee of Huong Xuan Commune have requested Ms. Tran Thi Loc and Mr. Truong Thai Huy to stop production, trading and trading of planted forest wood and using weighing stations at the two locations related to the above incident until the competent authority approves the multi-purpose land use plan in accordance with regulations.

The representative of the Department of Agriculture and Environment of Phu Loc district said that regarding business registration and traffic connection procedures, Ms. Loc and Mr. Huy both complied with the regulations. However, some land procedures were not complete. Pursuant to the provisions of Article 218 of the 2024 Land Law; Article 99 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law, the competent authority requested Ms. Tran Thi Loc and Mr. Truong Thai Huy to contact the land user to urgently develop a land use plan for commercial and service purposes to submit to the District People's Committee for approval in accordance with the order and procedure No. 20 of Decision No. 629/QD-NNMT dated April 3, 2025 of the Ministry of Agriculture and Environment ; the time to complete and submit the dossier according to administrative procedures is before May 12, 2025.

After May 12, 2025, in case Ms. Tran Thi Loc, Mr. Truong Thai Huy and the land user do not comply with the above content, the District People's Committee is requested to direct the Chairman of the People's Committee of Huong Xuan commune to establish procedures to handle in accordance with legal regulations. At the same time, regularly inspect and monitor the compliance of relevant individuals to promptly sue, prevent and handle violations in accordance with legal regulations on land.

According to Ms. Nguyen Thi Bich Ngoc, Party Secretary and Chairwoman of Huong Xuan Commune People's Committee, the locality has been coordinating with specialized agencies to guide relevant individuals to develop plans for land use combined with commercial and service purposes. Phu Loc District People's Committee also requested functional agencies and localities to regularly inspect and monitor the compliance of relevant individuals to promptly detect, prevent and handle violations in accordance with land law.
