Removing bottlenecks in the implementation of the Land Law in Da Nang.

On May 7th, the Land Management Department (Ministry of Agriculture and Environment), in coordination with the People's Committee of Da Nang City, organized a conference to disseminate and implement Resolution No. 254/2025/QH15 of the National Assembly on some mechanisms and policies to remove difficulties and obstacles in the implementation of the Land Law.

The conference focused on guiding the implementation of new regulations in Resolution No. 254/2025/QH15 and guiding documents such as Government Decree 49/2026/ND-CP detailing and guiding some articles of Resolution No. 254/2025/QH15, and Government Decree No. 50/2026/ND-CP detailing some articles of Resolution No. 254/2025/QH15 on land use fees and land lease fees. These are important legal frameworks aimed at resolving existing bottlenecks and promoting effective state management of land at the local level in the new context.

Speaking at the conference, Deputy Director of the Land Management Department Mai Van Phan emphasized that implementing Resolution 254/2025/QH15 and the guiding decrees of the Government is an urgent task. The new regulations not only help Da Nang and other provinces and cities resolve obstacles for real estate projects and land reclamation projects, but also create a transparent legal framework, helping businesses and people access land resources more effectively. Through the opinions and contributions of delegates, government officials, and investors at the conference, the Land Management Department gained practical insights from the grassroots level to further refine policies and ensure their effective implementation.

Vice Chairman of Da Nang City People's Committee Tran Nam Hung affirmed that land management is a particularly important political task with profound impacts on the socio-economic stability and national defense and security of the locality. In recent times, although Da Nang has resolutely directed the implementation of the Land Law, after nearly two years of operation, the 2024 Land Law still reveals many shortcomings, especially in the stages of land allocation, land valuation, compensation, and site clearance.

Faced with these "bottlenecks," the Vice Chairman of the Da Nang City People's Committee, Tran Nam Hung, expects that Resolution 254/2025/QH15 of the National Assembly, along with Decrees 49/2026/ND-CP and 50/2026/ND-CP, will be crucial legal "keys" to transparentizing mechanisms and simplifying administrative procedures to the maximum extent. The central goal is to raise awareness and responsibility among officials and leaders, focusing on thoroughly studying the new regulations to completely overcome old limitations. At the same time, Da Nang hopes that the Ministry of Agriculture and Environment will continue to cooperate, resolve practical obstacles, and create momentum to unlock land resources to serve the sustainable development of the city.

At the conference, delegates heard presentations on new policy initiatives, notably addressing obstacles to projects and reforming administrative procedures. One of the key focuses was strengthening decentralization and delegation of power to local governments. Accordingly, provincial People's Committees are granted the authority to decide on many important issues such as: land acquisition, compensation, and resettlement support; land allocation and leasing; land use conversion; and approval of land use plans for projects.

Ms. Kieu Thi Kim Dung, Deputy Head of the Policy and Legal Affairs Department (Land Management Agency), provided an in-depth analysis of the roadmap for preparing and implementing the two-tiered government system. Notably, Resolution 254/2025/QH15 emphasizes the principle of thorough decentralization and delegation of power to the provincial level. Accordingly, localities are granted a high degree of autonomy in deciding on land acquisition, compensation, resettlement support, as well as approving land use plans for mixed-use investment projects.

Regarding administrative procedure reform, the conference emphasized that provincial People's Committees must urgently develop and issue administrative procedures for land management that are appropriate to local realities, no later than July 1, 2026. During the transition period, units should flexibly apply current regulations but must ensure transparency on the local government's and the Ministry of Agriculture and Environment's electronic portals so that citizens and businesses can easily monitor them.

Regarding the financial sector, the conference clarified the new regulations on land prices and land price tables according to Decree 49/2026/ND-CP. New points include the addition of land price adjustment coefficients such as: market fluctuation adjustment coefficient, planning adjustment coefficient, and other influencing factors.

Regarding land price tables, local authorities have the power to amend and supplement them in cases of changes in administrative boundaries, street names, or when there are significant fluctuations in market prices exceeding the prescribed limits. Notably, the process of constructing land price tables has been streamlined, eliminating the requirement to create price tables for each individual plot of land based on value zones, thus accelerating implementation in localities. The conference also dedicated time to discussing the mechanism for paying for land funds for projects under build-transfer (BT) contracts, regulations on the sale of assets attached to land leased with annual payments, and conditions for multi-purpose land use.
