Are contract teachers civil servants?

To ensure teaching quality and the number of teachers in the classroom, many schools are forced to recruit additional contract teachers. Are these people civil servants?

According to Article 2 of the Law on Public Employees 2010, public employees are Vietnamese citizens recruited according to job positions, working at public service units under labor contracts, receiving salaries from the salary fund of public service units according to the provisions of law.

Therefore, in the case of contract teachers at public service units, they will not be considered civil servants.

If you want to become a civil servant, you must base it on the job requirements, job position, professional title standards and salary fund of the public service unit. Recruitment of civil servants is done through examination or selection.

Article 22 of the Law on Civil Servants stipulates that the conditions for registration for recruitment must be that the person meets the following conditions:

  • Nationality and residence in Vietnam;
  • 18 years of age or older. For some fields of cultural, artistic, physical education and sports activities, the recruitment age may be lower according to the provisions of law; at the same time, there must be written consent of the legal representative;
  • Application form;
  • Clear background;
  • Have a diploma, training certificate, practice certificate or have skills suitable for the job position;
  • Physically fit to perform the job or duties;
  • Meet other conditions as required by the job position as determined by the public service unit but must not be contrary to the provisions of law.

Are contract teachers entitled to social insurance?

According to Article 2 of the Law on Social Insurance 2014, contract teachers are subject to compulsory social insurance if their labor contract is for a term of 1 month or more.

Specifically, employees working under indefinite-term labor contracts and labor contracts with a term of 1 month or more must participate in compulsory social insurance. Short-term labor contracts (from 1 to less than 3 months) are also subject to compulsory social insurance.

Thus, if a school signs a labor contract with a teacher for 1 month or more, they must participate in compulsory social insurance according to regulations, helping contract teachers enjoy insurance regimes such as sickness, maternity, work accidents, occupational diseases, retirement and death, similar to other workers in the compulsory social insurance category.
