Hai Phong will enforce demolition of a house that was 'wrongly demolished'

The An Duong district authorities are expected to issue a decision this afternoon to forcibly demolish the house at the intersection of Ton Duc Thang and Nguyen Van Linh streets that was mistakenly demolished.

According to the An Duong District People's Committee, Ms. Pham Thi Thu Trang's house, along with four adjacent houses, was leased by an electronics company to be used as a storefront and had large advertising signs displayed since 2020. In early 2023, the Hai Phong City People's Committee implemented a project to create an intersection at the Ton Duc Thang - Nguyen Van Linh junction, and the entire land occupied by the five houses leased to the electronics supermarket was subject to demolition. Four families agreed to the compensation plan and handed over the land, but Ms. Trang's family did not.

On the morning of August 10, 2023, while demolishing advertising signs on the land of four houses that had already been handed over, a private company hired by the An Duong District Investment and Construction Project Management Board damaged Ms. Trang's house. "The construction unit did a poor job; no one would intentionally demolish a resident's property without agreeing on a compensation plan," said a leader of An Duong district.

Following the incident, Ms. Trang filed a report with the An Duong District Police, requesting an investigation into the destruction of her property and theft, claiming that she "lost many belongings along with a safe containing 30 million VND" during the demolition. The An Duong District Police concluded there were no signs of criminal activity and did not initiate a case. To this day, Ms. Trang continues to file complaints with various agencies requesting a resolution.

To ensure the intersection project proceeds on schedule, on December 14, 2023, the People's Committee of An Duong District issued notices of land acquisition for 139 households. To date, eight households (including Ms. Trang's family) have still not complied with handing over their land for the project, despite having their rights considered and addressed, and despite repeated efforts by various departments and organizations of the district and An Dong commune to persuade them.

Therefore, the An Duong District People's Committee is finalizing the legal documents to issue a decision on compulsory land reclamation this afternoon. "The land reclamation will not affect the process of resolving Ms. Trang's complaint regarding the damage to her house caused by the construction unit," the An Duong district leader affirmed.

The multi-level interchange project at the intersection of Ton Duc Thang and Nguyen Van Linh roads is being implemented in the period 2021-2024, with a total investment of nearly 670 billion VND from the Hai Phong City budget, and is expected to be put into use before the Lunar New Year of 2024.
