The resolution was issued to improve the quality of life and stabilize the livelihoods of ethnic minority communities in the city.
The resolution stipulates land policies for ethnic minorities residing in Hanoi City in accordance with Clause 6, Article 16 of the Land Law No. 31/2024/QH15.
The applicable subjects include: agencies with functions in land management and land finance; residential areas, hamlets, and villages in ethnic minority areas within Hanoi city; individuals from ethnic minorities who are classified as poor or near-poor households in ethnic minority areas within Hanoi city; and other subjects related to land management and use.

The resolution specifies the following land support policies for ethnic minorities:
Residential areas, villages, and hamlets in ethnic minority regions are allocated and planned with land for community activities for ethnic minorities in accordance with their customs, traditions, beliefs, cultural identity, and the actual conditions of each region, with a minimum area of 300m² or more.
The policy on initial land support for individuals from ethnic minorities classified as poor or near-poor households in ethnic minority areas within Hanoi (as stipulated in Clause 2, Article 16 of the Land Law No. 31/2024/QH15) is implemented as follows: Land allocation for residential purposes within the limits prescribed by the Hanoi People's Committee, with exemption from land use fees; permission to convert land use purposes from other land types to residential land within the limits prescribed by the Hanoi People's Committee, with exemption from land use fees for land originating from land allocation, lease, recognition, inheritance, donation, or transfer of land use rights by the State in accordance with the law.
Non- agricultural land (excluding residential land) can be leased for production and business purposes without auction, and the land rent will be reduced by 50%, except where otherwise stipulated by law; the area of non-agricultural land leased will be decided by the People's Committee of the commune based on the actual situation and the local land fund.
The land support policy to ensure stable livelihoods for ethnic minority individuals who have been allocated or leased land by the State but now have no land or insufficient land compared to the allocated limit, and who are classified as poor or near-poor households in ethnic minority and mountainous areas within Hanoi city, is implemented as follows:
In cases where there is no longer any residential land available, the applicant may be allocated residential land or permitted to convert the land use purpose from other land types to residential land within the residential land allocation limits stipulated by the City People's Committee, and will be exempt from land use fees.
In cases where the area of residential land currently in use is smaller than the local land allocation limit for residential land, it is permitted to convert the land use purpose from other land types to residential land within the land allocation limit stipulated by the City People's Committee, and the land use fee will be waived.
In cases where there is no more agricultural land available or the area of agricultural land currently in use is less than 50% of the land area allocated according to the agricultural land allocation limit stipulated by the City People's Committee, the land may be further allocated within the limit stipulated by the City People's Committee without collecting land use fees, or non-agricultural land (excluding residential land) may be leased without auction for production and business purposes, with a 50% reduction in land rent, unless otherwise stipulated by law; the area of non-agricultural land leased shall be decided by the commune-level People's Committee based on the actual situation and the local land fund.
