Previously, the District People's Committee directed the Department of Agriculture and Environment to coordinate with the Department of Finance and Planning, the Department of Economy , Infrastructure and Urban Development, and the People's Committee of Huong Xuan commune to inspect and verify the land use of two establishments owned by Ms. Tran Thi Loc and Mr. Truong Thai Huy (both engaged in the business of plantation timber) in Huong Xuan commune.
Regarding the current land use status of Ms. Tran Thi Loc's establishment, it is non- agricultural production and business land (Commercial and service land - land type code TMD), which is inconsistent with the intended land use purpose of residential land and land for perennial crops. Specifically, Ms. Tran Thi Loc's establishment leased land from Mr. Vo Xuan Thuong and Ms. Nguyen Thi Minh Tam under a contract dated October 30, 2024, with the leased area comprising 100m2 of residential land and 400m2 of land for perennial crops. Similarly, Mr. Truong Thai Huy's establishment also conducts business in plantation timber on land designated for perennial crops.
Due to the current land use status of the aforementioned plots (Commercial and Industrial Land) not conforming to the intended land use purpose, the Department of Agriculture and Environment, relevant agencies, and the People's Committee of Huong Xuan Commune have requested Ms. Tran Thi Loc and Mr. Truong Thai Huy to cease all production, business, and trading activities related to planted forest timber and the use of weighing stations at the two locations involved in the above case until a multi-purpose land use plan is approved by the competent authority in accordance with regulations.
Representatives from the Phu Loc District Department of Agriculture and Environment stated that Ms. Loc and Mr. Huy have complied with regulations regarding business registration and traffic connection procedures. However, some land-related procedures are incomplete. Based on the provisions of Article 218 of the 2024 Land Law and Article 99 of Government Decree No. 102/2024/ND-CP dated July 30, 2024, detailing the implementation of some articles of the Land Law, the relevant authorities have requested Ms. Tran Thi Loc and Mr. Truong Thai Huy to urgently contact the land users to prepare a land use plan combining commercial and service purposes for submission to the District People's Committee for approval, in accordance with procedure No. 20 of Decision No. 629/QD-NNMT dated April 3, 2025, of the Ministry of Agriculture and Environment ; the deadline for completion and submission of administrative documents is before May 12, 2025.
After May 12, 2025, if Ms. Tran Thi Loc, Mr. Truong Thai Huy, and the land users fail to comply with the above provisions, the District People's Committee is requested to direct the Chairman of the Huong Xuan Commune People's Committee to initiate procedures for handling the matter in accordance with the law. At the same time, regular inspections and monitoring of compliance by relevant individuals should be conducted to promptly detect, prevent, and handle violations in accordance with land law regulations.
According to Ms. Nguyen Thi Bich Ngoc, Secretary of the Party Committee and Chairwoman of the People's Committee of Huong Xuan commune, the locality has been coordinating with specialized agencies to guide relevant individuals in developing land use plans for combined commercial and service purposes. The People's Committee of Phu Loc district also requested functional agencies and localities to regularly inspect and monitor the compliance of relevant individuals to promptly detect, prevent, and handle violations in accordance with land law regulations.
