Documents in the application for maternity benefits
The Circular specifies a number of documents in the application for maternity benefits, including:
Documents proving the female worker's infertility treatment process, including one of the following documents:
a) Hospital discharge papers;
b) Summary of medical records;
c) Certificate of inpatient treatment;
d) Certificate of infertility treatment of female workers.
Certificate from medical examination and treatment facility on female employee having to take leave for pregnancy, including one of the following documents:
a) Hospital discharge papers;
b) Summary of medical records;
c) Certificate of inpatient treatment;
d) Certificate of leave to receive social insurance;
d) Certificate of maternity leave.
Certificate of mother's unfitness to care for child
In addition, the Circular also clearly stipulates: Form, procedures, and authority to issue a certificate from a medical examination and treatment facility on the condition of a mother who is no longer healthy enough to care for her child after giving birth or a female worker who is a surrogate mother after receiving a child but is no longer healthy enough to care for her child. Accordingly:
The form and method of filling out the medical examination and treatment facility's certificate of the mother's health after giving birth and not being healthy enough to take care of the child or the female worker who is a surrogate mother and not being healthy enough to take care of the child after receiving the child (certificate of the mother not being healthy enough to take care of the child) shall comply with the provisions of Form No. 10, Appendix II issued with this Circular.
Issuance procedure: The medical examination and treatment facility is responsible for returning the appointment letter to the applicant, which must clearly state the time for issuing the certificate confirming that the mother is not healthy enough to care for the child and must issue it within the time stated in the appointment letter.
Authority to issue a certificate confirming that the mother is not healthy enough to care for the child: the medical examination and treatment facility where the mother was examined and treated.
The Circular takes effect from July 1, 2025.
